Defending The Indefensible To Further A Later Case: Sanctioning Respondents In Illinois Domestic Violence Cases, David H. Taylor Jan 2003

Defending The Indefensible To Further A Later Case: Sanctioning Respondents In Illinois Domestic Violence Cases, David H. Taylor

Faculty Articles, Papers, and Other Scholarship

When an act of domestic violence occurs in Illinois, as in most other jurisdictions, both criminal charges and a civil Domestic Violence Order of Protection may follow. The order of protection may be commenced in conjunction with a criminal charge or may be commenced as an independent action. Because of the exigencies of the domestic violence situation, the legislature has enacted a statutory scheme that expedites the civil proceeding, so that the civil order of protection proceeding takes place in a period of twenty-one days from initial filing to final hearing. In other contexts, an act of intentional injury could …

Media Ownership And Objectivity, Xinkun Wang Jan 2003

Media Ownership And Objectivity, Xinkun Wang

LSU Master's Theses

The purpose of this study is to examine whether the different type of ownership will affect the degree of objectivity of newspaper coverage of 2000 presidential election. It is predicted by Shoemaker’s news content theory that publicly-owned newspaper is more objective than privately-owned newspaper. The findings of this study support this theory. A content analysis of 238 news stories and eight editorials from publicly-owned the Boston Globe and privately-owned the Boston Herald showed that not only does the ownership affect the objectivity of the coverage of these two newspapers on 2000 presidential election, the endorsements also affect the degree of …

Heavy Smokers Choose Large, Immediate Rewards With Large Penalties On A Simulated Task Of Gambling, Michael Shawn Businelle Jan 2003

Heavy Smokers Choose Large, Immediate Rewards With Large Penalties On A Simulated Task Of Gambling, Michael Shawn Businelle

LSU Master's Theses

The Gambling Task is a complex neuropsychological test (in the form of a card game) that examines the ability of individuals to assess potential immediate gains over long-term losses. Gambling Task performance has been examined in previous studies with individuals who are dependent on alcohol, cocaine, heroin, and amphetamine. These studies have shown that those who are dependent on the aforementioned substances perform more poorly on the Gambling Task than controls. Specifically, in relation to controls, drug/alcohol dependent individuals show impairment by tending to pick more cards that have large immediate gains and very large delayed punishers. The delayed punisher …

Louisiana Sugar: A Geohistorical Perspective, Elizabeth Vaughan Jan 2003

Louisiana Sugar: A Geohistorical Perspective, Elizabeth Vaughan

LSU Doctoral Dissertations

The planting of sugarcane in Louisiana’s southern parishes has persisted with stunning continuity since its introduction in the late eighteenth century. This industry, however, is an economic and agricultural anomaly. It is a relic of the sixteenth-century expansion of European capitalism in which granulated sugar, then a novel product, stimulated the Atlantic slave trade and contributed to the incorporation of the sugar-producing colonies of the Americas into an emerging European-world economy. The Louisiana sugar industry was launched in 1795 with a historic granulation from a new variety of sugarcane recently introduced into the Caribbean. From this early success, the industry …

Strange Fire, Sharon Nelson Jan 2003

Strange Fire, Sharon Nelson

LSU Master's Theses

In the aftermath of a worldwide war, the planet Xica is split into small pockets of humanoid civilization. One pocket is a divided abandoned military compound. Beyond the wall is the Outer Rim where people are free yet violence is rampant. Within the wall is the state of Sheol whose inhabitants are drugged and have few choices. Sheol’s ruler, Jared, conducts an experiment where children are raised without physical contact in the Complex at the center of the city. One boy, Zahid, escapes from the Complex and meets other children; Nick in Sheol and Alexandra in the Outer Rim. Together, …

The Social Context Of Norse Jarlshof, Marcie Anne Kimball Jan 2003

The Social Context Of Norse Jarlshof, Marcie Anne Kimball

LSU Master's Theses

A series of excavations from 1897 to 1951 showed the site of Jarlshof in Shetland to have been occupied by proto-Pictish, Pictish, and Viking peoples. These inquiries culminated in J.R.C. Hamilton’s 1956 monograph Excavations at Jarlshof, Shetland. In the years since the writing of the monograph, much new information has come to light that relates to the time periods found at Jarlshof. The concern of this thesis is how the new findings relate to Viking Age Jarlshof and how Viking Age Jarlshof relates to this new information. In order to set Viking Age Jarlshof into its overall historical context regarding …

An Evaluation Of Distributed Practice Using Constant Time Delay In The Acquisition Of Sight Words With Children, Kashunda Lynn Williams Jan 2003

