Risk Factors Associated With The Mucociliary Apparatus In Intensive Care Patients, Ross James Kay Jan 2003

Risk Factors Associated With The Mucociliary Apparatus In Intensive Care Patients, Ross James Kay

Peninsula Medical School Theses

Initially, there were two principal aims of this investigation. A laboratory based project studying the effect of elevated fraction of inspired oxygen on the ciliary coverage of rat trachea in culture and a clinically based investigation of the ciliary coverage and frequency of ciliary ultrastructural abnormalities in the bronchus of intensive care unit patients. The mucociliary apparatus is the main airway defence mechanism protecting the lungs from respiratory infections. It is vital in intubated patients, as they lack the back up clearance mechanism normally provided by the cough reflex. Ciliary coverage and ultrastructural integrity are two key components of effective …

Campaign Spending In The Local Government Elections Of 1999, Kenneth Benoit, Michael Marsh Jan 2003

Campaign Spending In The Local Government Elections Of 1999, Kenneth Benoit, Michael Marsh

Research Collection School of Social Sciences

For the first time in Irish electoral history, the 1999 local elections required candidates to publicly declare their campaign expenditures. Drawing on these data, we explore patterns in campaign spending and assess their impact, both on candidate success and on turnout. First, examining the elections contested by 1,838 candidates from 180 local constituencies and 34 councils, we identify both partisan and geographic spending patterns, and examine how well these can be explained as a function of political and demographic variables. Second, we model and estimate the effects of expenditure on individual electoral outcomes. The findings clearly indicate that even at …

Islam, Democracy And Civil Society, Chandran Kukathas Jan 2003

Islam, Democracy And Civil Society, Chandran Kukathas

Research Collection School of Social Sciences

What is the relationship between Islam, democracy, and civil society? This is thequestion which supplies the topic of this essay, Its purpose, more particularly, is to explore theplace of Islam in the modern world-a world which contemporary writers increasingly try tounderstand by invoking the notions of democracy and civil society. But the occasion for thisexploitation has a more precise origin still. The issue of the place of Islam in the modernworld is raised, more often than not, by writers and commentators for whom Islam is, aboveall, a danger, in geo-political terms, it is a danger to the West; in world-historical …

The Cultural Contradictions Of Socialism, Chandran Kukathas Jan 2003

The Cultural Contradictions Of Socialism, Chandran Kukathas

Research Collection School of Social Sciences

While no one has yet announced the death of capitalism, reports of its imminent demise have been as numerous as they have been exaggerated. Such reports have usually been bolstered by thoughtful analyses of the fundamental contradictions of capitalism, which was expected to come sliding—if not crashing—down under the weight of its own inconsistencies. Leaving aside Karl Marx's own predictions, twentieth-century analysts as diverse as Joseph Schumpeter, Daniel Bell, and Jurgen Habermas have asserted that the contradictions of capitalism could only mean that its days were numbered. Alas, all that has been established by these analyses is that predictive failure …

Lists: Starting Points For Researching And Writing The Histories Of Academic Departments, Michael R. Hill Jan 2003

Lists: Starting Points For Researching And Writing The Histories Of Academic Departments, Michael R. Hill

Department of Sociology: Faculty Publications

The discovery, imaginative construction, and methodical compilation of lists is a productive initial strategy for researching and writing the histories of academic department and small professional organizations. When purposefully conceptualized as inclusive, list construction provides a methodological framework that curtails the seemingly inherent tendency of historical writers to overlook the contributions and participation of minority members of professional organizations – I use the term “minority” here in the widest possible sense, to indicate virtually anyone who by one criterion or another has come to be defined or perceived as somehow “marginal” or “unimportant” to the historical record you are documenting.

Legal Transitions: Some Welfarist Remarks, Matthew D. Adler Jan 2003

Legal Transitions: Some Welfarist Remarks, Matthew D. Adler

Faculty Scholarship

This essay offers a sympathetic, utilitarian critique of Louis Kaplow's famous argument for legal retroactivity in his 1986 article, "An Economic Analysis of Legal Transitions." The argument, very roughly, is that the prospect of retroactivity is desirable if citizens are rational because it gives them a desirable incentive to anticipate legal change. My central claim is that this argument trades upon a dubious, objective view of probability that assumes rational citizens assign the same probabilities to states as rational governmental officials. But it is subjective, not objective probabilities that bear on rational choice, and the subjective probabilities of rational citizens …

Factors Related To Academic Gains For Adult Learners In A Correctionaleducation Program, Maria Deanne Sells Jan 2003

Factors Related To Academic Gains For Adult Learners In A Correctionaleducation Program, Maria Deanne Sells

All-Inclusive List of Electronic Theses and Dissertations

Education programs within the Indiana Department of Correction are evaluated on the number of student to teacher contact hours provided, the number of students enrolled and the number of students promoted or graduated from each program. Since each facility develops its own program design forEducation, it is important for each program to evaluate the effectiveness of the program design based on the individual program goals and objectives. The purpose of this study was to investigate the relationships among program placement, motivational time factors (i.e., age, length of sentence, time served, earliest possible release date, and time cut eligibility) and academic …

