A Theory Of Self-Control Problems And Incomplete Contracting: The Case Of Shareholder Contracts, Manuel A. Utset Jan 2003

A Theory Of Self-Control Problems And Incomplete Contracting: The Case Of Shareholder Contracts, Manuel A. Utset

Utah Law Review

This Article approached the incomplete contracting problem from a new perspective, one that brought to the foreground potential self-control problems faced by contracting parties. The Article identified two sources of incomplete contracts due to self-control problems. First, this Article showed how the timeinconsistent preferences of transacting parties can lead the parties to repeatedly procrastinate adopting contractual provisions that they had a strict (long-term) preference to adopt. Second, the Article showed how the intertemporal nature of contracting can lead to a projection bias by transacting parties: when trying to predict how their preferences may evolve during the transaction, parties will tend …

Restorative Justice And The Two-Track Establishment Clause, Frederick Mark Gedicks Jan 2003

Restorative Justice And The Two-Track Establishment Clause, Frederick Mark Gedicks

Utah Law Review

Many restorative justice programs, however, do have religious dimensions. A circle sentencing session, for example, may open or close with a prayer or other group religious ritual. Victim-offender mediations may be structured in accordance with theological concepts such as forgiveness, repentance, or atonement, or on sectarian versions of secular ideas like apology, remorse, restitution, or reconciliation. Many would argue, in fact, that even these ostensibly secular ideas were once religious. Participants in such mediations may explicitly invoke a God or a religious belief system as the source of ethical obligations owed by offenders or victims. For instance, a mediation involving …

Beyond Facile Assumptions And Radical Assertions: A Case For "Critical Legal Economics", Reza Dibadj Jan 2003

Beyond Facile Assumptions And Radical Assertions: A Case For "Critical Legal Economics", Reza Dibadj

Utah Law Review

While both L&E and CLS may have emerged as a reaction to the formalism of legal process, both in turn have become trapped by their own formalisms. For traditional L&E, it is a host of facile neoclassical assumptions to make possible "a brand of economic theory that expressed more rigorously the same laissez-faire vision that the realists had attacked decades before. For CLS, a panoply of unsubstantiated radical assertions have confined its adherents to the "prescriptively impotent tools of dissent and deconstruction.' The true insights within each school emerge once the doctrinaire mask of formalism is eschewed. Once this is …

Writing In A Second Grade Math Class, Tammy Bakken Jan 2003

Writing In A Second Grade Math Class, Tammy Bakken

Graduate Research Papers

Writing in math has given me a much better benchmark-driven curriculum. I know more clearly how to help students accomplish math benchmarks. I used to have a separate time for the students in my classroom to write and a separate time for my students to do math. Nearly two years ago, I had the idea of writing in math. I read what other teachers had tried and I tried to include more writing in math. The results have confirmed my belief that writing in math is a worthwhile practice. Writing in math gave my students a greater understanding of math. …

Using Wordless Picture Books To Stimulate Fictional Writing In First-Grade Students, Kathryn Nicol Morris

Graduate Research Papers

The use of wordless picture books was a successful strategy as an adult intervention for helping students at different levels in their writing ability to produce a story that followed a logical progression of events; that had a clear beginning, middle and end; and that described a character's experiences to a point of conclusion. This was accomplished with varying degrees of teacher assistance required. The stories from these students showed some similarities, but each student brought some unique element to the writing. The stories were distinguishable, even though the text in each story was inspired by the same set of …

In response to this important role, the International Society for Technology in Education has created technology standards for students and teachers to promote change in teaching and learning practices. A study done by Apple Computer identifies how far teachers are in the integration of technology to meet these standards.

When teachers' levels and concerns are identified, programs help teachers overcome their computer concerns, such as not having enough time, right equipment, or knowledge. Teachers also need to frequently practice what they have learned. In this time period, follow-up …

Design Of A Tem-Cell With Increased Usable Test Area, Kresimir Malaric, Juraj Bartolic Jan 2003

Design Of A Tem-Cell With Increased Usable Test Area, Kresimir Malaric, Juraj Bartolic

Turkish Journal of Electrical Engineering and Computer Sciences

Transversal electromagnetic mode cells (TEM-cells) are used for electromagnetic compatibility measurements (emission and immunity), and for biomedical applications. Over the years, higher and higher frequencies are being used, which demands smaller transmission structures in order to obtain the homogeneous field distribution due to resonance. Such resonance destroys the TEM field, introducing higher order modes. The goal was to design the TEM-cell for GSM frequencies that will have a larger area with a homogeneous field used for testing, while still obtaining the characteristic impedance. Commercial TEM-cells used for frequencies of 900 MHz have only 2 cm in height available for testing, …

Theory Of Antisymmetric Tensor Fields, Valeri Dvoeglazov Jan 2003

Theory Of Antisymmetric Tensor Fields, Valeri Dvoeglazov

Turkish Journal of Physics

It has long been claimed that the antisymmetric tensor field of the second rank is pure longitudinal after quantization. In my opinion, such a situation is quite unacceptable. I repeat the well-known procedure of the derivation of the set of Proca equations. It is shown that it can be written in various forms. Furthermore, on the basis of the Lagrangian formalism I calculate dynamical invariants (including the Pauli-Lubanski vector of relativistic spin for this field). Even on the classical level, the Pauli-Lubanski vector can be equal to zero after applications of well-known constraints. The importance of the normalization is pointed …

Pulsed River Flooding Effects On Sediment Deposition In Breton Sound Estuary, Louisiana, Katherine Wheelock Jan 2003

Pulsed River Flooding Effects On Sediment Deposition In Breton Sound Estuary, Louisiana, Katherine Wheelock

LSU Master's Theses

Louisiana's deltaic coast is a dynamic sedimentary environment made vulnerable by Mississippi River channelization, which restricts freshwater, sediment, and nutrient inputs to adjacent estuaries. Freshwater diversions now reconnect some estuaries with historic fluvial sources, like Breton Sound basin, which receives Mississippi River suspended loads through the Caernarvon freshwater diversion. The project objectives were to quantify short-term sediment accumulation using sediment traps, evaluate sediment trap effectiveness, and compare long-term deposition using feldspar horizon markers and 210Pb dating to the annual sediment trap deposition. Magnitude and variations of sediment deposition at 14 sites were compared during an 18-month study in the upper …

Advancing U.S. Interests With The International Criminal Court, David J. Scheffer Jan 2003

Vanderbilt Journal of Transnational Law

It is a great pleasure to be here in this beautiful lecture hall at Vanderbilt University Law School and to have the opportunity to speak to you this afternoon about the International Criminal Court (ICC). In recent months, one newspaper or magazine article after another, in examining the foreign policy of the current administration and the gulf (which seems to be so pronounced now) between the United States and even its closest allies throughout the rest of the world, has listed a basic set of treaties as being partly explanatory of that gulf. The Kyoto Protocol, for example, is always …
