Regulating Genetically Modified Foods: Is Mandatory Labeling The Right Answer?, Gregory Conko Jan 2003

Regulating Genetically Modified Foods: Is Mandatory Labeling The Right Answer?, Gregory Conko

Richmond Journal of Law & Technology

Thank you. It’s a very common mistake to believe that consumers could only have a choice if the government requires mandatory labeling of genetically engineered food. My question back to you, Jean, is, exactly what kind of information do consumers get if all you do is label the product as “Genetically Engineered?” We can take this up later in the debate part of our panel discussion. I think the one thing that we can all agree on, however, is that the food label is a very important source of information to consumers.

Regulating Genetically Modified Foods: Is Mandatory Labeling The Right Answer?, Jonathan Adler

Richmond Journal of Law & Technology

Thank you. It’s a pleasure to be here, and I appreciate the invitation. What I want to talk about are some legal issues relating to labeling and, in particular, constitutional issues relating to mandatory labeling for genetically modified foods or food products that may contain genetically modified components. This is a separate issue from whether or not the FDA, or some other agency, has sufficient statutory authority at present to mandate labeling, and that is something worth discussing. Even if they do have such authority, or even if Congress tomorrow were to give the FDA such authority or were to …

Remarks On Genetically Modified Foods And International Regulation, Tony Van Der Haegen Jan 2003

Remarks On Genetically Modified Foods And International Regulation, Tony Van Der Haegen

Richmond Journal of Law & Technology

Thank you. I certainly don’t want to interfere in the American debate about labeling, since I have already enough problems with European consumers, but what I would like to do today is not only to talk about our legislation a bit, because it’s so detailed and complex, but also to talk about the European/ American trade relations, in particular as it relates to biotechnology. First of all, I would like to say there is a strong trans-Atlantic relationship as far as trade is concerned between the EU and the U.S. We have to realize that we have a trade level …

Panel Remarks On Liability: Liability For Refusing To Use Agricultural Biotechnology, Drew Kershen Jan 2003

Panel Remarks On Liability: Liability For Refusing To Use Agricultural Biotechnology, Drew Kershen

Richmond Journal of Law & Technology

Good afternoon. I’m very pleased to be here. I appreciate the offer and the invitation from the Richmond Journal of Law & Technology to speak at this conference. This final panel is really about liability issues related to genetically modified foods or transgenic crops. Now I just want to quickly introduce these three people, and I’m going to start on my far side with Rachel Lattimore. Rachel Lattimore is a lawyer with the firm of Arent Fox in Washington D.C., and she is going to focus her talk – and we’ve sort of agreed among ourselves so we don’t step …

Panel Remarks On Liability: Liability For Farming?, Rachel G. Lattimore Jan 2003

Panel Remarks On Liability: Liability For Farming?, Rachel G. Lattimore

Richmond Journal of Law & Technology

Good afternoon. To begin, I’d like to thank Ed Wallis and the Richmond Journal of Law & Tech- nology for inviting me to speak on such a distinguished panel. And I’d like to tell you one thing about myself that is not in my fancy lawyer biography. I grew up on a small family farm down in North Caro- lina, so I learned from an early age about the different types of genetic manipulations that go on a farm, from breeding cattle to grafting apple trees, which if you’re fourteen years old, consists of spending your entire Spring Break taking …

Panel Remarks On Liability: Liability Issues: Lessons From Starlink, Donald Uchtmann

Richmond Journal of Law & Technology

Good afternoon ladies and gentlemen. I have an enormous opportunity and challenge. Here I am, the final speaker, on this final panel, on this beautiful Friday afternoon, on this beautiful campus. Stay “tuned” for just a few more minutes to hear my remarks regarding liability issues and then we will adjourn to the great outdoors.

Wills, Trusts And Estates (Annual Survey Of Virginia Law, 2002-2003), J. Rodney Johnson Jan 2003

Wills, Trusts And Estates (Annual Survey Of Virginia Law, 2002-2003), J. Rodney Johnson

Law Faculty Publications

The General Assembly of Virginia enacted legislation dealing with wills, trusts, and estates that added or amended a number of sections of the Virginia Code in its 2003 Session. In addition, there were three opinions and one order from the Supreme Court of Virginia, and one Virginia Circuit Court opinion, that raised issues of interest to the general practitioner as well as the specialist in wills, trusts, and estates during the period covered by this review. This article reports on all of these legislative and judicial developments.

Earned Sovereignty: The Political Dimension, James Hooper, Paul Williams Jan 2003

Earned Sovereignty: The Political Dimension, James Hooper, Paul Williams

Scholarly Articles in Law Reviews & Journals

There are currently over fifty sovereignty-based conflicts throughout the world, and nearly a third of the Specially Designated Global Terrorists listed by the United States Treasury Department are associated with sovereignty-based conflicts and self-determination movements. To date, the "sovereignty first" international response to these conflicts has been unable to stem the tide of violence, and in many instances may have contributed to further outbreaks of violence. This article will argue that the "sovereignty first" doctrine is slowly being supplemented by a new conflict resolution approach which we dub "earned sovereignty."