Analysis Of Space Employee Risk Acceptance, Aliya Bostubayeva Jan 2003

Analysis Of Space Employee Risk Acceptance, Aliya Bostubayeva

Theses

In the summer of 2002, eighty-one students, faculty and staff of RIT took a survey that was aimed at determining the possible employees expectations about the risk compensation if hired to work in space. Every mission in space entails a certain degree of health damage; the length of stay is directly related with more risk involved. The survey results help understand rough estimations of risk acceptance of the future space labor force (cosmonauts and astronauts not included). Three sets of questions described the consequences of space missions (short, month-long and long), where the extent of health damage is directly dependent …

The Principal's Role In Promoting Success For Culturally And Linguistically Diverse Students: A Participatory Research Study, Maria Norma Martinez

Doctoral Dissertations

We need to understand more fully what facilitates success in schools with diverse populations. Through participatory research, the voices of school principals who are responsive to the needs of culturally and linguistically diverse students were recorded and analyzed to provide insights on the practices that promote the school success of culturally and linguistically diverse students. Using a dialogic retrospective, the participants had the opportunity to engage, individually and collectively, in reflection and dialogue to identify common themes that emerged in their important work as school leaders and as advocates for diverse students.

The Federal Income Tax Act And Private Law In Canada: Complementarity, Dissociation, And Canadian Bijuralism, David G. Duff

All Faculty Publications

This article examines the relationship between the federal Income Tax Act (ITA) and provincial private law, evaluating judicial decisions and statutory provisions according to the goals of Canadian bijuralism expressed in the policy on legislative bijuralism adopted by the federal Department of Justice in June 1995, the preamble to the first Federal Law-Civil Law Harmonization Act, No. 1, and new sections 8.1 and 8.2 of the federal Interpretation Act. The first part of the article reviews notable cases in which Canadian courts have recognized a relationship of complementarity between the ITA and provincial private law, looking at cases arising in …

An Empirical Test Of Justice Scalia's Commitment To The Rule Of Law, Gary S. Lawson Jan 2003

An Empirical Test Of Justice Scalia's Commitment To The Rule Of Law, Gary S. Lawson

Faculty Scholarship

On January 13, 2001, barely one month after the Supreme Court's decision in Bush v. Gore, a group of 554 legal academics calling themselves "Law Professors for the Rule of Law" took out a full-page ad in the New York Times that essentially accused the Court's majority of being faithless to the rule of law. In full, the advertisement read: BY STOPPING THE VOTE COUNT IN FLORIDA, THE U.S. SUPREME COURT USED ITS POWER To ACT AS POLITICAL PARTISANS, NOT JUDGES OF A COURT OF LAW We are Professors of Law at 120 American law schools, from every part of …

Excuse And Justification In The Law Of Fair Use: Transaction Costs Have Always Been Only Part Of The Story, Wendy J. Gordon Jan 2003

Excuse And Justification In The Law Of Fair Use: Transaction Costs Have Always Been Only Part Of The Story, Wendy J. Gordon

Faculty Scholarship

In American copyright law, the doctrine of "fair use" has long been problematic. Every plausible litmus test that might simplify the "fair use" inquiry has proven inadequate, and copyright commentators have long sought an algorithm or heuristic to lend predictability and conceptual coherence to the doctrine. Twenty years ago, I published in this Journal an article entitled Fair Use as Market Failure, which suggested that the key to understanding the protean terms of "fair use" could best be found in the notion of market failure. That 1982 article has been often misapplied, by both courts and commentators. I am …

Reexamining The Posse Comitatus Act: Toward A Right To Civil Law Enforcement, Sean J. Kealy Jan 2003

Reexamining The Posse Comitatus Act: Toward A Right To Civil Law Enforcement, Sean J. Kealy

Faculty Scholarship

The military is currently prohibited by federal statute from participating in domestic law enforcement. The Posse Comitatus Act of 1878 ("PCA") establishes criminal penalties for people who willfully use members of the Army or the Air Force to execute the laws. Although a product of the Reconstruction Era, this law reflects a strong American tradition against the domestic use of the military that stretches back before the founding of the nation.

International Commercial Dispute Resolution, William W. Park, Andrea K. Bjorklund, Jack J. Coe Jan 2003

International Commercial Dispute Resolution, William W. Park, Andrea K. Bjorklund, Jack J. Coe

Faculty Scholarship

A recent Court of Appeals decision has made it more difficult for judges in the United States to second-guess arbitrators in international cases. To understand the significance of the recent decision, one must remember that the Federal Arbitration Act (FAA) has been interpreted to permit vacatur of awards in an international arbitration on the same grounds available in domestic cases. Thus, a litigant who is unhappy with an arbitrator's decision gets a chance to re-argue the case by alleging "manifest disregard of the law," a ground for judicial review created fifty years ago by Supreme Court dictum.

