Priestley V. Fowler (1837) And The Emerging Tort Of Negligence, Michael Ashley Stein

Priestly v. Fowler has long been noted as the source of the doctrine of common employment. This Article, however, argues that the case is better understood in the context of the then-emerging independent tort of negligence-specifically, as an unsuccessful attempt to require of masters a duty of care towards their servants. The Article re-examines the facts, arguments, personalities, and various reported versions of the case in tracing the effort to establish a new duty of care. The Article traces, as well, to another case, Hutchinson v. York, the true origins of the common employment doctrine. Finally, the Article compares the …

Living With Life-Threatening Illness: An Inquiry Into Children's Experience Of Cancer, Kristy Novinski

Previous studies concerning children living with illness have been limited by (a) a narrow focus on the child's cognitive development, (b) reliance on sources outside of the child's experience, (c) reliance on methods based on the language and quantitative modes of measuring used by adults rather than the experience of the child, (d) models that emphasize methods of control in coping, and (e) a tendency to pathologize the responses of the child.

In contrast, the current study involved speaking directly with school-aged children living with a diagnosis of cancer. The qualitative method developed for this study involved a two-fold approach, …

Automated Grammatical Tagging Of Language Samples From Children With And Without Language Impairment, Deborah Millet

Theses and Dissertations

Grammatical classification ("tagging") of words in language samples is a component of syntactic analysis for both clinical and research purposes. Previous studies have shown that probability-based software can be used to tag samples from adults and typically-developing children with high (about 95%) accuracy. The present study found that similar accuracy can be obtained in tagging samples from school-aged children with and without language impairment if the software uses tri-gram rather than bi-gram probabilities and large corpora are used to obtain probability information to train the tagging software.

Fully automated programming language translation has been described as an unrealistic goal, with previous research being limited by a ceiling of 90% successful code translation. The key issues hindering automatic translation efficacy are the: maintainability of the translated constructs; full utilisation of the target language's features; and amount of manual intervention required to complete the translation process. This study has concentrated on demonstrating improvements to the translation process by introducing the programming-language-independent, Unified Modelling Language (UML) and Computer Assisted Software Engineering (CASE) tools to the legacy-system language migration project. Research into the psychology of theatrical dancers has indicated that as a group, dancers may be a high-risk population for psychological disorders. The majority of this research however, has only sampled ballet dancers. In consideration of the fact that contemporary dance is philosophically and aesthetically different from ballet, it is proposed that the experience of contemporary dancers may be different from that of ballet dancers and thus their psychological experience and potential problems may also be different. Companion animals have been identified as improving the physical and emotional health of some older adults (Collis & McNicholas, 1998). This qualitative study explored the psychological impact of owning a cat or a dog for persons aged 65 or older who resided alone. Nine participants, two male and seven female, were recruited through local media advertisements in the Guildford area to participate in a semi-structured interview about their relationship with their pet. Following transcription the semi-structured interviews were analysed using thematic analysis (Aronson, 1994). The current exploratory study examined Psychological Sense of Community (PSOC) in 16 Western Australian school children, between the ages of seven and eight from two schools in the Perth metropolitan region. The aim was to identify whether young children understand the concept of PSOC, within their school environment. A qualitative methodology using semi-structured interviews was employed. Questions were generated based on the Neighbourhood Youth Inventory (NYI) and the Sense of Community Index (SCI), as a measure of children's PSOC in their school environment. This study of three women's experiences ·with studying at university whilst bearing the responsibilities of family and work, investigated the unique situations and problems that these mothers encountered. A qualitative research approach was utilised, using a narrative inquiry method to give voice to the student mothers, which has proved to be lacking in academic research. In addition to an auto-ethnographic case study, two case studies were formulated by conducting conversational interviews with two other student mothers. This research has made a comparative investigated of crosstalk in backside illuminated and frontside illuminated single junction photodiode and vertical double junction photodiode CMOS compatible pixels, using a commercial 2D device simulation package, SEMICAD DEVICE (1994). Comparison of pixel total, electron and hole quantum efficiency response and Absorption Volume data is undertaken. This is so that the underlying carrier drift-diffusion dynamics responsible for optimal pixel response resolution may be qualitatively understood, allowing prediction of even more optimal photodiode pixel configurations. It is theorised that the ability to "listen" to an explosion is possible by detecting gravitational waves. By choosing to remain anonymous, photographers often create images in which only their subjects are exposed. By unveiling their identities however, they often create images in which their interaction becomes evident in the resulting images. On Virtue And Peace: Creating A Workplace Where People Can Flourish, Caryn L. Beck-Dudley, Steven H. Hanks

In this Article, Professors Beck-Dudley and Hanks explore the virtues necessary for individuals to flourish within a business organization. Through this exploration, they conclude that modern discussions of business ethics fail to account for the value and virtue of peaceableness. Then, focusing on the freedom from conflict aspect of peaceableness, they use Champion Paper Products, Sartell Minnesota Paper Mill, as a case study in the significant improvements in human flourishing and organizational performance that can occur when management and labor choose peaceable solutions to labor conflicts.
