Retaining Judicial Authority: A Preliminary Inquiry On The Dominion Of Judges, Larry Catá Backer Dec 2003

Retaining Judicial Authority: A Preliminary Inquiry On The Dominion Of Judges, Larry Catá Backer

William & Mary Bill of Rights Journal

Why do the people and institutions of democratic states, and in particular those of the United States, obey judges ? This article examines the foundations of judicial authority in the United States. This authority is grounded on principles of dominance derived from the organization of institutional religion. The judge in Western states asserts authority on the same basis as the priest - but not the priest as conventionally understood. Rather, the authority of the judge in modern Western democratic states is better understood when viewed through the analytical lens of priestly function developed in the philosophy of Friedrich Nietzsche. Focusing …

The Effect Of Non-Stoichiometry On The Structure Of La-Ni And La-Ni-Ga Alloys, Pertrice Auguste Wethey Dec 2003

The Effect Of Non-Stoichiometry On The Structure Of La-Ni And La-Ni-Ga Alloys, Pertrice Auguste Wethey

Masters Theses

Non-stoichiometric samples of the AB5 system defined by the formula La1-yNi5+2y and LaNi5+2xGa1-x were cast using an arc-melting furnace. The samples were then analyzed to determine their lattice parameters and phases present using XRD. They were then heat-treated to produce homogeneous compounds and quenched with the intention of retaining high temperature compositions. Following the heat-treatment, the alloys underwent XRD again as well as SEM/EDS. The XRD information was analyzed using Rietveld refinement and the elemental data derived from the EDS was used to ascertain the compositions were statistically akin to the weighed values. …

Hybrid Neural Networks Models For A Membrane Reactor, Mohammed Al-Yemni Dec 2003

Hybrid Neural Networks Models For A Membrane Reactor, Mohammed Al-Yemni

Graduate Theses, Dissertations, and Problem Reports (ETD)

Artificial neural networks (ANN) have become an established discipline and have gained extensive interest within chemical engineering. In recent years, research effort has focused on the use of "hybrid artificial neural networks" (HANN) models that combine both the deterministic and the ANN elements. Several methods have been proposed for combining ANN with first principle relations. In this thesis, a new hybrid scheme, which is similar to that developed by Kasprow for a space-independent and time-dependent fed-batch microbial reactor, was developed for a space-dependent steady-state enzymatic reactor. This scheme combines ANN with mass balances and assumed rate expressions. It was shown …

Years Of Teaching Experience And Descriptions Of Educational Situations, Dana J. Stapleford

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study examined the relationship between years of teaching experience and the type of descriptions given of educational situations. Participants were certified teachers with 1 to 27 years of teaching experience and preservice teachers with 0 years of teaching experience. A coding system was developed as an objective method for extracting participants' descriptions of actions and consequences pertaining to student and teacher behavior. Results did not support the original hypothesis that a relationship would be found between years of teaching experience and the descriptions made. However, several other relationships among certain characteristics of the descriptions were found.;The typical description made …

Administrative Law, Martin M. Wilson Dec 2003

Administrative Law, Martin M. Wilson

Mercer Law Review

Administrative law continues to be a front-burner item in the practice of law because each day more and more activities, businesses, and persons fall under a state or local agency's regulatory sphere of influence. While the number of appellate cases reviewed in this Article has dropped slightly from recent years, reports from several agency heads in state and local governments would lead one to believe that agency workloads only continue to increase. Given the current economy and resulting shortfalls of tax revenues, it will be interesting to observe what effects static or reduced levels of enforcement and regulatory officials will …

Criminal Law And Criminal Procedure, John O. Cole, Bonnie K. Cole Dec 2003

Criminal Law And Criminal Procedure, John O. Cole, Bonnie K. Cole

Mercer Law Review

In reading over 900 cases in criminal law and criminal procedure during the survey period, the fact that courts find the time to carefully analyze the allegations of error in each case is striking. The difference in the quality of the courts' work is especially striking when compared to the courts of twenty years ago.

