Post-Earnings Announcement Drift And Market Participants' Information Processing Biases, Lihong Liang
Post-Earnings Announcement Drift And Market Participants' Information Processing Biases, Lihong Liang
Accounting - All Scholarship
Prior research has been unable to explain the phenomenon known as post-earnings announcement drift, raising questions concerning the semi-strong form efficiency of the market typically assumed in capital market research. This study contributes to our understanding of this anomaly by examining drift in the context of theories that consider investors' non-Bayesian behaviors. The empirical evidence reveals that investors' overconfidence about their private information and the reliability of the earnings information are two important factors that explain drift. Finally, this study also provides insight into the puzzling relationship between dispersion and drift discussed in prior research.
Reliability And The Admissibility Of Experts, Dale A. Nance
Reliability And The Admissibility Of Experts, Dale A. Nance
Faculty Publications
Modern law on expert testimony insists, as a condition of admissibility, that the asserted expertise be determined by the trial judge to be reliable. Reliability is usually characterized as a dichotomous attribute of evidence, as if expertise were either reliable or unreliable. This article argues that making progress in the development of meaningful and appropriate restrictions on the admissibility of expert testimony requires that we abandon this conceptualization and understand the implications of endorsing a gradational notion of reliability in which evidence can be more or less reliable and in which a comparative assessment of reliability is prominent. Consistent with …
Corrective Justice And Title I Of The Ada, Sharona Hoffman
Corrective Justice And Title I Of The Ada, Sharona Hoffman
Faculty Publications
Several recent studies have shown that employment discrimination plaintiffs filing lawsuits in federal court under Title I of the Americans with Disabilities Act (ADA) win only approximately five percent of their cases. This Article argues that this phenomenon is attributable at least in part to the ADA's very flawed definition of the term "disability." It suggests that the current definition be abandoned and that a new approach be adopted, one that would reshape the ADA's protected class so that it more closely resembles a discrete and insular minority, such as those traditionally protected by the civil rights laws. While Title …

Midwifery: Strategies On The Road To Universal Legalization, Laura Hermer
Midwifery: Strategies On The Road To Universal Legalization, Laura Hermer
Faculty Scholarship
Multiple studies have shown that direct-entry midwifery is just as safe, if not safer than, medical care in low-risk childbirth. Most births using direct-entry midwives require fewer interventions than those attended by physicians, yet yield excellent results. The results of these studies indicate that we should return to midwifery for normal births, rather than continuing to rely primarily on medicine. This option, however, has been significantly curtailed by many state legislatures and courts, despite decades of attempts to make incursions on the traditional paradigm of hospital births attended by obstetricians. As a result, where midwifery is more readily available, it …

Negligent Infliction Of Emotional Distress: Has The Legislative Response To Diane Whipple's Death Rendered The Hard-Line Stance Of Elden And Thing Obsolete, Michael Jay Gorback
UC Law Journal
On January 26, 2001, Diane Alexis Whipple was savagely attacked and mauled to death by two Presa Canario dogs as she was opening the front door to her San Francisco apartment. The following March, Whipple's partner, Sharon Smith, commenced a wrongful death lawsuit against the dogs' owners, Marjorie Knoller and Robert Noel. Recognizing that under the current legal regime, Smith's suit would almost certainly be dismissed on demurrer because the two women were related by neither blood nor marriage, the California Legislature enacted section 1714.01 of the Civil Code, which would enable domestic partners, such as Smith, to sue for …

Profiting From Poverty: The Competition Between For-Profit And Nonprofit Developers For Low-Income Housing Tax Credits, Megan J. Ballard
UC Law Journal
As governmental actors continue to withdraw from providing social services, private nonprofit and for-profit entities have stepped in to fill the gap and perform social service functions previously under the purview of governmental agencies. In doing so, nonprofit and for-profit actors vie for limited governmental incentives offered to encourage the privatization of social services. The competition between nonprofit and for-profit entities over privatization resources may adversely affect the beneficiaries of these social services. This Article highlights this competitive dynamic and the potentially negative consequences for social policy beneficiaries through an analysis of the federal Low- Income Housing Tax Credit (LIHTC) …
Daubert & Danger: The "Fit" Of Expert Predictions In Civil Commitments, Alexander Scherr
Daubert & Danger: The "Fit" Of Expert Predictions In Civil Commitments, Alexander Scherr
UC Law Journal
In civil commitments, courts face the task of predicting the dangerousness of a mentally ill person and often turn to experts for help. Recently, the reliability of expert predictive testimony has improved; yet the best predictions still fall far short of reasonable certainty. Predictive science itself remains under scrutiny and is the subject of extended research and debate.
The modern handling of expert testimony, initiated in Daubert v. Merrell Dow Pharmaceuticals, Inc., might suggest that courts should exclude such unreliable expertise. The Daubert rules seem to imply a reliability standard under which trial courts should exclude expertise that lacks scientific …

Variability of 45 isolates of Rhizoctonia solani (teleomorph Thanatephorus cucumeris) causing web blight (WB) of common bean, Phaseolus vulgaris, was examined by polymerase chain reaction-restriction fragment length polymorphism (PCR-RFLP) analysis of the internal transcribed spacer regions (ITS1 and ITS2) and the 5.8S subunit (5.8S) of the nuclear ribosomal DNA repeat (ITS-5.8S-rDNA). Isolates were collected from diseased bean leaves from Argentina, Costa Rica, Cuba, Dominican Republic, Honduras, Panama, and Puerto Rico. These WB isolates belong to AG-1 and AG-2 based on anastomosis reaction. Isolates of AG-1 that cause WB were separated into three distinct groups of RFLP patterns from …

Migrants from Java arrive in hyperendemic Papua, Indonesia lacking exposure to endemic malaria. We evaluated records of evacuation to hospital with a diagnosis of severe malaria from a transmigration village in northeastern Papua. During the first 30 months, 198 residents with severe disease were evacuated (7.5 evacuations/100 person-years). During this period the risk of evacuation for adults (>15 years of age) was 2.8. (95% CI=2.1–3.8; P<0.0001) relative to children, despite apparently equal exposure to risk of infection. Relative risk (RR) for adults was greatest during the first 6 months (RR>16; 95% CI>2.0–129; P=0.0009), and diminished during the second 6 months (RR=9.4; 95% CI=2.7–32.8; P<0.0001) and the third 6 months (RR=3.7; 95% CI=1.7–7.9; P=0.0004). During the next two 6-month intervals, the RR for adults was 1.6 and 1.5 (95% CI range 0.8–2.6; P<0.18). Adults lacking chronic exposure were far more likely to progress to severe disease compared to children during initial exposure, but not after chronic exposure to infection.

Johnny Carson School of Theatre and Film: Faculty Publications and Creative Activity
On the occasion of Marianne Hoppe=s death in Siegsdorf, Bavaria on October 23, 2002, obituaries in several German newspapers recalled her as one of the great stars of the Third Reich. Most recalled her rise under the Nazis, and some inferred that she attained stardom largely for the wrong reasons. Her marriage to Hermann Goering's favorite actor and director, Gustaf Gründgens (1899-1963), was a political cloud that hovered over her until her death. Her frank admission that she was aware of the regime=s persecution, terror, and concentration camps did little to dispel persistent misgivings about her, even as she continued …
