Legislating With Integrity, Jeremy Waldron Jan 2003

Legislating With Integrity, Jeremy Waldron

Faculty Articles

I am happy to participate in this symposium honoring the work of John Feerick. My title is "Legislating with Integrity," and I want to distinguish it immediately from a title that I had thought about addressing in this panel, "Integrity in Legislation." If I had called the talk "Integrity in Legislation," I might have embarked on a discussion of some of the themes that Ronald Dworkin raised in his book Law's Empire, for although integrity-a central theme in Dworkin's recent jurisprudence-is invoked in that book largely as a value associated with judicial reasoning, Dworkin also applies the idea of integrity …

India's Wto Challenge To Drug Enforcement Conditions In The European Community Generalized System Of Preferences: A Little Known Case With Major Repercussions For "Political" Conditionality In Us Trade Policy, Robert L. Howse Jan 2003

India's Wto Challenge To Drug Enforcement Conditions In The European Community Generalized System Of Preferences: A Little Known Case With Major Repercussions For "Political" Conditionality In Us Trade Policy, Robert L. Howse

Faculty Articles

The use of trade sanctions for broad foreign policy purposes has been a matter of longstanding controversy in the US. Apart from questioning the effectiveness of such sanctions, and pointing out that they may have innocent victims, free traders often claim that sanctions violate the rules of the WTO. Here, Howse details a case brought by India to the WTO dispute mechanism, which is against the European Community (EC) that originally attacked conditions relating to the environment, labor rights, and drug enforcement.

The "Necessary" History Of Property And Liberty, Richard A. Epstein Jan 2003

The "Necessary" History Of Property And Liberty, Richard A. Epstein

Faculty Articles

In this Foreword I wish to look at the question of takings and economic liberties from what I like to call, only half-facetiously, "necessary history." The purpose of this exercise is to show that there are certain powerful principles to which any conscientious application of constitutional discourse or doctrine must turn if it is to meet the minimum standards of intellectual coherence and practical common sense. In my view, this form of history is not clause-bound in any strict sense of the term, but rather rests on the broader considerations of the proper relationship between an individual and the state, …

Back To Court After Shrimp/Turtle? Almost But Not Quite Yet: India's Short Lived Challenge To Labor And Environmental Exceptions In The European Union's Generalized System Of Preferences, Robert L. Howse Jan 2003

Back To Court After Shrimp/Turtle? Almost But Not Quite Yet: India's Short Lived Challenge To Labor And Environmental Exceptions In The European Union's Generalized System Of Preferences, Robert L. Howse

Faculty Articles

The World Trade Organization's Appellate Body rulings in United States-Import Prohibition of Certain Shrimp and Shrimp Products ("Shrimp/Turtle")' created a new baseline for the labor and environment debate at the World Trade Organization ("WTO"). These landmark decisions effectively rejected (without citing!) the previous General Agreement on Tariffs and Trade ("GATT") holding in United States-Restrictions on Imports of Tuna Case ("Tuna/Dolphin"), where the panel ruled that Article XX limits exporting countries from using market access measures on policy grounds. The basic logic of the Appellate Body's ruling applies to, inter alia, Article XX(a). Before Shrimp/Turtle, conventional wisdom had it that the …

Surviving Against The Odds: Families’ Journeys Off Welfare And Out Of Homelessness, Donna H. Friedman, Tatjana Meschede, Michelle Hayes Jan 2003

Surviving Against The Odds: Families’ Journeys Off Welfare And Out Of Homelessness, Donna H. Friedman, Tatjana Meschede, Michelle Hayes

Center for Social Policy Publications

Homeless families face complex challenges when making the transition from welfare to the workforce. By focusing on the experiences of homeless families participating in a Boston-based welfare-to-work program, the multimethod, longitudinal study described in this article explored factors contributing to more successful transitions as well as barriers faced by families having a harder time making the transition.

Nearly 90 percent of the families that were studied left a shelter with a housing subsidy and retained it 6 to 12 months later. Successful employment outcomes after exiting a shelter were more evident for families whose head of household was older, two-parent …

Retirement And High Level Human Capital, Irving Gershenberg Jan 2003

Retirement And High Level Human Capital, Irving Gershenberg

Gerontology Institute Publications

Given that demographic trends in economically advanced industrial countries such as our own continue to shift toward increasingly older, formally retired populations, we need to find ways to keep more of this older retired population productive. Economists and others differ in their estimation regarding the ability and/or willingness on part of the retired to retain, let alone utilize the know-how, the human capital accumulated prior to retirement. This is as true for those who have spent their work life engaged in producing and communicating new ideas and synthesizing and diffusing what is known, those who have accumulated what I term …

