Emotional Intelligence And Academic Performance Of College Honors And Non-Honors Freshmen, Malaika Castro-Johnson, Alvin Wang Oct 2003

Emotional Intelligence And Academic Performance Of College Honors And Non-Honors Freshmen, Malaika Castro-Johnson, Alvin Wang

Journal of the National Collegiate Honors Council Online Archive

A positive freshman year experience is critical for student persistence and longterm success in college (Tinto, 1975; Tinto & Goodsell,1993). Recently, institutions have begun to recognize that student factors beyond demographics, academic records, and standardized test scores influence the likelihood of a positive freshman year experience (Levitz & Noel, 1989). “Emotional intelligence” is one such factor which is instrumental in situations that call upon students to adjust successfully from one environment to another (Hettich, 2000). While there is some data on the personality characteristics of college Honors students (Grangaard, 2003), to our knowledge no data have been collected on their …

Unity In Diversity: The Virtues Of A Metadisciplinary Perspective In Liberal Arts Education, Alexander Werth Oct 2003

Unity In Diversity: The Virtues Of A Metadisciplinary Perspective In Liberal Arts Education, Alexander Werth

Journal of the National Collegiate Honors Council Online Archive

Remember the story of the blind men and the elephant? Each man touches a different part of the animal (its side, trunk, tusk, leg, ear, and tail) and pronounces his find a wall, a snake, a spear, a tree, a fan, or a rope. As the poet Godfrey Saxe (1816-1997) wrote of the blind men in his retelling of this ancient Indian parable, “Though each was partly in the right, they all were in the wrong” (Galdone, 1973). This allegory quickly encapsulates the benefits, and the challenges, of seeing, or not seeing, something through multiple perspectives—in short, it illuminates the …

Gender, Professional Orientation, And Student Achievement: Elements Of School Culture, Teresa White, Barbara N. Martin, Judy A. Johnson Oct 2003

Gender, Professional Orientation, And Student Achievement: Elements Of School Culture, Teresa White, Barbara N. Martin, Judy A. Johnson

Journal of Women in Educational Leadership

This study explored the relationships between professional orientation (defined as how the principal sees his or her role in the organization) and school culture, the influence of gender on professional orientation, and the relationship between school culture and the academic achievement of students. One hundred principals were surveyed. Two instruments, the Professional Orientation and the School Culture Survey were completed. The results were analyzed using linear regression statistics to determine (a) gender and professional orientation effect on the factors of school culture, and (b) if factors of school culture had an effect on student success in the elementary school. Findings …

Conflicts In The Regulation Of Hostile Business Takeovers In The United State And The European Union, Barbara Ann White Oct 2003

Conflicts In The Regulation Of Hostile Business Takeovers In The United State And The European Union, Barbara Ann White

All Faculty Scholarship

This essay focuses on hostile business takeovers to illustrate the significance that cultural differences among nations can play in developing a harmonized European Union law. After 12 years of development, the EU Directive regulating hostile takeovers, to everyone’s surprise, was voted down in the EU Parliament in 2001. The EU Parliament consists of the member nations and the movement to defeat the Directive was led by Germany, which had just suffered a brutal hostile takeover of its largest company by British raiders.

The “harmonization” efforts within the EU (i.e., establishing uniform laws among the member nations) mirrors the federalism movement …

Age Group Differences In Recall Of Relevant And Irrelevant Words, Daniel Jose' Padilla Oct 2003

Age Group Differences In Recall Of Relevant And Irrelevant Words, Daniel Jose' Padilla

Master's Theses - Daytona Beach

Many studies have shown that older adults tend to perform more poorly on memory tasks, when compared to younger people. Conversely, studies have also indicated that there may be ways to combat this decline in age related memory performance by using memory aid techniques. In addition to memory aid techniques, word familiarity may be used to increase memory performance because working memory for familiar words benefits from the availability of long-term phonological memory representations, which act to "clean up" the decaying memory traces of items in the list retrieval stage. This memory study compared word recall performance of younger and …

Review Of Red Matters : Native American Studies By Arnold Krupat, James H. Cox Oct 2003

Review Of Red Matters : Native American Studies By Arnold Krupat, James H. Cox

Great Plains Quarterly (through 2013)

A reviewer of Red Matters might reasonably expect a work with the post-colon title Native American Studies to foreground Native intellectual voices or the voices of Native and nonnative scholars who work in the field and publish in the field's journals and to privilege indigenous critical perspectives. The reviewer might have some apprehension, however, that Krupat would say he or she was provincial or a "back to the blanket" scholar. The title, nevertheless, is part of a broad deception, for though red matters in Red Matters, non-indigenous critical perspectives and Western and non-Native intellectual, cultural, and historical traditions matter …