Several themes emerge after reading these cases. The first theme is the number of specious arguments raised on appeal. This is due, in large part, to the Georgia Supreme Court's opinion in Huguley v. State in which the court disapproved Anders motions and forced attorneys …

Domestic Relations, Barry B. Mcgough, Gregory R. Miller Dec 2003

Domestic Relations, Barry B. Mcgough, Gregory R. Miller

Mercer Law Review

Fourteen of the domestic relations appellate cases decided during the survey period' are digested here. Georgia law requires that appeals of domestic relations cases occur through the discretionary application process. A party wanting to appeal an order in a domestic relations case must first file an application to obtain the appropriate appellate court's permission to file an appeal. As part of a pilot project, the Georgia Supreme Court announced it would accept all "non-frivolous" applications filed in domestic relations cases during the calendar year 2003. The pilot project does not include cases that would be appealed first to the court …

In addition, the United States Court of Appeals for the Eleventh Circuit decided one significant case involving judicial elections in Georgia.

Local Government Law, R. Perry Sentell Jr. Dec 2003

Local Government Law, R. Perry Sentell Jr.

Mercer Law Review

After an attorney's bill of more than $600 for February, the town council passed a law Tuesday that limits the ability of the mayor and city clerk to call the attorney. The mayor and clerk were criticized for contacting the town attorney to answer what one council member called "useless questions . . . ." The solution was a new town law requiring that if the mayor, council member, or clerk need to discuss a town issue with the attorney, the mayor and at least three council members must approve the question before the call.

Generally, a little knowledge is …

Since the last survey period, a stringent predatory lending law has come and gone, and the courts have decided numerous cases with real property issues. Not every case decided nor every statute enacted can be discussed. The cases and legislation discussed below were chosen for their significance to real property law and their significance to any attorney who either regularly, or from time to time, practices in the field of real property.

Insurance, Stephen L. Cotter, Stephen M. Schatz, Bradley S. Wolff Dec 2003

Insurance, Stephen L. Cotter, Stephen M. Schatz, Bradley S. Wolff

Mercer Law Review

Extra-contractual issues continue to percolate in the insurance arena. The Georgia Supreme Court resettled the law enforcing contractual suit limitations and created a "safe harbor" for an insurer faced with demands conditioned on terms beyond an insurer's control. The Supreme Court of the United States, in reversing a nine-digit punitive award, laid down "bright-line," conservative rules regulating punitive considerations in extra-contractual and other situations.

Improving Economic Literacy: The Role Of Concurrent Enrollment Programs, Donald H. Dutkowsky, Jerry M. Evensky, Gerald S. Edmonds

Economics - All Scholarship

This paper introduces Concurrent Enrollment Programs (CEPs), within the context of Syracuse University Project Advance (PA) Economics, as a way to improve economic literacy. We describe measures implemented to operate PA Economics as a high-quality CEP, as well as the National Alliance of Concurrent Education Partnerships to establish national standards. This study also contains results from administering to high school students taking PA Economics the nationally normed Test of Economic Literacy (TEL). PA students average nearly one percentage point higher than the AP/Honors Economics Group, and score considerably better than AP/Honors Economics in fundamentals and international economics. By cognitive level, …

Harm, History, And Counterfactuals, Stephen Perry Dec 2003

Harm, History, And Counterfactuals, Stephen Perry

San Diego Law Review

In this Article I undertake a very preliminary inquiry into some aspects of the concept of harm. My excuse for doing so in a symposium on compensation is that, in private law and particularly in tort law, an award of damages is often intended to compensate for harm; if we do not know something about the nature of harm, we cannot fully understand the nature of at least this type of compensation.

