Inordinate Chill: Bits, Non-Nafta Mits, And Host-State Regulatory Freedom- An Indonesian Case Study, Stuart G. Gross Jan 2003

Inordinate Chill: Bits, Non-Nafta Mits, And Host-State Regulatory Freedom- An Indonesian Case Study, Stuart G. Gross

Michigan Journal of International Law

A number of structural factors, which are beyond the immediate scope of this Note, may influence less wealthy countries to cave in to investor threats of arbitration, as Indonesia appears to have done here. However, their hesitancy to fight may also be based, in part, on an inadequate understanding of the applicable law, which allows investors to inordinately influence host-State decisions through threats of arbitration that have little or no chance of success. In regard to the mining companies' threat, this at least appears to be the case. As this Note will demonstrate, the GOI could have likely beaten the …

Problem Behavior Theory In An Ethnically Diverse Female Prison Sample, Kristen J. Quinlan Jan 2003

Problem Behavior Theory In An Ethnically Diverse Female Prison Sample, Kristen J. Quinlan

Open Access Master's Theses

Research on female inmates has shown that this population engages in a variety of risky behaviors, like alcohol abuse, drug abuse, and risky sexual activities, and that these problem behaviors seem to share high positive intercorrelations. Problem Behavior Theory (PBT) explains these positive intercorrelations by viewing problem behaviors like alcohol abuse, drug abuse, and risky sexual activities as a single factor, or a single behavioral syndrome. Although the presence of this syndrome has been demonstrated in a variety of ethnically diverse adolescent samples, little work has been done to evaluate its presence in a sample of adults. Adult female inmantes …

Spirituality And The Quality Of Life: Relationships Between Existential Well-Being And Aspectgs Of Life Functioning, Bettina Brigit Höppner Jan 2003

Spirituality And The Quality Of Life: Relationships Between Existential Well-Being And Aspectgs Of Life Functioning, Bettina Brigit Höppner

Open Access Master's Theses

The focus of this thesis is the role of spirituality within the quality of life. This role is explored in a macro-level approach by investigating the overall relationships between existential well-being, of which spirituality is seen as a part of, and life functioning. This macro-level investigation is then followed by a more detailed, variable specific micro-level delineation of relationships.

Recognizing the fact that spirituality cannot be discussed without an implicit reference to the overall concept of religion, the connections between spirituality and religion is explicitly discussed, although this connection is not the focus of this study. Thus, by way of …

Scale Validation Of High School Teachers’ Attitudes Toward Inclusion Of Students With Disabilities, Catherine Ernst Jan 2003

Scale Validation Of High School Teachers’ Attitudes Toward Inclusion Of Students With Disabilities, Catherine Ernst

Open Access Master's Theses

Research has shown that teacher attitudes influence their expectations of students and the way in which they interact with them (Brophy & Good, 1972; Brownwell & Pajares, 1999; Bryan 1974; Cook 2001; Harris, Snodgrass, & Rosenthal, 1986; Jordan & Stanovich, 2001; Kuklinski & Weinstein, 2001; Rosenthal, 2002). Ajzen and Fishbein (1969) developed the Theory of Reasoned Action, which proposes that people's behavior is determined by intention and that these intentions are represented in people's attitudes toward the behavior and the perceived norm of that behavior. Beginning with the passage of Public Law 94-142 and the IDEA reauthorization, regular education teachers …

International Regulation Of Underwater Sound: Establishing Rules And Standards To Address Ocean Noise Pollution, Elena Marie Mccarthy Jan 2003

International Regulation Of Underwater Sound: Establishing Rules And Standards To Address Ocean Noise Pollution, Elena Marie Mccarthy

Open Access Dissertations

An increasing awareness of anthropogenic sound in the ocean has generated international concern that it is affecting marine mammal behavior and could affect entire marine ecosystems as well. Presently there is a lack of a coherent policy framework for evaluating the environmental impacts of underwater noise pollution. No international treaties or laws specifically address the transmission of sound in waters under national jurisdiction or on the high seas. This dissertation examines the issue of underwater noise pollution in a global context and considers the extent to which the international legal and environmental community has addressed it. The sharp increase in …

