Viewpoint: Fostering Dialogue And Interreligious Conversation, Deepak Sarma Jan 2003

Viewpoint: Fostering Dialogue And Interreligious Conversation, Deepak Sarma

Journal of Hindu-Christian Studies

Since seeing Santosh Sivan's film, "The Terrorist," a few days ago, I have been unable to rid my mind of the haunting images of Malli, a troubled young woman who has been chosen for a mission as a suicide bomber. In this fictional account, Sivan successfully reveals that she is not merely a brainwashed fanatic but that she is as human as anyone else, despite the fact that she is planning a despicable act, the assassination of an important politician. She has fears, hopes, loves, and disappointments and is not simply an unfeeling automaton. By illustrating quite clearly her zeal …

Cross-Shelf Habitat Utilization Patterns Of Reef Fishes In Southwestern Puerto Rico, John D. Christensen, Christopher F.G. Jeffrey, Chris Caldow, Mark E. Monaco, Matthew S. Kendall, Richard S. Appeldoorn

Gulf and Caribbean Research

In June 2000, the National Ocean Service and University of Puerto Rico initiated a long-term reef-fish-monitoring program in La Parguera, Puerto Rico. Objectives of this ongoing work are to: 1) develop spatially-explicit estimates of reef fish habitat utilization patterns to aid in defining essential habitats, and 2) provide a quantitative and ecologically sound foundation to delineate marine reserve boundaries. Central to this effort are recently completed digital and georeferenced benthic habitat maps for the near-shore waters of Puerto Rico. The GIS-based map served as a framework for development of a spatially stratified reef-fish-monitoring program across the shelf. Simultaneous collections of …

Spawning Aggregation Sites Of Snapper And Grouper Species (Lutjanidae And Serranidae) On The Insular Shelf Of Cuba, Rodolfo Claro, Kenyon C. Lindeman Jan 2003

Spawning Aggregation Sites Of Snapper And Grouper Species (Lutjanidae And Serranidae) On The Insular Shelf Of Cuba, Rodolfo Claro, Kenyon C. Lindeman

Gulf and Caribbean Research

Twenty-one spawning aggregation sites on the Cuban shelf were identified for eight species of snappers (Lutjanus) and groupers (Epinephelus and Mycteroperca) using information from experienced fishers and field studies. Three sites are on the southeastern shelf, eight on the southwest shelf bordering the Golfo de Batabanó, two in the northwest, and eight in the north-central region along the margins of the Archipiélago de Sabana-Camagüey. These numbers may reflect sampling effort as much as absolute aggregation numbers, with most effort concentrated in the southwest and north-central regions. Additional studies, particularly field assessments, are needed to determine the …

Community-Based Development Of Multiple-Use Marine Protected Areas: Promoting Stewardship And Sharing Responsibility For Conservation In The San Andres Archipelago, Colombia, Marion Howard, Ernesto Connolly, Elizabeth Taylor, June Marie Mow

Gulf and Caribbean Research

The San Andres Archipelago in the western Caribbean includes some of the largest and most productive coral reef ecosystems in the hemisphere. Declared the Seaflower Biosphere Reserve by UNESCO in 2000, this Colombian archipelago has 3 inhabited islands, 5 atolls, and an oceanic area of 300,000 km2. CORALINA, the local representative of the National Environment System, is responsible for environmental planning, management, and education. While setting up the Seaflower Biosphere Reserve, this agency had hundreds of meetings with the islands’ communities, listening to their concerns. Issues, conflicts, and threats to marine and coastal areas were identified during these …

It's All In The Rhetoric: Using Affective Design To Change Users' Perceptions Of Online Help, Robert C. Stultz

Retrospective Theses and Dissertations

This thesis investigates the role of affective design in online help systems. The thesis begins with a discussion of the current research related to online help systems and the rhetorical nature of technical communication. The thesis then provides a heuristic evaluation of two versions of procedural discourse for Microsoft Word 2000. Based on an analysis of the heuristic evaluation, five recommendations are given for improving the affective design of online help systems. The thesis concludes with a proposed usability test and consideration of a related area of study.

Business, The Arts & The Role Of The Copyright Act, Keith C. Hauprich Jan 2003

Business, The Arts & The Role Of The Copyright Act, Keith C. Hauprich

Vanderbilt Journal of Entertainment & Technology Law

Two recent court decisions examined, addressed, and adjudicated parallel issues potentially determining the scope of rights of legions of recording artists and freelance authors. While the core of each case centered on the fact that the agreements between each of the respective litigants did not expressly grant (or reserve) the exercise of the particular rights in dispute, the decisions of the courts have seemingly antithetical results. A review of each court's application of the governing law to the disparate facts of each case presents an interesting illustration of the relationship among business, the arts, and the role of the Copyright …

Almost Famous: Reality Television Participants As Limited-Purpose Public Figures, Darby Green Jan 2003

Almost Famous: Reality Television Participants As Limited-Purpose Public Figures, Darby Green