Restitution In Public Concern Cases, Candace Kovacic-Fleischer Jan 2003

Restitution In Public Concern Cases, Candace Kovacic-Fleischer

Scholarly Articles in Law Reviews & Journals

Enron Corporation. Arthur Andersen. Guns. Tobacco. Lead. Asbestos. Water Pollution. All are in the news as allegedly having caused injury. All involve restitution. Plaintiffs are bringing suits claiming that not only have they been injured, but also that the companies involved have been unjustly enriched at the plaintiffs' expense. The plaintiffs use, either explicitly or implicitly, the broad concept of restitution found in section one of the Restatement of the Law of Restitution. That section, entitled "Unjust Enrichment," says "[a] person who has been unjustly enriched at the expense of another is required to make restitution to the other."' In …

Challenging Legislative Infringements Of The Inherent Aboriginal Right Of Self-Government, Kent Mcneil Jan 2003

Challenging Legislative Infringements Of The Inherent Aboriginal Right Of Self-Government, Kent Mcneil

Articles & Book Chapters

The Parliament of Canada exercised its s.91 (24) legislative authority over "Indians, and Lands reserved for the Indians" when it enacted the Indian Act in 1816. Through this Act and its precursors, the Canadian government imposed the band governance system on First Nations. Although traditional forms of Aboriginal government were not abolished by the imposition of this system, there can be no doubt that the capacity of Aboriginal governments was impaired and the inherent right of self-government of at least some First Nations was infringed. After the enactment of section 35 of the Constitution Act, 1982, this infringement of the …

Beyond Rhetoric: State Sovereignty, Common Concern, And The Inapplicability Of The Common Heritage Concept To Plant Genetic Resources, Ikechi Mgbeoji Jan 2003

Beyond Rhetoric: State Sovereignty, Common Concern, And The Inapplicability Of The Common Heritage Concept To Plant Genetic Resources, Ikechi Mgbeoji

Articles & Book Chapters

Until the emergence of the Convention on Biological Diversity in 1992 and the FAO Treaty on Plant Genetic Resources in 2001, opinion had hardened in some quarters that the principle of a common heritage of mankind regulated international transfer of plant genetic resources, By a historical analysis of customary international law in the colonial age and the recent pedigree of the principle of common heritage, this article points out the fallacies in such arguments and contends that plants have always been subject to various national jurisdictions. It has to be conceded, however, that contemporary developments in the field of international …

Effects Of Concurrent Motor, Linguistic, Or Cognitive Tasks On Speech Motor Performance, Christopher Dromey, April Benson Jan 2003

Effects Of Concurrent Motor, Linguistic, Or Cognitive Tasks On Speech Motor Performance, Christopher Dromey, April Benson

Faculty Publications

This study examined the influence of 3 different types of concurrent tasks on speech motor performance. The goal was to uncover potential differences in speech movements relating to the nature of the secondary task. Twenty young adults repeated sentences either with or without simultaneous distractor activities. These distractions included a motor task (putting together washers, nuts, and bolts), a linguistic task (generating verbs from nouns), and a cognitive task(performing mental arithmetic). Lip movement data collected during the experimental conditions revealed decreases in displacement and velocity during the motor task. The linguistic and cognitive tasks were associated with increased spatiotemporal variability …

Globalization, International Human Rights, And Civil Procedure, Trevor C. W. Farrow Jan 2003

Globalization, International Human Rights, And Civil Procedure, Trevor C. W. Farrow

Articles & Book Chapters

This article discusses the modern convergence of three traditionally separate topics: globalization and international human rights on the one hand, and civil procedure on the other. Its project is twofold: first, to highlight the role of domestic legal processes and communities in the advancement of the post-World War I1 international human rights project. Second - in contemplation of the specific context of teaching civil procedure - to help bring alive the power and increasingly-global context of civil procedure for the benefit of students.

Revising The Model Penal Code: Keeping It Real, Gerard E. Lynch Jan 2003

Revising The Model Penal Code: Keeping It Real, Gerard E. Lynch

Faculty Scholarship

The thesis of this talk can be simply stated: In any serious discussion of revising the Model Penal Code (MPC), the object of the game cannot be revising the MPC itself. Rather, the object of any revision of the Code is to promote the reform of the nation's actual criminal codes, as adopted by the state legislatures and Congress.

