How talk show workers, guests and audiences behave behind-the-scenes is largely a mystery to the public. This research focuses on the behind-the-scenes workings of a daytime syndicated talk show to better understand the motivations of talk show guests and how talk show workers manipulate guests and audiences. While researchers have conducted studies of talk show guests using formal interviews and questionnaires, no researchers have posed as covert observers to study talk shows. The Mausoleum of Galla Placidia has generated a lengthy bibliography over the centuries but, in spite of repeated investigations, the north and south arm barrel vaults have received almost no attention. Commentary on these areas of the mosaic program is usually brief and limited to a comparison between the appearance of the barrel vaults and patterns found in various textiles, such as carpets. This eight-week descriptive study examined the impact of the incorporation of a Life-Application Learning Methods Program on struggling middle school readers. Two questions were explored: 1) How did incorporating life–application learning into the middle school curriculum impact reading motivation?, and 2) How did incorporating life-application learning in the middle school curriculum impact the reading levels? Participants in the study were eight eighth-grade students considered to be struggling readers Qualitative methods were used for this study utilizing responses from a survey, two inventories, student journals, and researcher observations. The 1991 Supreme Court decision in Gilmer v. Interstate/Johnson Lane Corp. introduced a new era in the enforcement of statutory rights designed to protect individuals in the workplace. No longer would employees be entitled to a judicial forum or employers limited to such a forum in adjudicating workplace disputes. Rather, Gilmer created the possibility that pre-dispute employment contracts could bind workers to litigate important public rights in the private forum of arbitration under the auspices of the Federal Arbitration Act. This possibility reached fruition in the Court's 2001 decision in Circuit City Stores, Inc. v. Adams, making such pre-dispute arbitration …

This Note provides an overview of California's mental health care system. It discusses the history of the civil liberty movement as it pertains to mental health care and its impact on the current system. The Note argues that the present system is inadequate because of the obstacles to obtaining treatment and, when it is available, the poor quality of mental health care. This Note also explores the societal consequences of the current system and offers some alternatives.

Clear Sailing Agreements: A Special Form Of Collusion In Class Action Settlements, William D. Henderson

A clear sailing agreement (or clause) is a compromise in which a class action defendant agrees not to contest the class lawyer's petition for attorneys' fees. This Article argues that clear sailing provisions often facilitate collusive settlements in cases involving non-pecuniary relief or claims-made common funds that return all unclaimed monies to the defendant. Because these types of settlements present difficult valuation problems, trial courts lack a clear benchmark for calculating attorneys' fees. Defendants and class can exploit this uncertainty by presenting an inflated settlement value to the court (to justify higher attorneys' fees) while simultaneously reducing the true cost …

Human rights language is particularly attuned to setting out the goals of protecting the worlds least protected people. As human rights advocates have entered negotiations with international economic institutions and transnational corporations (TNCs), such negotiations have often resulted in an alternative language to describe the necessity of protecting and promoting human rights. After describing the progressive inclusion of human rights ideas by TNCs, the World Bank, the IMF, and the WTO, this Article argues that, while such inclusion is a benefit to the human rights movement, the creation of an alternative language to describe human rights goals is potentially detrimental. …

A scalable parallel algorithm, Macro-Molecular Dynamics (MMD), has been developed for large-scale molecular dynamics simulations of organic macromolecules, based on space-time multi-resolution techniques and dynamic management of distributed lists. The algorithm also includes the calculation of long range forces using Fast Multipole Method (FMM). FMM is based on the octree data structure, in which each parent cell is divided into 8 child cells and this division continues until the cell size is equal to the non-bonded interaction cutoff length. Social capital-resources embedded in social structures that can be accessed or mobilized by individuals in pursuit of some goal- is the most prominent in a long line of concepts developed by social scientists who wish to incorporate social and cultural elements into models of economic behavior. The research presented here is a qualitative exploration of social capital, its forms and functions, and its relationship to the occupational decision-making of current and former oyster harvesters in Plaquemines Parish, Louisiana. Very little research, however, has been conducted to quantify the benefits that gardening provides to students. The inadequate removal of aconitic acid from sugar cane juice during the clarification process results in the acid contributing to processing difficulties, sucrose loss and extended down time. However, very few attempts have been made to remove the acid during normal factory operations. Batch clarification techniques were used in this study to investigate the effect of sucrose concentration, temperature, pH, time, defecant, and defecant concentration on aconitic acid removal from a synthetic juice solution. It is important to be able to predict the potential spread of water borne diseases when building dams or redirecting rivers. This study was designed to test whether the use of a growing degree day (GDD) climate model and remotely sensed data (RS) within a geographic information system (GIS), could be used to predict both the distribution and severity of Schistosoma haematobium. This study sought to identify the skills that need to be taught in an associate degree program for office information systems. Specifically, the researcher sought to determine the importance of skills needed by office information systems/ administration graduates with implications for curricular revision. One hundred and fifty-seven members of the International Association of Administrative Professionals in the states of Louisiana, Mississippi, and East Texas including the Houston, Texas area participated in this study. Aerenchyma - a specialized tissue with abundant, interconnected gas spaces - facilitates oxygen transport from shoots to roots in many emergent wetland plants. The importance of oxygen transport to root elongation and aerenchyma development in rice (Oryza sativa L.) seedlings was demonstrated in this investigation. Germinated seeds of Lemont (a commercial cultivar) and red rice (an agricultural weed) were positioned at 4.5, 2.5, or 1.0 cm below the surface of aerated or hypoxic water to control the duration of leaf submergence and the availability of oxygen. This dissertation is a historical anthropogeography that focuses on the city of Rockland, Maine from its prehistoric beginnings to the present. Throughout the historic period, a series of single industries have dominated Rockland's economy while its population has remained remarkably stable. Lime production, for mortar and plaster, was first, beginning with the earliest Europeans in the area in the eighteenth century and coming to its end in the 1930s. Shipping and shipbuilding were important outgrowths of the lime industry but shipbuilding ended by the early 1920s with the change from wood to steel as the favored material for shipbuilding. The geometric, topological, and symplectic properties of moduli spaces (spaces of configurations modulo rotations and translations) of polygonal linkages have been studied by Kapovich, Millson, and Kamiyama, et. al. One can form a polygonal linkage by taking two free linkages and identifying initial and terminal vertices. This can be generalized so that one takes three free linkages and identifies initial and terminal vertices. Then one obtains a linkage which contains multiple polygons, any two of which have shared edges. The geometric and topological properties of moduli spaces of these multi-polygonal linkages are studied. These spaces turn out to be compact …