Yeast Oxa1 Interacts With Mitochondrial Ribosomes: The Importance Of The C‐Terminal Region Of Oxa1, Lixia Jia, Mary Kathryn Dienhart, Mark Schramp, Matthew Mccauley, Kai Hell, Rosemary A. Stuart Dec 2003

Yeast Oxa1 Interacts With Mitochondrial Ribosomes: The Importance Of The C‐Terminal Region Of Oxa1, Lixia Jia, Mary Kathryn Dienhart, Mark Schramp, Matthew Mccauley, Kai Hell, Rosemary A. Stuart

Biological Sciences Faculty Research and Publications

The yeast mitochondrial Oxa1 protein is a member of the conserved Oxa1/YidC/Alb3 protein family involved in the membrane insertion of proteins. Oxa1 mediates the insertion of proteins (nuclearly and mitochondrially encoded) into the inner membrane. The mitochondrially encoded substrates interact directly with Oxa1 during their synthesis as nascent chains and in a manner that is supported by the associated ribosome. We have investigated if the Oxa1 complex interacts with the mitochondrial ribosome. Evidence to support a physical association between Oxa1 and the large ribosomal subunit is presented. Our data indicate that the matrix‐exposed C‐terminal region of Oxa1 plays an important …

Genetic Locus And Structural Characterization Of The Biochemical Defect In The O-Antigenic Polysaccharide Of The Symbiotically Deficient Rhizobium Etli Mutant, Ce166, Lennart Scott Forsberg, K. Dale Noel, Jodie M. Box, Russell W. Carlson Dec 2003

Genetic Locus And Structural Characterization Of The Biochemical Defect In The O-Antigenic Polysaccharide Of The Symbiotically Deficient Rhizobium Etli Mutant, Ce166, Lennart Scott Forsberg, K. Dale Noel, Jodie M. Box, Russell W. Carlson

Biological Sciences Faculty Research and Publications

The O-antigen polysaccharide (OPS) of Rhizobium etli CE3 lipopolysaccharide (LPS) is linked to the core oligosaccharide via an N-acetylquinovosaminosyl (QuiNAc) residue. A mutant of CE3, CE166, produces LPS with reduced amounts of OPS, and a suppressed mutant, CE166α, produces LPS with nearly normal OPS levels. Both mutants are deficient in QuiNAc production. Characterization of OPS from CE166 and CE166α showed that QuiNAc was replaced by its 4-keto derivative, 2-acetamido-2,6-dideoxyhexosyl-4-ulose. The identity of this residue was determined by NMR and mass spectrometry, and by gas chromatography-mass spectrometry analysis of its 2-acetamido-4-deutero-2,6-dideoxyhexosyl derivatives produced by reduction of the 4-keto group using …

Dynamic Modeling Of Compliant Constant-Force Compression Mechanisms, Cameron Boyle, Larry L. Howell, Spencer P. Magleby, Mark S. Evans Dec 2003

Dynamic Modeling Of Compliant Constant-Force Compression Mechanisms, Cameron Boyle, Larry L. Howell, Spencer P. Magleby, Mark S. Evans

Faculty Publications

A mathematical dynamic model is derived for compliant, constant-force compression-mechanisms, based on the pseudo-rigid-body model simplification of the device. The compliant constant-force compression mechanism (CFCM) is a slider mechanism incorporating large-deflection beams, which outputs near-constant-force across the range of its designed deflection. The equation of motion is successfully calibrated with empirical data from five separate mechanisms, comprising two basic configurations of CFCMs. The dynamic equation is derived from a generalized pseudo-rigid-body model. This allows every configuration to be represented by the same model, so a separate treatment is not required for each configuration. An unexpected dynamic trait of the constant-force …

Charge Transfer In Slow Collisions Of C⁴⁺ With H Below 1 Kev/Amu, Chen-Nan Liu, Anh-Thu Le, C. D. Lin Dec 2003

Charge Transfer In Slow Collisions Of C⁴⁺ With H Below 1 Kev/Amu, Chen-Nan Liu, Anh-Thu Le, C. D. Lin

Physics Faculty Research & Creative Works

We reexamined charge-transfer cross sections for C⁴⁺ + H collisions for energies from 1 meV/amu to 1 keV/amu using the recently developed hyperspherical close-coupling method. Our results agree with several previous theoretical calculations using molecular-orbital expansion. However, these converged theoretical predictions do not agree with total cross sections from the merged-beam experiments.