Air Intake Cooling Motor Vehicle Performance Enhancement, James Brunton, David Kennedy, John D. Kelleher Jan 2003

Air Intake Cooling Motor Vehicle Performance Enhancement, James Brunton, David Kennedy, John D. Kelleher

Articles

This research examined the practical effects of cooling the intake air, on the combustion characteristics of a modern motor vehicle operating under simulated road conditions as well as its subsequent impact on the environment. The cooling effect was achieved by taking a typical air conditioning rig as fitted to a modern motor vehicle and incorporating it into the induction system of the car. The test vehicle used was a 1993 Renault Safrane 2.0Vi standard passenger car that was modified as part of the research to facilitate the extraction of the required test information. A series of tests were conducted using …

An Evaluation Of An Alternative High School As A Learning Organization, David K. Moore Jan 2003

An Evaluation Of An Alternative High School As A Learning Organization, David K. Moore

Abraham S. Fischler College of Education ETD Archive

The problem that was addressed by this evaluation study was the failure of a majority of the students who entered the Alternative Program at Miami-Douglas MacArthur Senior High School South (MDMS) to return to their schools of residence. Of those who did return, over 60% were unsuccessful. The systemic changes that were needed to resolve this problem required the faculty to function as an effective learning organization as described in the research of P. Senge. Evaluation research was conducted to determine to what extent MDMS staff was functioning within each of the 5 disciplines of a learning organization.

The data …

Case Study Of Public School 370 And Implementation Of An Education Program For Disabled 18- To 21-Year-Old Detainees, Dawn A.J. Downing

Abraham S. Fischler College of Education ETD Archive

This applied dissertation describes an alternative public high school for adjudicated youth. This report discusses the legal and social issues that justify the need for the implementation of an education program for 18- to 21-year-olds detained in the Baltimore City Detention Center. Analysis of internal and external data sources indicated the need for this case study.

The focus of this study was creating a learning community where educational staff and security staff work together to provide an appropriate education for adjudicated students. The relationship between educators and correctional staff can be an uneasy one when the security and education staffs …

Increasing Students’ Performance In English Within A Two-Way Bilingual Immersion Program, Jacquelyne Hoy Jan 2003

Increasing Students’ Performance In English Within A Two-Way Bilingual Immersion Program, Jacquelyne Hoy

Abraham S. Fischler College of Education ETD Archive

During the 2000-2001 school year, 30.76% of the 1st- through 3rd-grade students performed below grade level in the English reading comprehension test. Consequently, 35% of the students withdrew from Lycée Franco-American during the 2000-2001 school year because their parents feared that their children would not perform at or above grade level in English.

This writer conducted an initial analysis of the study in May of 2001, which revealed the following causes for the low performance in English reading comprehension: (a) teachers’ lack of training and experience in 2-way bilingual immersion programs, (b) the English program was too cumbersome and did …

Historical Perspectives (Apoptosis), James Curtin, Thomas Cotter Jan 2003

Historical Perspectives (Apoptosis), James Curtin, Thomas Cotter

Articles

Apoptosis is one of the most widely studied fields in biology and accounts for over 2% of all life science publications annually. It plays a fundamental role in development, and defects in the regulation of apoptosis are directly implicated in numerous well-known diseases including cancer, neurodegenerative disorders, tissue atrophy and auto-immune diseases. However, the field of apoptosis has humble beginnings and was neglected by biologists for much of its history. This chapter reviews the history of research in apoptosis and highlights key experiments that have contributed significantly to our current understanding of apoptosis. In addition, the topics covered in later …

Assessment Of The Acoustic Properties Of Common Tissue-Mimicking Test Phantoms, Jacinta Browne, K. Ramnarine, A. Watson, P. Hoskins

Articles

Ultrasound (US) test phantoms incorporating tissue-mimicking materials (TMMs) play an important role in the quality control (QC) and performance testing of US equipment. Three commercially available TMMs (ZerdineTM from CIRS Inc.; condensed-milk-based gel from Gammex RMI; urethane-rubber-based from ATS Labs) and a noncommercial agar-based TMM, were investigated. Acoustic properties were measured over the frequency range 2.25 to 15 MHz at a range of ambient temperatures (10 to 35°C). The acoustic velocity of the TMMs remained relatively constant with increasing frequency. Only the agar-based TMM had a linear increase of attenuation with frequency, with the other materials exhibiting nonlinear responses to …

Elastomeric Hoof Boots, John Hanley Jan 2003

Elastomeric Hoof Boots, John Hanley

Masters

The design, manufacture and testing of a prototype elastomeric equine boot is described in this thesis. Thoroughbred horses may suffer from a number of serious hoof disorders. These include stone bruising, navicular syndrome and hoof wall separation. Excessive concussion in the equine hoof is a major contributory factor in most of the problems horses experience in their lower limbs. Bandaging of a horses foot after injury is time consuming as well as being labour intensive. The proposed boot serves a number of purposes; by replacing bandages during poulticing it plays a part in faster healing of foot ailments. It can …
