Missouri Law Review
In Purcell Tire and Rubber Co. v. Executive Beechcraft, Inc., the Missouri Supreme Court held that the “express negligence” rule is inapplicable to liability limitations in contracts between sophisticated parties with claims or purely economic losses. Although the decision does not explicitly determine whether the case presented a contract or a tort claim, the result clearly follows from the treatment of the case as a pure contract action. Consequently, the decision parallels the typical result reached under the application of the more well-known “economic loss rule” and appropriately preserves the fundamental distinctions between contract and tort law in cases involving …

Perfecting Patent Prizes, Michael B. Abramowicz

A number of commentators in recent years have suggested permitting holders of intellectual property rights to give up these rights in exchange for cash prizes from the government. In this Article, Professor Abramowicz shows that each of the proposals has significant flaws that would make implementation impractical and argues that no single perfect formula or algorithm for determining the size of prizes exists. A prize system is nonetheless worth pursuing because it could increase social welfare significantly by eliminating deadweight loss. Professor Abramowicz recommends a relatively simple approach that would complement rather than replace the patent system. The proposal is …

The Barbados Marine Reserve (BMR) is a 2.2 km2 no-take marine reserve occupying one of the most intensely used and impacted sections of the coast and comprises four zones: Scientific, Northern Watersports, Recreational, Southern Watersports. Establishment of the BMR in 1981 did little to change the de facto marine resource governance regime for the area. There was minimal consultation of stakeholders in determining the zoning and regulations. Fishers were negatively impacted, and no user group derived significant benefits from the reserve. A mandate to maximise revenues led the National Conservation Commission (NCC), responsible for BMR management, to virtually abandon …

Transcortical motor aphasia (TCMA) is an acquired impairment of language expression that occurs following neurologic damage that affects left frontal cortex and spares perisylvian regions. In some individuals with TCMA, verbal expression is rendered nonfluent due to difficulty spontaneously initiating and elaborating upon verbal messages. Nonfluency arises from impaired activation of intended messages and inhibition of competing verbal expressions. This impairment of the intentional aspects of language expression can be termed 'adynamia.' Because adynamic forms of TCMA occur infrequently, few systematic treatment investigations have been reported for this condition. A rigorous between-subjects methodology employing independent random samples and having broad clinical applicability was designed and implemented to evaluate the effectiveness of back safety and patient transfer training interventions for both hospital nurses and nursing assistants. Effects upon self-efficacy, cognitive, and affective measures are assessed for each of three back safety procedures. The design solves the problem of obtaining randomly assigned independent controls where all experimental subjects must participate in the training interventions.

Randomized Comparisons Among Health Informatics Students Identify Hypertutorial Features As Improving Web-Based Instruction, Craig W. Johnson, Yan Xing, Lan Yang

Hypertutorials optimize five features - presentation, learner control, practice, feedback, and elaborative learning resources. Previous research showed graduate students significantly and overwhelmingly preferred Web-based hypertutorials to conventional "Book-on-the-Web" statistics or research design lessons. The current report shows that the source of hypertutorials' superiority in student evaluations of instruction lies in their hypertutorial features. Randomized comparisons between the two methodologies were conducted in two successive iterations of a graduate level health informatics research design and evaluation course.