Journal of the Arkansas Academy of Science

The objective of this study was to assess the water quality of the Big Creek watershed during the winter and spring of 2002 by analyzing water physical, chemical variables, aquatic macro-invertebrates, and habitat. The Big Creek watershed, arising on Crowley's Ridge in northeast Arkansas, is a small deltaic watershed and is an area of intense cultivation. Four stations, Big Creek Upper (BCU), Mud Creek (MC),Lost Creek (LC), and Big Creek Lower (BCL) were established for this study from Big Creek, Mud Creek and Lost Creek. Water samples were collected on a weekly basis for 10 weeks from January 2002 through …

Nationbuilding 101: Reductionism In Property, Liberty, And Corporate Governance, O. L. Reed Jan 2003

Nationbuilding 101: Reductionism In Property, Liberty, And Corporate Governance, O. L. Reed

Vanderbilt Journal of Transnational Law

In this Article, Professor Reed re-examines the importance of property as a formal legal institution. He continues by arguing that central to creating property is the right to exclude others from resources acquired without force, theft, or fraud. In countries where this right has been firmly established, per capita income far exceeds that of countries lacking a strong right to exclude. Professor Reed then asserts the importance to nation builders of appreciating the virtual semantic equivalence of the terms "property" and "liberty." Finally, he argues that both the specific and broad senses of corporate governance can be reduced to property …

Nafta Chapter 11 And Professional Sports In Canada, Robert A. Schmoll Jan 2003

Nafta Chapter 11 And Professional Sports In Canada, Robert A. Schmoll

Vanderbilt Journal of Transnational Law

Modern professional sports leagues are significant economic enterprises, the most prominent of which span the political border between the United States and Canada. In recent decades, local governments in the United States have invested heavily in professional sports franchises by building stadiums and arenas, hoping either to prevent the home team from moving out or to entice someone else's home team to move in. The willingness to pay of U.S. local governments, coupled with apparently disadvantageous economic conditions in Canada, has resulted in a net loss of professional franchises for Canadian cities, in particular franchises in Canada's national game, hockey. …

Urer, The Transcriptional Activator Of The Proteus Mirabilis Urease Gene Cluster, Is Required For Urease Activity And Virulence In Experimental Urinary Tract Infections, Jonathan D. Dattelbaum, C. Virginia Lockatell, David E. Johnson, Harry L.T. Mobley

Chemistry Faculty Publications

Proteus mirabilis, a cause of complicated urinary tract infection, produces urease, an essential virulence factor for this species. UreR, a member of the AraC/XylS family of transcriptional regulators, positively activates expression of the ure gene cluster in the presence of urea. To specifically evaluate the contribution of UreR to urease activity and virulence in the urinary tract, a ureR mutation was introduced into P. mirabilis HI4320 by homologous recombination. The isogenic ureR::aphA mutant, deficient in UreR production, lacked measurable urease activity. Expression was not detected in the UreR-deficient strain by Western blotting with monoclonal antibodies raised against UreD. Urease …

Essential Components Of Psychosocial Care For Newly Diagnosed Breast Cancer Patients, Beverly Lee Laird Jan 2003

Essential Components Of Psychosocial Care For Newly Diagnosed Breast Cancer Patients, Beverly Lee Laird

All ETDs from UAB

Breast cancer is the most commonly diagnosed cancer in women in the United States, and, today, there are approximately 1.7 million women living with breast cancer. Due to earlier detection and better treatments, the 5-year survival rate for breast cancer has increased dramatically in the past few decades. With better survival rates has come increased attention to other needs for cancer patients, including information and psychosocial support. Providing appropriate psychosocial care as an adjunct to standard medical treatment is expected to improve quality of life for cancer survivors, which is one of the three major 2015 goals for the American …

Disaster Prevention Presentation, From Scjil Symposium 2003, Jacqueline Hand Jan 2003

Disaster Prevention Presentation, From Scjil Symposium 2003, Jacqueline Hand

Santa Clara Journal of International Law

This paper covers the development of international legal mechanisms designed to respond to natural disasters. Particularly, disasters brought on or exacerbated by human activities is the focus of this paper. For example, there is often a direct causal link between a disaster and previous environmental degradation. The author provides cases in which previous environmental degradation brought on or worsened disasters. The paper then discusses tools developed to mitigate environmental degradation resulting from poor decision making. These tools fall under the term "environmental impact assessment." In recent years there has been a general movement by the international community in the direction …