Characteristics Of Homeless Individuals Accessing Massachusetts Emergency Shelters, 1999-2001, Tatjana Meschede, Michelle Kahan, Michelle Hayes, Donna Friedman

Center for Social Policy Publications

The Center for Social Policy (CSP) at the McCormack Institute, University of Massachusetts Boston oversees the Connection, Service, and Partnership through Technology (CSPTech) project. CSPTech operates a homeless management information system being implemented throughout the Commonwealth. Founded in 1995, this project is a networked computerized record-keeping system that allows homeless service providers across Massachusetts to collect uniform client information over time. This information is aggregated in a database used by service providers, advocates, government officials, researchers, and people experiencing homelessness. Analysis of this information is critical to efforts to understand the extent of this problem in Massachusetts in an attempt …

The United Nations And The Magna Carta For Children, Winston E. Langley Jan 2003

The United Nations And The Magna Carta For Children, Winston E. Langley

McCormack Graduate School General Publications (active until 2013)

The impulse that invited the preparation of this book is one which is linked to the convergence of a number of factors bearing on my interest in human rights. First, the brutality visited on children during World War II has had an abiding negative effect on my sense of what is possible in human conduct. Second, I am persuaded that children are not simply the means by which human societies are continued, but, as well, the potential source of moral revitalization and transformation for those societies. Third, I recognize that the human rights movement, which followed World War II, holds …

Economic Currents: The State Of The State Economy, Alan Clayton-Matthews Jan 2003

Economic Currents: The State Of The State Economy, Alan Clayton-Matthews

Public Policy and Public Affairs Faculty Publication Series

Statewide numbers paint a picture of declining employment and output, continuing widespread layoffs, slow wage and income growth, rapidly declining consumer confidence, weak consumer spending, stagnant tax revenues, high vacancy rates in the commercial real estate market, and no clear sign of growth in demand for the state’s technology products.

The Trajectory Of "Normal" After 9/11: Trauma, Recovery And Post-Traumatic Societal Adaptation, Joel B. Eisen Jan 2003

The Trajectory Of "Normal" After 9/11: Trauma, Recovery And Post-Traumatic Societal Adaptation, Joel B. Eisen

Law Faculty Publications

I shall evaluate some of the wide-ranging psychological effects of 9/11 to further flesh out the concept that 9/11 is a "national trauma," in pursuit of a more sophisticated understanding intended to supplant the traditional concept of "trauma" so often associated with events of this caliber. Before 9/11, most people thought posttraumatic stress was something Vietnam veterans (or perhaps rape victims) suffered. As I describe in Part I, this is squarely at odds with recent research that shows such trauma is common. I will discuss current literature reflecting on post-traumatic stress and the associated disorder (post-traumatic stress disorder, or "PTSD"), …

Authoritarianism As An Agent Of Status Quo Maintenance: Women’S Careers And Family Lives, Lauren Duncan, Bill E. Peterson, Erin E. Ax Jan 2003

Authoritarianism As An Agent Of Status Quo Maintenance: Women’S Careers And Family Lives, Lauren Duncan, Bill E. Peterson, Erin E. Ax

Psychology: Faculty Publications

We examined how right-wing authoritarianism (RWA) influenced career and family plans and life outcomes in 2 samples of educated women. In the college-aged sample, participants who planned to earn professional degrees scored higher on RWA than those who planned to earn graduate degrees in the humanities or social sciences. RWA was also positively related to the expression of preferences for male partners who possess masculine characteristics. In the midlife sample, RWA scores were higher for participants with traditional career and family outcomes at midlife. For midlife participants following a nontraditional career path, RWA was positively related to compartmentalizing career and …

Client Perceptions To Chronic Obstructive Pulmonary Disease: Symptoms And Responses Over Time, Mary Findeisen Jan 2003

Client Perceptions To Chronic Obstructive Pulmonary Disease: Symptoms And Responses Over Time, Mary Findeisen

Open Access Dissertations

Chronic obstructive pulmonary disease (COPD) is a major public health problem that affects millions of Americans. Adherence to treatment regimens is of critical importance to reduce disease progression and disability. This is particularly true in the early stages of COPD when symptoms are insidious not only in the late stages when symptoms are severe. Health care providers generally assume that once a treatment regimen is prescribed it will be followed. Yet it is not uncommon, particularly in chronic illnesses, for individuals to ignore or abandon treatment regimens. The purpose of this study was to: (1) describe and explore the process …
