Would Brown Make It To New York City? The First Phase Of The Battle For School Integration, 1954-1957, Kristopher B. Burrell

Publications and Research

This conference paper looks at the struggle to desegregate New York's City's public schools in the immediate aftermath of the Brown v Board of Education decision in 1954. For the first three years following the Supreme Court decision, the New York City Board of Education make public overtures toward fulfilling the letter and spirit of Brown in New York, but in practice the Board of Education engaged in stalling and half-measures that succeeded in effectively stopping widespread school desegregation in the city.

Etsu Today - Fall 2003, University Marketing And Communication, East Tennessee State University

ETSU Today [magazine]

I wish to tell you about organizational growth, as we experience it on the campus of ETSU. Although much institutional energy was expended this year in recovering from the government shutdown at the conclusion of the previous fiscal year and in re-orienting the university to manage the massive budget cuts that followed, many significant achievements took place during 2002-2003, due in large part to the strong partnerships that we have forged over the years and the attitude of the fine faculty, staff, and students at ETSU. It took creativity, unconventional thinking, and cooperation to reach closure on the 2003- 2004 …

Sound Science, Careful Policy Analysis, And Ongoing Relationships: Integrating Litigation And Negotiation In Aboriginal Lands And Resources Disputes, Shin Imai

Osgoode Hall Law Journal

Until recently, both courts and dispute resolvers have viewed negotiation and adjudication as two separate processes. What occurred in one process was considered largely irrelevant to what went on in the other. Recently, however, there has been a growing recognition that both processes must work together to resolve disputes over Aboriginal lands and resources. This paper weaves together the emerging trends in court decisions with the new thinking on dispute system design to set out a framework that maximizes the strengths of each process. In this framework, the courts are responsible not only for adjudicating on the substance of Aboriginal …

Exact Multiplicity For Periodic Solutions Of Duffing Type, Hongbin Chen, Yi Li, Xiaojie Hou

Mathematics and Statistics Faculty Publications

In this paper, we study the following Duffing-type equation:

x″+cx′+g(t,x)=h(t),

where g(t,x) is a 2π-periodic continuous function in t and concave–convex in x, and h(t) is a small continuous 2π-periodic function. The exact multiplicity and stability of periodic solutions are obtained.

The Night Gwen Stacy Died:' The End Of Innocence And The Birth Of The Bronze Age, Arnold T. Blumberg

Reconstruction: Studies in Contemporary Culture

[First paragraph]

The time was 1973, and superheroes had some growing up to do.

The signs were already there as the genre eased into its fifth decade as the dominant force in American comic books. 1968 had seen the introduction of Robert Crumb's Zap Comics [1], an underground comic more concerned with counterculture trends and bucking the establishment than chronicling the exploits of spandex-wearing conservatives. The medium was testing its boundaries, finding flexibility where once there had been rigidity, and soon superheroes began to look like a timelost collection of crusaders who spoke to a generation long since past.

Three Steps And You're Out: The Misuse Of The Sequential Evaluation Process In Child Ssi Disability Determinations, Frank S. Bloch Oct 2003

Three Steps And You're Out: The Misuse Of The Sequential Evaluation Process In Child Ssi Disability Determinations, Frank S. Bloch

University of Michigan Journal of Law Reform

The federal Supplemental Security Income (SSI) program provides cash benefits to financially needy persons who are 65 years of age or older, blind, or disabled. It also provides cash benefits to children with disabilities under the age of 18. This Article examines three sets of regulatory efforts to implement special disability standards for children, based first on the original SSI legislation, then on a seminal Supreme Court decision, and finally on amendments to the Social Security Act overruling the Court's decision, and shows how the "sequential evaluation process," which has been useful for adjudicating adult disability claims, has been a …

Chapter 11 At Twilight, Robert K. Rasmussen, Douglas G. Baird Oct 2003

Chapter 11 At Twilight, Robert K. Rasmussen, Douglas G. Baird

Coase-Sandor Institute for Law & Economics Research Paper Series

In The End of Bankruptcy we set out the forces that have rendered obsolete traditional conceptions of corporate reorganization. Lynn LoPucki wrote a critique that asserted that our paper lacked empirical foundation. In this response, we draw on LoPucki’s data set of the reorganization of large, publicly held entities to show the robustness of our claims, both empirical and theoretical. Looking in detail at the firms whose Chapter 11 cases ended in 2002, most of which concluded after we completed our original piece, we find that in over 80% of the cases the assets of the firm were either sold …

Helicobacter Pylori Infection And Micronutrient Deficiencies., Javed Yakoob, Wasim Jafri, Shahab Abid Oct 2003

Helicobacter Pylori Infection And Micronutrient Deficiencies., Javed Yakoob, Wasim Jafri, Shahab Abid

Section of Gastroenterology

It is known that deficiencies of micronutrients due to infections increase morbidity and mortality. This phenomenon depicts itself conspicuously in developing countries. Deficiencies of iron, vitamins A, E, C, B12, etc are widely prevalent among populations living in the third world countries. Helicobacter pylori (H pylori) infection has a high prevalence throughout the world. Deficiencies of several micronutrients due to H pylori infection may be concomitantly present and vary from subtle sub-clinical states to severe clinical disorders. These essential trace elements/micronutrients are involved in host defense mechanisms, maintaining epithelial cell integrity, glycoprotein synthesis, transport mechanisms, myocardial contractility, brain development, cholesterol …

Fundamental Retribution Error: Criminal Justice And The Social Psychology Of Blame, Donald A. Dripps Oct 2003

Fundamental Retribution Error: Criminal Justice And The Social Psychology Of Blame, Donald A. Dripps

Vanderbilt Law Review

At least since the M'Naghten case of the 1840s,' Anglo- American criminal law has concerned itself closely, famously, and contentiously with the psychology of the accused. Another significant body of scholarship addresses the psychology of juries, and other valuable research has approached some of the rules of criminal evidence from the perspective of social and cognitive psychology. There has, however, yet to be a general investigation of what social cognition research might teach us about the criminal law's pervasive concern with blameworthiness.

This Article undertakes that investigation. It brings research on the psychology of social cognition to bear on the …
