Toward A Multiple Party Representation Model: Moderating Power Disparity, Henry Ordower Jan 2003

Toward A Multiple Party Representation Model: Moderating Power Disparity, Henry Ordower

All Faculty Scholarship

Argues that the zealous representation model of contemporary legal practice with its emphasis on primacy of the client causes lawyers to assist and motivate their clients to exploit the clients' power advantages in non-litigation contexts. The article recommends that ethical rules shift to a multiple client representation model. The model would be based upon the Brandeisian "lawyer for the situation" and would empower attorneys in non-litigation settings to consider and evaluate the impact of their activities on other constituencies that the representation affects. Attorneys would become better able to encourage their clients to seek distributional fairness and balance in their …

The American Worker: Junior Partner In Success And Senior Partner In Failure, Charles B. Craver Jan 2003

The American Worker: Junior Partner In Success And Senior Partner In Failure, Charles B. Craver

GW Law Faculty Publications & Other Works

This article explores the degree to which American workers are treated like second-class parties by corporate leaders. When business firms do well, share holders and managers obtain significant financial gains, but rank-and-file workers do not usually share in those gains. On the other hand, when firms do poorly, thousands of employees are laid off, while managers obtain bonuses for their forthright actions designed to curtail labor costs. These developments correspond directly to the decline of labor organizations in the United States. When unions represented 35 percent of private sector workers in the late 1950s and 1960s, wages and benefits were …

The Sarbanes-Oxley Yawn: Heavy Rhetoric, Light Reform (And It Might Just Work), Lawrence A. Cunningham Jan 2003

The Sarbanes-Oxley Yawn: Heavy Rhetoric, Light Reform (And It Might Just Work), Lawrence A. Cunningham

GW Law Faculty Publications & Other Works

A thorough examination of the much ballyhooed Sarbanes-Oxley Act reveals dominantly a federal codification of extant rules, regulations, practices, and norms. Despite advertising it as "the most far-reaching reforms of American business practices since the time of FDR," a soberly apolitical view sees the Act as more sweep than reform. Important are provisions calling for nine studies; redundant but much publicized were the certification requirements imposed during the summer of 2002; other moves are mere patchwork responses to precise transgressions present in the popularized scandals. The Act is far from trivial, however. A silver bullet relates to the structure and …

Caves And Karsts Of Northeast Africa, William R. Halliday Jan 2003

Caves And Karsts Of Northeast Africa, William R. Halliday

International Journal of Speleology

At least potentially karstifiable rocks cover much of the surface of Egypt and northern Libya. Study of caves and other karstic features of this region has been hampered by lack of roads, rapid disintegration of the surface of friable, poorly consolidated limestone, wind-blown sand and other factors. Interbedding with marly aquicludes hampers speleogenesis locally. Calcareous and evaporite karsts are present, however, and their waters are important albeit generally limited resources. Large quantities of fresh water are lost through submarine springs downslope from Libya’s Gebel al Akhdar range; the caves and karst of that range may be among the world’s greatest. …

Caught In The Crossfire: A Defense Of The Cultural Theory Of Gun-Risk Perceptions, Donald Braman, Dan M. Kahan Jan 2003

Caught In The Crossfire: A Defense Of The Cultural Theory Of Gun-Risk Perceptions, Donald Braman, Dan M. Kahan

GW Law Faculty Publications & Other Works

In this article, Dan Kahan and Donald Braman expand upon the cultural theory of gun-risk perception and respond to the commentaries on their previous article, More Statistics, Less Persuasion: A Cultural Theory of Gun-Risk Perceptions, 151 U. Pa. L. Rev. 1291 (2003). Their critics argue that the authors are too quick to dismiss the power of empirical information to influence individuals’ positions on gun control. But in analyzing the variety of their critics’ arguments, Kahan and Braman note the strange pattern of opinions that has emerged on the relative importance of culture and data in the gun debate. What could …