Vanderbilt Journal of Entertainment & Technology Law

This Note begins with an overview of the basic facets of privacy law, focusing on the tort of the public disclosure of private facts and its interaction with the First Amendment. Next, this Note explores the differences in rules for public, private, and involuntary public figures. The law of defamation is offered as a model for privacy law to emulate, specifically, the limited-purpose public figure created under Gertz and its progeny. Then, the issue of whether one's status as a public figure may diminish over the passage of time is considered. This Note posits that limited-purpose public figures should exist …

Long Overdue? An Exploration Of The Status And Merit Of A General Public Performance Right In Sound Recordings, Matthew S. Delnero Jan 2003

Long Overdue? An Exploration Of The Status And Merit Of A General Public Performance Right In Sound Recordings, Matthew S. Delnero

Vanderbilt Journal of Entertainment & Technology Law

In the sound recording performance rights debate, positions advocated by broadcasters are the polar opposite of those taken by recording artists and labels. Considering all the factors, it is likely that neither claim is entirely meritorious. Both are too extreme to be supported by available evidence. Radio broadcasters ignore what would amount to at least some international harmonization and added foreign royalties, as well as the potential creation of new works that would not be economically viable without a performance royalty. Furthermore, broadcasters fail to adequately account for the possible inequity of granting performance royalties to those who compose music …

Idea Men Should Be Able To Enforce Their Contractual Rights: Considerations Rejecting Preemption Of Idea-Submission Contract Claims, Celine Michaud, Gregory Tulquois Jan 2003

Idea Men Should Be Able To Enforce Their Contractual Rights: Considerations Rejecting Preemption Of Idea-Submission Contract Claims, Celine Michaud, Gregory Tulquois

Vanderbilt Journal of Entertainment & Technology Law

It is a long-standing and general rule that ideas are "free as the air" as Justice Brandeis eloquently stated in the dissent to the seminal case International News Service v. Associated Press.' This axiom of copyright law expresses the idea that copyright does not protect ideas but only protects the expression of ideas in a work. The distinction between unprotected ideas and protected expression is often referred to as the idea-expression dichotomy...

The principle of the idea-expression dichotomy was initially stated in Baker v. Selden, and later cases further articulated this principle, so that it has become one of the …

New Social Movements And The Struggle For Worker’S Rights In The Maquila Industry, Victoria Carty Jan 2003

New Social Movements And The Struggle For Worker’S Rights In The Maquila Industry, Victoria Carty

Sociology Faculty Articles and Research

"Campaigns to improve worker’s rights in export processing zones (EPZs), also referred to the maquila industry in Latin America, is an important topic analytically and politically. On theoretical and practical levels, the co-existence of market economies with effective means to ensure adequate working conditions for workers is a critical question. Underlying the issue is a vigorous debate regarding how the global economy should be governed; who or what should govern it, and whose interest is should serve (Faux, 2002)."

Letters And Postcards We Wished We Had Sent To Gary Bellow And Bea Moulton, Marilyn Berger, John Mitchell, Annette Clark Jan 2003

Letters And Postcards We Wished We Had Sent To Gary Bellow And Bea Moulton, Marilyn Berger, John Mitchell, Annette Clark

Faculty Articles

To celebrate the 25th anniversary of the publication of Gary Bellow's and Bea Moulton's The Lawyering Process, this essay consists of eleven letters and postcards about how The Lawyering Process inspired the writing of the authors’ books - Pretrial Advocacy: Planning, Analysis & Strategy and Trial Advocacy: Planning, Analysis & Strategy. Alas, this correspondence is imaginary because that exchange of ideas did not take place. This method was inspired by the medieval letters of Abelard and Heloise and the modern-day fictional postcards and letters of Griffin and Sabine. Tracing the evolution of their thoughts from first reading the Bellow and …

Risk Avoidance, Cultural Discrimination, And Environmental Justice For Indigenous Peoples, Catherine O'Neill Jan 2003

Risk Avoidance, Cultural Discrimination, And Environmental Justice For Indigenous Peoples, Catherine O'Neill

Faculty Articles

This article begins with the recognition that environmental justice for Native peoples requires attention to the interrelated cultural, spiritual, social, ecological, economic, and political dimensions of environmental issues. It observes, moreover, that “environmental justice requires an appreciation of each tribe’s particular historical circumstances and contemporary understandings, including each group’s aspirations for the flourishing of its culture.” It contends that some environmental decision makers and commentators have increasingly come to embrace “risk avoidance” – strategies that call upon risk-bearers to alter their practices in order to avoid the risk of environmental harms – in lieu of risk reduction – strategies that …

“Soldiering On In Hope”: United Nations Peacekeeping In Civil Wars, Anna Roberts

This note will examine the consequences of the Security Council’s decisions to deploy under-resourced operations to civil war situations and various proposed means by which the Security Council might more effectively fulfill its responsibilities. Part II will look at a number of post-Cold War U.N. operations in civil wars—UNPROFOR in Croatia and Bosnia, United Nations Operation in Somalia I (UNOSOM I), United Nations Assistance Mission for Rwanda II (UNAMIR II), and United Nations Mission in Sierra Leone (UNAMSIL)—and show how, at least partly because of the Security Council’s failure to ensure that the operations it authorized were provided with sufficient …
