Keeping The Citizenry Informed: Early Congressional Printing And 21st Century Information Policy, Aimée C. Quinn Jan 2003

Keeping The Citizenry Informed: Early Congressional Printing And 21st Century Information Policy, Aimée C. Quinn

Library Scholarship

Although the electronic revolution in publishing fostered a new Information Age, the need for government documents in tangible format continues. This paper examines the historical roots of congressional printing compared to 21st century challenges to information policy. The author argues that the founding fathers intentionally did not include language mandating the printing of government information, aside from the Journal as described in the Constitution, for the simple reason that they viewed it as an inherent obligation on the part of all elected officials. As such, restrictive information policies, such as the U.S.A. Patriot Act, impinge upon the original intent of …

Trade, Democracy, And The Ftaa: Public Access To The Process Of Constructing A Free Trade Area Of The Americas, Eric Dannenmaier Jan 2003

Trade, Democracy, And The Ftaa: Public Access To The Process Of Constructing A Free Trade Area Of The Americas, Eric Dannenmaier

Fordham International Law Journal

The Article concentrates on access for non-profit or "public interest" elements of civil society rather than for-profit business interests, because public interest organizations have been more marginalized from the FTAA, and their interests are more diffuse and conflicting - rendering their integration more problematic. It also concentrates on the multilateral process in the context of Ministerial meetings rather than trade policymaking at a national level because of the symbolic value attached to meetings of ministers, and the unique opportunities for public dialogue offered by these high-level meetings.

The Just War Ethic In International Law, Joseph C. Sweeney Jan 2003

The Just War Ethic In International Law, Joseph C. Sweeney

Fordham International Law Journal

To the student and practitioner of international law in the twenty-first century, the just war ethic is clearly part of Moral Theology--binding the consciences of ethical people everywhere --but it is not part of international law. Nevertheless, there is today a lingering flavor of the Just War Ethic in debates about issues that are partly moral and partly political, such as: 1. the testing and use of nuclear weapons; 2. combating terrorism; and 3. humanitarian intervention to save lives and the human environment. None of these activities is authorized expressly in the United Nations Charter. What is an unjust war …

Capital Punishment And Martial Law In Ireland, 1916-1923, Thomas Michael Taff Jan 2003

Capital Punishment And Martial Law In Ireland, 1916-1923, Thomas Michael Taff

Honors Theses

My thesis, “Capital Punishment and Martial Law in Ireland 1916-1923”, deals with the early years of the Irish Dominion. After the ratification of a peace treaty in December of 1921 between Great Britain and Ireland, the lower twenty-six counties of Ireland became a Dominion of the British Empire. The following summer a civil war occurred between the armed forces in Ireland who supported and rejected the treaty. During the Irish civil war, which lasted from June 1922 until April 1923, nearly eighty IRA men were executed by the Pro-Treaty government in Dublin. My thesis looks into the legal and political …

Understanding Statutory Bundles: Does The Sherman Act Come With The 1996 Telecommunications Act?, Randal C. Picker Jan 2003

Understanding Statutory Bundles: Does The Sherman Act Come With The 1996 Telecommunications Act?, Randal C. Picker

Coase-Sandor Institute for Law & Economics Research Paper Series

Three recent appellate decisions—Goldwasser, Trinko and Covad—have addressed the interplay of the 1996 Telecommunications Act and the antitrust laws. This area raises questions of both substantive law and standing. This essay focuses on standing and in particular the question of how the antitrust doctrine in Illinois Brick should apply to situations in which there is an alleged breach of an access duty owed by an incumbent local exchange carrier. That access duty might arise under the 1996 Act itself or under applicable antitrust doctrines, such as the essential facilities doctrine or the duty to deal with competitors seen in Aspen …

A Computational Approach To Arteriolar Bifurcations: Evaluation Of Factors Influencing Predicted Wall Shear Stress, Charles Robinson Jan 2003

A Computational Approach To Arteriolar Bifurcations: Evaluation Of Factors Influencing Predicted Wall Shear Stress, Charles Robinson

Theses

Recent studies of blood flow regulation at the microcirculatory level have linked the physical characteristics of the arteriolar bifurcations and the physiology of the flow through them to the autoregulatory mechanisms exhibited by the endothelial cell lining. Research in this area is decomposed to the following two components: understanding the biochemical activity that takes place at the cellular level as a result of flow-induced stimulation and characterizing the physical flow behavior causing the stimulation. The following study develops the currently accepted method of characterizing the physical flow behavior, in the form of wall shear stress, through computational analysis. The goal …

A Different Place: Student Learning In An Online Course, Susan Jane Mannan

All-Inclusive List of Electronic Theses and Dissertations

The purpose of this qualitative study was to explore and describe the learning experience of students in two online courses at a multi-campus, two-year technical/community college in the Midwest. During the spring, 2002 semester, the researcher gathered data from students and instructors in a technical writing and a nutrition online course through online observations, face-to-face interviews, time logs, reflective e-mail journals, surveys, and analysis of archival material. The study describes the experiences of a …

Characterization Of Inflammation In Tendinitis And Application Of Electromagnetic Fields, Brittany Jayne Wetzel Jan 2003

Characterization Of Inflammation In Tendinitis And Application Of Electromagnetic Fields, Brittany Jayne Wetzel

All-Inclusive List of Electronic Theses and Dissertations

Tendinitis is a disorder caused by inflammation of the tendon fibers, characterized by collagen fiber disruption and cellular infiltration. Current treatments are lacking, in that they often are associated with unwanted side effects or can even cause an increased amount of damage via scar tissue formation. Pulsed electromagnetic fields (PEMFs) have been shown to be useful in treating wounds and healing non-union fractures. The purpose of the current study was to develop a quantitative rat model of mild tendinitis and subsequently to examine the efficacy of therapeutic electromagnetic fields (EMFs) on this injury. The EMFs used in the current study …

Identifying Factors That Contribute To The Performance Of Campus -Level Boards In A Multicampus System, Daniel L. Schenk Jan 2003

Identifying Factors That Contribute To The Performance Of Campus -Level Boards In A Multicampus System, Daniel L. Schenk

All-Inclusive List of Electronic Theses and Dissertations

Limited research exists on assessing the performance of campus-level boards involved in the governance of campuses within multicampus systems. The purpose of this mixed-method study was to identify factors that contribute to the performance of campus-level boards. The study included 13 campus-level boards that served the Ivy Tech State College multicampus system. Seventy of the 90 trustees appointed to the 13 boards participated in the quantitative element of the study. The Board Self Assessment Questionnaire (BSAQ) developed by Chait, Holland, and Taylor provided data for the quantitative element of the study. Interviews of 10 trustees, purposefully selected from the 70 …