Implementing Constitutional Rights For Juveniles: The Parent-Child Privilege In Context, Catherine J. Ross Jan 2003

Implementing Constitutional Rights For Juveniles: The Parent-Child Privilege In Context, Catherine J. Ross

GW Law Faculty Publications & Other Works

This article advocates for the creation of a parent-child privilege by focusing on the parental contribution to raising their children. The article argues that children cannot fully exercise their constitutional rights without being able to confide freely in their parents and consult them before waiving rights and while working with their attorneys. I begin by describing the current state of privilege law and suggest that there is already a “de facto” tendency to observe a parent-child privilege. I show that courts have failed to distinguish among three distinctive kinds of confidences: (1) testimony concerning confidences from a minor child to …

Foreword: The Administrative Law Of The European Union, Francesca Bignami

GW Law Faculty Publications & Other Works

This special issue of Law and Contemporary Problems is devoted to the administrative law of the European Union. The foreword sets the stage by narrating the history of legal scholarship on European administration, explaining the public law methodology of the contributors, and describing the different legal styles that separate the civil from the common law traditions and that mark the contributions. The foreword then previews the individual articles, organized by the law of centralized or “direct” administration by the European Commission and the law of decentralized or “mixed” administration, in which national civil servants interact with their counterparts elsewhere and …

The Design Of A Professional Development Program To Train Reading Teachers To Coach Content Area Teachers, Cara Richardson

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to investigate and provide middle school content-area teachers with ongoing support in an effort to foster reading across the curriculum. Mathematics, science, social studies, and language arts teachers participated in a mandatory content area literacy training where they were provided with research-based reading strategies to implement into their classrooms. The requirement to implement these new strategies into their daily instruction seemed overwhelming, which led to reluctance and frustration among many of the teachers.

The development methodology was used to develop the product utilizing a formative and a summative committee. The formative committee gathered data that …

Development Of A Fee-Based Service Delivery Model For The Department Of Career Services At The University Of Connecticut, Cynthia F. Jones

Abraham S. Fischler College of Education ETD Archive

This applied dissertation project provided a partial solution to the problem of reduced state government budget support for the Department of Career Services at the University of Connecticut. A reduction in fiscal resources will hinder the operation of the Department of Career Services at the University of Connecticut and prevent the department from providing adequate career development services to help students reach career goals. The creation of a model for fee-based service delivery to users, using a development methodology, was the product of this project.

The research questions addressed and answered in this project explored following issues related to developing …

Creating A New Reporting System For Effective Communication Between The School And The Home, Dennet John Sidell Jan 2003

Creating A New Reporting System For Effective Communication Between The School And The Home, Dennet John Sidell

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to create and use a new reporting system that would better communicate with parents how their child was performing in school. The system used before the implementation was fragmented (each grade used a different reporting system), outdated (not complementing what was happening in the classroom), used confusing codes (parents not receiving a clear message), and unreliable (teachers used the reporting systems for different purposes). The new reporting system would have a common purpose, be consistent in format between grades, and use vocabulary that was clear and easy to understand.

Three solution strategies were incorporated into …

Developing And Using A Welfare Reform Model Of Social Work To Increase The Role Of Social Workers In Assisting Welfare Customers To Self-Sufficiency Through Employment, Jessie Jordan-Parker

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to increase and enhance the role of the Welfare Social Workers in providing case management services to Welfare customers. Welfare Reform (WR) Social Work positions were being eliminated because some thought that traditional social work models could not be adapted to the requirements of employment centered WR programs. This was thought because no research had been carried out and no data was available to indicate the efficacy of social workers or social work models in assisting those welfare customers to self-sufficiency through employment.

The writer developed a WR model of social work intervention. The model …

The amount of student-reported harassment was greater in the freshman and sophomore years and diminished in the junior and senior years. A survey taken in October 2002 for the New England Association of Schools and Colleges’ self-study indicated that 90% of the 138 respondents do not feel respected …
