Abraham Lincoln's First Amendment, Geoffrey R. Stone Jan 2003

Abraham Lincoln's First Amendment, Geoffrey R. Stone

Articles

As we confront the challenges of the "War on Terrorism," it is useful to look back at our own history to understand how in past crises we have struck the balance between liberty and security. In this Essay, Professor Geoffrey Stone considers how Abraham Lincoln dealt with the conflict between free expression and military necessity during the course of the Civil War. Although we tend to think of Lincoln's suspension of habeas corpus as the paramount civil liberties issue in this era (apart from slavery), Professor Stone explores how Lincoln, facing often severe criticism of his administration, struggled to balance …

Action Education In Land Use Decisions: Student Views On Urbanization And Farmland Loss, Mindi Schneider, Charles A. Francis, Dick Esseks Jan 2003

Action Education In Land Use Decisions: Student Views On Urbanization And Farmland Loss, Mindi Schneider, Charles A. Francis, Dick Esseks

CARI Extension and Education Materials for Sustainable Agriculture

Loss of prime farmland is a serious concern in the United States and around the globe. With rapid urban population increases, the activities and perceived needs of concentrated groups of people result in the swallowing of some of the most fertile lands in this country. Today we have just under 2 acres of productive farmland per person in the United States. Given the current population growth rate due to births and immigration, plus the present rate of farmland loss, World Watch Institute estimates that we will have about 0.6 acres or one-third as much farmland available per person by 2055--a …

Monte Carlo Assessments Of Goodness-Of-Fit For Ecological Simulation Models, Lance A. Waller, David Smith, James E. Childs, Leslie A. Real Jan 2003

Monte Carlo Assessments Of Goodness-Of-Fit For Ecological Simulation Models, Lance A. Waller, David Smith, James E. Childs, Leslie A. Real

Zoonotics and Wildlife Disease: Publications

One often develops stochastic ecologic simulation models based on local interactions between individuals or groups and bases systemic conclusions on trends summarized over multiple data sets generated from the model. In many cases, such models generate data sets (“realizations”) each violating the usual assumptions associated with traditional statistical tests of goodness-of-fit, most notably that of independent observations. Monte Carlo hypothesis tests applied to multiple realizations from such models provide appropriate goodness-of-fit tests regardless of within-model peculiarities. The Monte Carlo tests address the question “Do the observed data appear consistent with the model?” in contrast to the usual question “Does the …

Abundant PrpCwd In Tonsil From Mule Deer With Preclinical Chronic Wasting Disease, Katherine I. O'Rourke, Dongyue Zhuang, Amy Lyda, Gabriel Gomez, Elizabeth S. Williams, Wenbin Tuo, Michael W. Miller

Zoonotics and Wildlife Disease: Publications

A monoclonal antibody dot-blot assay was used to evaluate detergent lysates of tonsil tissue from mule deer to detect PrPCWD, the marker for the cervid transmissible spongiform encephalopathy chronic wasting disease (CWD). Samples of formalin-fixed brain and tonsil tissues from mule deer were examined for PrPCWD using immunohistochemistry (IHC) with Mab F99/97.6.1, the gold standard for diagnosis of preclinical CWD. The contralateral tonsil from each of the 143 deer was prepared for confirmatory IHC and as a 10% (wt/vol) detergent lysate without purification or enrichment steps for monoclonal antibody dot-blot assay. PrPCWD was detected by dot-blot …

Global Optical Lightning Flash Rates Determined With The Forte Satellite, Tracy E. Light, Sean M. Davis, William Boeck, Abram Jacobson, David Suszcynsky Jan 2003

Global Optical Lightning Flash Rates Determined With The Forte Satellite, Tracy E. Light, Sean M. Davis, William Boeck, Abram Jacobson, David Suszcynsky

United States Department of Energy: Publications

Using FORTE photodiode detector (PDD) observations of lightning, we have determined the geographic distribution of nighttime flash rate density. We estimate the PDD flash detection efficiency to be 62% for total lightning through comparison to lightning observations by the TRMM satellite's Lightning Imaging Sensor (LIS), using cases in which FORTE and TRMM viewed the same storm. We present here both seasonal and total flash rate maps. We examine some characteristics of the optical emissions of lightning in both high and low flash rate environments, and find that while lightning occurs less frequently over ocean, oceanic lightning flashes are somewhat more …