An Imaging System Correlating Lip Shapes With Tongue Contact Patterns For Speech Pathology Research, Christopher Dromey, Daniel Bates, Xiaoqian Xu, Sameer Antani, D J. Lee Jan 2003

An Imaging System Correlating Lip Shapes With Tongue Contact Patterns For Speech Pathology Research, Christopher Dromey, Daniel Bates, Xiaoqian Xu, Sameer Antani, D J. Lee

Faculty Publications

In this research, an imaging system was built to work with a newly developed electronic device to help people produce sounds correctly. The system consists of two parts, the internal tongue contact pattern data collection and the external lip shape information analysis. The tongue position information was gathered using the palatometer, an innovative tongue contact pattern-tracking device invented by Dr. Samuel Fletcher. The lip shape information was collected by processing images taken from people articulating different sounds. We developed an efficient color image segmentation technique to extract lip contour points and form a closed curve for shape analysis. The geometry …

Private Lawyers And Environmental Justice, Michael B. Gerrard Jan 2003

Private Lawyers And Environmental Justice, Michael B. Gerrard

Faculty Scholarship

A private lawyer representing a private client is seldom a crusader. When environmental justice is relevant to a particular matter – the client proposes to build a facility and engages the lawyer to help secure necessary governmental approvals, for example-the lawyer's primary duty must be to the client.

The client in such a case faces two primary types of questions: substantive, such as where and how to build the facility; and procedural, deciding what processes to follow and how much to involve the community in the planning. Typically, by the time the lawyer is brought in, the client already has …

Federalism And The Future Of Health Care Reform, Richard Briffault, Sherry Glied Jan 2003

Federalism And The Future Of Health Care Reform, Richard Briffault, Sherry Glied

Faculty Scholarship

An important theme in the ongoing health care reform debate is federalism. During the battle over the Clinton Health Plan in 1993–94, the question of which level of government — federal or state — should take the leading role in health policy was almost as contentious as the particular proposals for extending access to quality health care and controlling health care costs. With the failure in 1994 to achieve comprehensive legislation at the national level, many policymakers and commentators gave fresh attention to the states as potential agents for health care reform.

Towards A New Scholarship For Equal Justice, James S. Liebman Jan 2003

Towards A New Scholarship For Equal Justice, James S. Liebman

Faculty Scholarship

Over the last thirty years, the legal academy has turned a cold shoulder to the subject matter of this symposium: scholarship for equal justice. I am here to suggest that a thaw may be on the way. By scholarship for equal justice – as distinguished from scholarship about that topic – I mean academic work undertaken for the purpose of improving outcomes for individuals and members of groups who have been systematically held back by their race, sex, poverty, or any other basis for rationing success that our legal system treats with suspicion. With reference to some of my own …

Punishment, Proportionality, And Jurisdictional Transfer Of Adolescent Offenders: A Test Of The Leniency Gap Hypothesis, Aaron Kupchik, Jeffrey A. Fagan, Akiva Liberman Jan 2003

Punishment, Proportionality, And Jurisdictional Transfer Of Adolescent Offenders: A Test Of The Leniency Gap Hypothesis, Aaron Kupchik, Jeffrey A. Fagan, Akiva Liberman

Faculty Scholarship

In the past two decades, nearly every state has expanded its authority and simplified its procedures to transfer adolescent offenders from juvenile to criminal (adult) courts. As a result, the use of jurisdictional transfer has grown steadily. These developments reflect popular and political concerns that punishment in juvenile courts is too lenient for serious crimes committed by adolescents. Yet there is mixed evidence that expanded transfer authority has produced more certain or severe punishments for adolescents prosecuted in criminal courts. Some empirical studies show that adolescents transferred to criminal court are more likely to be convicted, sentenced to prison, and …

Introduction To The Decennial Volume, George A. Bermann Jan 2003

Introduction To The Decennial Volume, George A. Bermann

Faculty Scholarship

Ten years ago, when the Columbia Journal of European Law began, the European Union was, as we tend to say, "in a different place" than it is today. The "internal market" or, as it was called, the "1992" program had very largely been achieved, validating the institutional changes wrought by the Single European Act and boosting incalculably the Community's credibility as a regional economic entity and potential international political force. The Member States had just successfully orchestrated what may fairly be regarded as their most ambitious Intergovernmental Conference to date, culminating in the Treaty of Maastricht. While the referendum road …

A Case Study Analysis Of Five African American Male Educational Leaders, Donna Richardson Jan 2003

A Case Study Analysis Of Five African American Male Educational Leaders, Donna Richardson

UNF Graduate Theses and Dissertations

This qualitative study was conducted to elucidate the current understandings about what is known about the African American pathway from seemingly oppressive beginnings to educational leadership positions. It was an investigation of five African American male leaders from Jacksonville, Florida, and their individual and collective perceptions on what enabled them to educationally succeed despite their humble beginnings. The study explored the similarities, differences, and historical experiences of all five of the African American male leaders purposefully chosen for this research. Two categories or types of themes were identified in this study, common background themes and common outcome themes. Six themes …