Review Of Forming The Collective Mind: A Contextual Exploration Of Large-Scale Collaborative Writing In Industry, By Geoffrey A. Cross., Barbara Couture Oct 2003

Review Of Forming The Collective Mind: A Contextual Exploration Of Large-Scale Collaborative Writing In Industry, By Geoffrey A. Cross., Barbara Couture

Department of English: Faculty Publications

We have come a long way in studies of writers in professional settings, learning with each exploration how these behaviors differ from and relate to the processes we have taught beginning writers in our classroom. Studies of these processes have become increasingly more sophisticated since Selzer (1983) treated researchers to his intriguing account of a technical writer’s composing processes. Next, we saw case studies of writers designed to produce real-world writing contexts for students—such as Cases for Technical and Professional Writing, which I coauthored with Rymer Goldstein (1985)—and then more detailed descriptions of how writers learn to become proficient communicators …

The Price Of Education: What Local Control Is Costing American Children., Debra L. Ireland Oct 2003

The Price Of Education: What Local Control Is Costing American Children., Debra L. Ireland

The Scholar: St. Mary's Law Review on Race and Social Justice

Wealth and property are not equally distributed in America, and these inequities are exacerbated by the American school system. The current school system is community-centered, meaning children living in poorer districts do not have access to the same level of education as children living in wealthier districts. The comment discusses the impact that budgeting decisions have on community perceptions and expectations, as well as how community favoritism plays a role in the education financing equation. Finally, the author proposes eliminating what is essentially an “educational caste system,” and discusses how to change the attitudes of society and alter the ways …

Mind Your Own Business: The Trouble With Justice In Plato's Republic, John Patrick Coby Oct 2003

Mind Your Own Business: The Trouble With Justice In Plato's Republic, John Patrick Coby

Government: Faculty Publications

The Republic’s paradoxical definition of justice—minding one’s own business—comes mainly from Socrates’ examination of the arts. The definition applies well to artisans who specialize in single trades, but poorly to warriors who meddle in everyone’s affairs. Are the warriors then unjust? Rather than conclude that they are, the paper maintains that justice is conditioned by class and that the justice practiced by warriors (self-sacrificing and homogenizing) differs from the justice practiced by workers (self-serving and differentiating). But because the formal definition never changes, despite the awkwardness of fit, the paper further suggests that something is askew with justice, with its …

Death Of An Accountant: The Jury Convicts Arthur Andersen Of Obstruction Of Justice, Stephan Landsman Oct 2003

Death Of An Accountant: The Jury Convicts Arthur Andersen Of Obstruction Of Justice, Stephan Landsman

Chicago-Kent Law Review

Since at least the time of Peter Zenger, American juries have served as agents of legal and social change. When and how juries become involved in transformative decision making has only occasionally been examined. This Article seeks to explore the jury as change agent in the context of the recent conviction of the Arthur Andersen accounting firm on a charge of obstruction of justice. It analyzes the erroneous belief that the case would be a "slam-dunk" for the government, detailing why the jury found the matter so difficult to decide. It then considers the reasons for the government's hard-won victory …

Pay Secrecy/ Confidentiality Rules And The National Labor Relations Act, Rafael Gely, Leonard Bierman

Faculty Publications

This article seeks to provide a comprehensive account of doctrinal issues related to the use of pay secrecy/confidentiality rules (“PSC rules”) under the NLRA. In Part II, we describe what pay secrecy/confidentiality is and discuss recent survey evidence of their presence in workplaces across the United States. In Part III, we describe the current legal framework under which PSC rules are evaluated under the NLRA, while in Parts IV and V, we explore various doctrinal issues related to these rules in more detail. This leads us to Part VI, where we ponder the future of PSC rules under the NLRA …

The Origins Of Felony Jury Sentencing In The United States, Nancy J. King Oct 2003

The Origins Of Felony Jury Sentencing In The United States, Nancy J. King

Chicago-Kent Law Review

This Article traces the development of jury sentencing in non-capital felony cases in Virginia and Kentucky, as well as the rejection of jury sentencing in Pennsylvania, in the late eighteenth century. Several of the explanations that modern commentators on jury sentencing have offered for the adoption of jury sentencing are questioned. In Virginia, where party politics may have affected the choice of jury over judge, pockets of judicial sentencing power remained, inconsistent with a strong preference for the democratic judgment of a jury in punishment over the professional decisions of the judiciary. Kentucky's experience suggests that settlement patterns and legal …