Quantitation Of Aberrant Interlocus T-Cell Receptor Rearrangements In Mouse Thymocytes And The Effect Of The Herbicide 2,4-Dichlorophenoxyacetic Acid, Geremy Knapp, R. Woodrow Setzer, James Fuscoe

United States Environmental Protection Agency: Publications

Small studies in human populations have suggested a correlation between the frequency of errors in antigen receptor gene assembly and lymphoid malignancy risk. In particular, agricultural workers exposed to pesticides have both an increased risk for lymphoma and an increased frequency of errors in antigen receptor gene assembly. In order to further investigate the potential of such errors to serve as a mechanistically based biomarker of lymphoid cancer risk, we have developed a sensitive PCR assay for quantifying errors of V(D)J recombination in the thymocytes of mice. This assay measures interlocus rearrangements between two T-cell receptor loci, V-gamma and Jbeta, …

Quantitative Soil Descriptions For Ecoregions Of The United States, Mostafa A. Shirazi, Colleen Burch Johnson, James M. Omernik, Denis White, Patricia K. Haggerty, Glenn E. Griffith

United States Environmental Protection Agency: Publications

Researchers have defined and mapped ecological regions of the United States based on similar patterns of ecosystems such as deserts, forests, and croplands. These studies are useful in regional research, monitoring, and environmental management because data can be more readily extrapolated within the same ecoregion and to regions with similar characteristics. The description of ecoregions is largely holistic and qualitative. Conversely, quantitative information for soil are abundant and soil is an important ecosystem component related to many ecoregion properties. We used the nationwide State Soil Geographic database(STATSGO) to describe the soils of 84 Level III ecoregions in the United States. …

In Situ Abiotic Detoxification And Immobilization Of Hexavalent Chromium, Faruque A. Khan, Robert W. Puls Jan 2003

In Situ Abiotic Detoxification And Immobilization Of Hexavalent Chromium, Faruque A. Khan, Robert W. Puls

United States Environmental Protection Agency: Publications

Detailed site characterization data from the former electroplating shop at the U.S. Coast Guard Air Support Center, Elizabeth City, North Carolina, suggested that the elevated Cr(VI) in the capillary fringe area had contaminated the ground water at the site. Most of the mobile Cr(VI) is present in the capillary fringe zone of the aquifer under an oxidizing environment. Current literature suggests that the reduction of Cr(VI) to Cr(Ill) through in situ redox manipulation in the presence of a reductant is an innovative technique for remediating chromate-contaminated sediments and ground water. The objective of this study was to evaluate the effectiveness …

United States Environmental Protection Agency: Publications

U.S.EPA Methods 1622 and 1623 are used to detect and quantify Cryptosporidium oocysts in water. The protocol consists of filtration, immunomagnetic separation (IMS), staining with a fluorescent antibody, and microscopic analysis. Microscopic analysis includes detection by fluorescent antibody and confirmation by the demonstration of 1–4 sporozoites or nuclei after staining with 4V,6-diamidino-2-phenyl indole dihydrochloride (DAPI). The purpose of this study was to evaluate a new IMS dissociation, a 10-min incubation at 80 °C. Heat dissociation improved the average oocyst recovery from 41% to 71% in seeded reagent water, and from 10% to 51% in seeded river samples. The average DAPI …

Monitoring Trends In Bat Populations Of The United States And Territories: Problems And Prospects, T.J. O'Shea, M. A. Bogan Jan 2003

Monitoring Trends In Bat Populations Of The United States And Territories: Problems And Prospects, T.J. O'Shea, M. A. Bogan

United States Geological Survey: Publications

Bats are ecologically and economically important mammals. The life histories of bats (particularly their low reproductive rates and the need for some species to gather in large aggregations at limited numbers of roosting sites) make their populations vulnerable to declines. Many of the species of bats in the United States (U.S.) and territories are categorized as endangered or threatened, have been candidates for such categories, or are considered species of concern. The importance and vulnerability of bat populations makes monitoring trends in their populations a goal for their future management. However, scientifically rigorous monitoring of bat populations requires well-planned, statistically …

Geologic Studies Of Mercury By The U.S. Geological Survey

United States Geological Survey: Publications

A liquid at room temperature, mercury is a unique metal with unusual properties. Elemental mercury has long been used in thermometers because it responds to changes in temperature. In fact, mercury’s many diverse properties have made it useful for many products. Mercury is a good metallic conductor with a low electrical resistivity; it has been used in electrical products including electrical wiring and switches, fluorescent lamps, mercury batteries, and thermostats (Eisler, 1987). Mercury also is used in navigational instruments to measure changes in temperature and pressure. In the medical field, mercury is used as a component in dental fillings and …