An Evaluation Of Distributed Practice Using Constant Time Delay In The Acquisition Of Sight Words With Children, Kashunda Lynn Williams

LSU Master's Theses

Although, distributed practice has been demonstrated to be superior to massed practice for learning, studies examining the degree of distribution needed to obtain this effect remain lacking. This study extends prior research by (1) determining if there is a difference in distributed practice schedules, when the total time to practice remains constant, (2) determining which schedule produces the superior amount of learning, and (3) determining which schedule produces superior retention of learned materials across time. Study participants were general education elementary school students referred for reading assistance. The constant time delay procedure was used to teach the participants sight words. …

The Effect Of High Frequency Amplification On Subjective And Objective Benefit With Digital Hearing Instruments, Erica Lynn Fleck Jan 2003

The Effect Of High Frequency Amplification On Subjective And Objective Benefit With Digital Hearing Instruments, Erica Lynn Fleck

LSU Master's Theses

The purpose of the present study was to determine whether amplifying beyond 3 kHz was beneficial to the user, whether the benefit was dependent on degree of loss, and whether subjective data reflected the benefit. Seventeen hearing impaired subjects were binaurally fitted with digital hearing instruments. Qualified subjects were divided into two groups, A and B. Group A had a pure tone average (3,4, and 6 kHz), of 55 dBHL or better. Group B had a pure tone average (3,4, and 6 kHz) greater than 55 dBHL but not exceeding 75 dBHL. Each subject was fit with two conditions (upward …

Dialogic Dogs And Phatic Felines: Speaking To And Through Our Pets, Nicole M. Dufour Jan 2003

Dialogic Dogs And Phatic Felines: Speaking To And Through Our Pets, Nicole M. Dufour

LSU Master's Theses

While many pet owners acknowledge that they speak to their pet, Pet Communication has remained mostly overlooked by researchers. Through discourse analysis, this thesis is an attempt to analyze Pet Communication, which deals with human speech to a pet, about a pet, or through a pet. I analyze data which I transcribed in the waiting room of the Louisiana State University School of Veterinary Medicine Small Animal Clinic. Data were collected from conversations that took place between pet owners, between pet owners and the Clinic's staff, pet owners and their pets, and between staff and pets. These data were then …

The Relationship Of Feeding Problems With The Use Of Antiepileptic Medication Among Persons With Severe And Profound Mental Retardation, Rinita B. Laud Jan 2003

The Relationship Of Feeding Problems With The Use Of Antiepileptic Medication Among Persons With Severe And Profound Mental Retardation, Rinita B. Laud

LSU Master's Theses

Epilepsy and/or seizure activity are frequently occurring phenomena and a significant co-morbid condition for persons with severe to profound intellectual disability (Burke, McKee, Pathak, Donahue, Parasuraman & Baltenhorst, 1999). The majority of seizure activity leads to deficits across a number of social, physical, occupational, and personal variables, and if left untreated, may lead to death in these individuals. The treatment of this condition frequently utilizes anti-epileptic medication, but these medications are often associated with a variety of side effects such as dental complications and disturbed gait. Previous researchers have suggested that these side effects may be manifested in forms of maladaptive …

The Price Of Macroeconomic Imprecision: How Should The Law Measure Inflation?, Jim Chen Jan 2003

The Price Of Macroeconomic Imprecision: How Should The Law Measure Inflation?, Jim Chen

UC Law Journal

Because no economy is forever free from price change, a legal system that seeks to maintain its vitality across the full range of macroeconomic conditions must adopt a proper measure of inflation. In areas such as taxation, economic regulation, and private contracting, the law's response to inflation constitutes a policymaking opportunity in its own right. In campaign finance and judicial compensation, the legal treatment of inflation may have constitutional consequences.

In spite of inflation's profound ramifications for the law, federal law has taken a seemingly haphzard approach toward its measurement. Federal statutes specifying one price index strongly favor the Bureau …

Marital Immunity, Intimate Relationships, And Improper Inferences: A New Law On Sexual Offenses By Intimates, Michelle J. Anderson Jan 2003

Marital Immunity, Intimate Relationships, And Improper Inferences: A New Law On Sexual Offenses By Intimates, Michelle J. Anderson

UC Law Journal

Today, to one degree or another, marital immunity for sexual offenses persists in over half the states. Underlying the marital rape immunity has been the assumption that when a woman enters into a marriage, she gives her ongoing consent to sexual intercourse. This Article argues that states must abolish this immunity to make the law formally neutral on the marital status of the parties. However, as this Article argues, such formal neutrality is insufficient. The ideology of ongoing consent underlying the marital rape immunity has infected the way the legal system treats sexual offenses among intimates who are not married. …