Evidence For Disease-Related Amphibian Decline In Colorado, Erin Muths, Paul Stephen Corn, Allan P. Pessier, D. Earl Green Jan 2003

Evidence For Disease-Related Amphibian Decline In Colorado, Erin Muths, Paul Stephen Corn, Allan P. Pessier, D. Earl Green

United States Geological Survey: Staff Publications

The recent discovery of a pathogenic fungus (Batrachochytrium dendrobatidis) associated with declines of frogs in the American and Australian tropics, suggests that at least the proximate cause, may be known for many previously unexplained amphibian declines. We have monitored boreal toads in Colorado since 1991 at four sites using capture–recapture of adults and counts of egg masses to examine the dynamics of this metapopulation. Numbers of male toads declined in 1996 and 1999 with annual survival rate averaging 78% from 1991 to 1994, 45% in 1995 and 3% between 1998 and 1999. Numbers of egg masses also declined. …

A Longitudinal Assessment Of The Aquatic Macroinvertebrate Community In The Channelized Lower Missouri River, Barry C. Poulton, Mark L. Wildhaber, Collette S. Charbonneau, James F. Fairchild, Brad G. Mueller, Christopher J. Schmitt

United States Geological Survey: Staff Publications

We conducted an aquatic macroinvertebrate assessment in the channelized reach of the lower Missouri River, and used statistical analysis of individual metrics and multimetric scores to identify community response patterns and evaluate relative biological condition. We examined longitudinal site differences that are potentially associated with water quality related factors originating from the Kansas City metropolitan area, using data from coarse rock substrate in flowing water habitats (outside river bends), and depositional mud substrate in slack water habitats (dike fields). Three sites above river mile (RM) 369 in Kansas City (Nebraska City, RM = 560; St. Joseph, RM = 530; Parkville, …

Just The (Unweildy, Hard To Gether, But Nonetheless Essential) Facts, Ma'am: What We Know And Don't Know About Problem-Solving Courts, Greg Berman, Anne Gulick

Fordham Urban Law Journal

This article asses what is known and what remains to be understood about problem-solving courts. Specifically, the article asserts that drug courts serve a needy population, court mandated treatment programs have higher retention rates, those who participate longer have better outcomes, those in drug courts had lower rates of recidivism, drug use, and that graduated sanctions have statistically significant impact on offenders behavior, sanctions are crucial to the model's effectiveness, post-program studies are sparse, drug courts are less costly than traditional adjudication, but cost savings for jail and prison beds are less clear. The article also addresses questions that remain …

La Bodega De La Familia: Supporting Parolees' Reintegration Within A Family Context, Jeanne Flavin, David Rosenthal Jan 2003

La Bodega De La Familia: Supporting Parolees' Reintegration Within A Family Context, Jeanne Flavin, David Rosenthal

Fordham Urban Law Journal

This essay discusses how Family Justice and La Bodega de la Familia respond to the diverse challenges of reintegration post incarceration. It also discusses the benefits of a model of judicial supervision that recognizes individuals' social locations within their families and communities. With the goal of producing more effective and humane prisoner reintegration, especially in the context of drug offenses, the Authors recommend family case management. They additionally encourage parole and criminal justice practice to shift its focus from the individual parolee to families and their strengths.

Is The Experimental Use Exemption For Patent Infringement Still Needed?, 3 J. Marshall Rev. Intell. Prop. L. 103 (2003), Melanie K. Kitzan Haindfield Jan 2003

Is The Experimental Use Exemption For Patent Infringement Still Needed?, 3 J. Marshall Rev. Intell. Prop. L. 103 (2003), Melanie K. Kitzan Haindfield

UIC Review of Intellectual Property Law

The judicially created experimental use exemption has traditionally been a limitation on a patent holder’s rights because it allows patent infringing activities involving research for mere curiosity or amusement. This exemption was later modified to further protect any research performed by institutions not having a profit motive for the patent infringement, resulting in many institutions freely infringing patented inventions, knowing that broad protection was available under the experimental use exemption. However, in 2002 the Federal Circuit effectively ended the experimental use exemption as a defense for academic institutions, by recognizing that academic institutions can be held liable for infringement for …