The Dubious Concept Of Jurisdiction, Evan Tsen Lee Jan 2003

The Dubious Concept Of Jurisdiction, Evan Tsen Lee

UC Law Journal

The conventional wisdom about jurisdiction is that it equals power and is conceptually distinct from the merits. In this Article, Professor Lee challenges both those notions. Jurisdiction is more akin to legitimate authority than to power, and, as such, cannot be conceptually distinguished from the merits, which also ultimately pertain to legitimate authority. Professor Lee argues that courts should therefore abstain from the metaphysics of jurisdiction-they should always ask whether, all things considered, they should rule as a plaintiff asks, not whether they are capable of so ruling.

Golden Gateway And The Search Of A Fairer Application Of California's Constitutional Right To Free Expression, Eileen K. Chauvet Jan 2003

Golden Gateway And The Search Of A Fairer Application Of California's Constitutional Right To Free Expression, Eileen K. Chauvet

UC Law Journal

Over twenty years after its landmark decision in Robins v. Pruneyard Shopping Center, the California Supreme Court revisited the issue of constitutionally protected speech on private property. The resulting plurality opinion in Golden Gateway Center, Inc. v. Golden Gateway Tenants Ass'n clarified that free expression on private property may be protected by the state constitution only when that private property is freely open to the public. While the case showed a strong desire by members of the court to return to free speech jurisprudence more in line with the First Amendmentrequiring state action before a constitutional claim could be madethere …

Robert Lowell's Life-Writing And Memory, Gye-Yu Kang Jan 2003

Robert Lowell's Life-Writing And Memory, Gye-Yu Kang

LSU Master's Theses

This thesis examines Robert Lowell's use of memory in such autobiographical works as Life Studies and Day by Day. In those volumes, Lowell returns to recollect his private past; his act of remembering becomes the poetic process by which Lowell is able to create the retrospective truth of his life. The most important feature of memory in his life-writing is in its role as an imaginative reconstruction. In the first chapter, I review recent models that regard memory as a reconstructive process. Memory involves more than fact, according to these investigations; it also represents a fictionalizing process of self. In …

The Public Domain: The Evolution Of Legal Restraints On The Government's Power To Control Public Access Through Secrecy Or Intellectual Property, Edward Lee Jan 2003

The Public Domain: The Evolution Of Legal Restraints On The Government's Power To Control Public Access Through Secrecy Or Intellectual Property, Edward Lee

UC Law Journal

The concept of the public domain is the focus of a firestorm of debate, precipitated by some of the most important controversies of our digital age. This debate, however, is deeply flawed in two critical respects. First, the debate has invoked the public domain without a clear understanding of the origin of the term and the first principles that courts enunciated in recognizing the concept. Second, the debate has focused almost exclusively on intellectual property law in analyzing the public domain, ignoring the many uses of the term in other areas of law, such as First Amendment rights of access, …

Behind The Scenes: Uncovering The Structures And Manipulations Of Tabloid Talk Show Workers, Guests And Audiences, Kelly Thompson Losch Deshotel Jan 2003

Behind The Scenes: Uncovering The Structures And Manipulations Of Tabloid Talk Show Workers, Guests And Audiences, Kelly Thompson Losch Deshotel

LSU Master's Theses

How talk show workers, guests and audiences behave behind-the-scenes is largely a mystery to the public. This research focuses on the behind-the-scenes workings of a daytime syndicated talk show to better understand the motivations of talk show guests and how talk show workers manipulate guests and audiences. While researchers have conducted studies of talk show guests using formal interviews and questionnaires, no researchers have posed as covert observers to study talk shows. The researcher conducted participant observation to study the behaviors of those involved with the on and offstage talk show structure. The researcher interned for the show without revealing …

Hearing Voices: Speaker Identification In Court, Lawrence M. Solan, Peter M. Tiersma Jan 2003

Hearing Voices: Speaker Identification In Court, Lawrence M. Solan, Peter M. Tiersma

UC Law Journal

Many of the problems that people have identifying speakers solely by their voices are similar to those that people have as eyewitnesses. The amount of exposure, the nature of the identification process, and the number of exposures all matter in determining how likely a witness is to make a correct identification. Yet while the reliability of eyewitness identification has been a focal point in the news, scholarly literature, and the courts, the reliability of earwitness identification has gone virtually unnoticed in the case law and legal literature. The reluctance of the legal system to deal with this problem stems from …

Seeking Justice, Preserving Liberty, Geoffrey C. Hazard Jr. Jan 2003

Seeking Justice, Preserving Liberty, Geoffrey C. Hazard Jr.

UC Law Journal

At the annual Jerome Hall Lecture, presented at the Hastings College of Law on September 19, 2002, Professor Hazard explored the concepts behind the American Bar Association's watchword "ABA Defending Liberty, Pursuing Justice" as it relates to the professional activities in which a large percentage of lawyers are regularly and actively engaged. Professor Hazard contends that although the watchword denotes lofty goals, the concepts of seeking justice and preserving liberty are not inconsistent with fee-forservice representation of ordinary individuals in their business matters. Approximately half of the practicing bar is engaged in the representation of business interests, including for-profit business, …

Advancing The Language Of Human Rights In A Global Economic Order: An Analysis Of A Discourse, Christiana Ochoa Jan 2003

Advancing The Language Of Human Rights In A Global Economic Order: An Analysis Of A Discourse, Christiana Ochoa

Articles by Maurer Faculty

Human rights language is particularly attuned to setting out the goals of protecting the worlds least protected people. As human rights advocates have entered negotiations with international economic institutions and transnational corporations (TNCs), such negotiations have often resulted in an alternative language to describe the necessity of protecting and promoting human rights. After describing the progressive inclusion of human rights ideas by TNCs, the World Bank, the IMF, and the WTO, this Article argues that, while such inclusion is a benefit to the human rights movement, the creation of an alternative language to describe human rights goals is potentially detrimental. …

Helen M. Turner, American Impressionist, Maia Jalenak Jan 2003

Helen M. Turner, American Impressionist, Maia Jalenak

LSU Master's Theses

A renewal of interest in the French impressionists began in 1974 with the 100th anniversary of the first exhibition of the artists who broke with the official Salon in Paris and held their own exhibitions from 1874 through 1886. Since 1974, there has been a swell of interest in reinvestigating lesser-known European and American impressionist artists, especially women artists whose work often was relegated to second-class professional status. Among them was Helen Maria Turner (1858-1958), an artist whose work merits further examination. In the first two decades of the twentieth century, Turner's art was held in great esteem by critics, …

Evaluation Of Computerized Reading Intervention, Jennifer Lynne Koenig Jan 2003

Evaluation Of Computerized Reading Intervention, Jennifer Lynne Koenig

LSU Master's Theses

The purpose of this study was to evaluate the effectiveness of a computer-based reading intervention with eight elementary school children. This program, called the Reading Center, utilizes repeated reading, listening passage preview, word drills, and comprehension questions. A multiple baseline design was used to evaluate the intervention effects on oral reading fluency. Results indicated growth in all eight children, with increases between 8.7 and 20 words per week for intervention passages. The implications of the results for the use of computer-delivered interventions are discussed.

The Integration Of A Formal Garden Curriculum Into Louisiana Public Elementary Schools, Leanna Lynn Smith Jan 2003

The Integration Of A Formal Garden Curriculum Into Louisiana Public Elementary Schools, Leanna Lynn Smith

LSU Master's Theses

School gardens have been and are in use today at schools around the United States to supplement their curriculum. Very little research, however, has been conducted to quantify the benefits that gardening provides to students. The first four chapters of a hands-on gardening curriculum (Junior Master Gardener Handbook Level One) were introduced into three East Baton Rouge Parish elementary schools the fall semester of 2002. Science achievement tests developed at Texas A&M University specifically for the Junior Master Gardener program, were given both before and after the students participated in the gardening activities to determine whether or not the activities …

How to Make a Girl: Female Sexuality in Young Adult Literature analyzes representations of female sexuality in more than fifty texts. By examining these texts in relation to each other and in terms of historical development, this project creates a literary history of female sexuality in Young Adult fictions. By depicting young women in varying stages of adolescence and young adulthood, these fictional texts offer unique representations …

Alternative Language Sample Analyses For The Assessment Of Low-Income African American Children, Christy Gayle Wynn Jan 2003

Alternative Language Sample Analyses For The Assessment Of Low-Income African American Children, Christy Gayle Wynn

LSU Master's Theses

The purpose of this study was to examine the clinical utility of three language sample analyses when working with low-income, African American (AA) children. Eighteen normally developing and three at-risk AA three-year-old preschoolers participated in the study. Language samples were elicited from each child during a 15-20 minute play interaction. Three language sample analyses, contrastive analysis, average sentence length, and complex syntax use, were completed on each language sample. Also coded was each child’s use of nonmainstream African American English (AAE) patterns. Only the contrastive analysis generated reliable differences between the at-risk children and the normally developing children. Other group …
