Bioterrorism Defense: Are State Mandated Compulsory Vaccination Programs An Infringement Upon A Citizen's Constitutional Rights, Brendon Kohrs Jan 2003

Bioterrorism Defense: Are State Mandated Compulsory Vaccination Programs An Infringement Upon A Citizen's Constitutional Rights, Brendon Kohrs

Journal of Law and Health

The agents of anthrax and smallpox threaten the health and welfare of the state citizenry and therefore the state can enact legislation appropriate to offset the possible harm. In order for the enacted legislation to withstand a constitutional challenge, the possible harm has to be a compelling governmental interest of public safety and welfare narrowly tailored to that goal. The purpose of this article is to demonstrate that the United States Department of Health and Human Services has the ability to recommend a compulsory vaccination program for citizens, and this program would not be in violation of a person's constitutional …

Ohio's Patient-Physician Privilege: Whether Planned Parenthood Is A Protected Party, Melissa O'Neill Jan 2003

Ohio's Patient-Physician Privilege: Whether Planned Parenthood Is A Protected Party, Melissa O'Neill

Journal of Law and Health

This article will suggest that under Ohio's patient-physician privilege, the results of pregnancy tests that are administered at Planned Parenthood clinics will not be considered privileged or confidential information, unless the test is administered by a physician and is later used by a physician in treatment of the woman. In particular, this article will briefly examine the history of a right to medical privacy, the development of the patient-physician privilege and the origin of Planned Parenthood . The notion of very intimate details of a person's health, including diseases, conditions, diagnoses and prognoses being readily available to whoever would like …

Do Not Resuscitate Decision-Making: Ohio's Do Not Resuscitate Law Should Be Amended To Include A Mature Minor's Right To Initiate A Dnr Order, Allison Mantz Jan 2003

Do Not Resuscitate Decision-Making: Ohio's Do Not Resuscitate Law Should Be Amended To Include A Mature Minor's Right To Initiate A Dnr Order, Allison Mantz

Journal of Law and Health

Part One discusses Ohio's current DNR (Do Not Resuscitate) law, which does not include an exception for mature minors. It explains the medical difference between initiating a valid DNR order and refusing life-sustaining medical treatment. However, the note solely focuses on DNR and how it relates to a minor's right to initiate his or her own DNR order in light of parental disagreement. Part two explains the evolution of the minor and healthcare. Specifically, the progression from the early common law assumption that minors lack the capacity to consent, to the present, in which minors are permitted to make some …

To Preempt Or Not To Preempt: Hmo Liability Pre And Post Pegram V. Herdrich , Adam D. Glassman

Journal of Law and Health

Should consumers have the right to sue their HMOs (health maintenance organizations) for the way they deliver medical care? In recent years, the federal courts have focused their attention upon, inter alia, the issue of whether HMOs have a duty to reveal financial incentive provisions contained in contracts between the HMO plan physicians to plan members and beneficiaries under a health plan. In fact, on June 12, 2000, the United States Supreme Court, in Pegram v. Herdrich, pondered whether HMO physicians and administrators are fiduciaries under the Employee Retirement Income Security Act (ERISA), and if so, must they exercise their …

Dramatic Relocation: The Time And Place For Shakespeare On Film, Lydia Lunning Jan 2003

Dramatic Relocation: The Time And Place For Shakespeare On Film, Lydia Lunning

Honors Papers

"Doing Shakespeare is simply harder than anything else," Colm Feore says to his interviewer, while apparently on break from rehearsing his role as Marcus Andronicus before principal photography begins for Julie Taymor's film, Titus (1999). "It's harder than Chekov, it's harder than Moliere, it's harder than Racine, it's harder than .. . anything!" ("The Making of Titus," DVD Special Features). The team involved in Michael Almereyda's Hamlet (2000) as well as that of Richard Loncraine's Richard III (1995) didn't have it any easier. By all accounts of each filmmaking process, none of the films to be discussed here had the …

The Responsibility To Protect: A Beaver Without A Dam Review Of The Responsibility To Protect: Reprot Of The International Commission On Intervention And State Sovereignty, Jeremy I. Levitt

Journal Publications

The beaver's dam is comparable to protective intervention for at-risk populations.' Beavers need dams to enlarge the underwater habitat that will be open to them in winter, by creating a pond deep enough so that the bottom will not freeze. Humanitarian corridors and safe havens serve parallel functions for displaced civilians during times of conflict. Deep water, whether it is due to a beaver dam or not, provides storage for winter food and year-round underwater access to the den secure from predators. The shelter and safety deep water provides can be likened to the physical protection needed to safeguard civilians …

Problem Behavior Theory In An Ethnically Diverse Female Prison Sample, Kristen J. Quinlan Jan 2003

Problem Behavior Theory In An Ethnically Diverse Female Prison Sample, Kristen J. Quinlan

Open Access Master's Theses

Research on female inmates has shown that this population engages in a variety of risky behaviors, like alcohol abuse, drug abuse, and risky sexual activities, and that these problem behaviors seem to share high positive intercorrelations. Problem Behavior Theory (PBT) explains these positive intercorrelations by viewing problem behaviors like alcohol abuse, drug abuse, and risky sexual activities as a single factor, or a single behavioral syndrome. Although the presence of this syndrome has been demonstrated in a variety of ethnically diverse adolescent samples, little work has been done to evaluate its presence in a sample of adults. Adult female inmantes …

Spirituality And The Quality Of Life: Relationships Between Existential Well-Being And Aspectgs Of Life Functioning, Bettina Brigit Höppner Jan 2003

Spirituality And The Quality Of Life: Relationships Between Existential Well-Being And Aspectgs Of Life Functioning, Bettina Brigit Höppner

Open Access Master's Theses

The focus of this thesis is the role of spirituality within the quality of life. This role is explored in a macro-level approach by investigating the overall relationships between existential well-being, of which spirituality is seen as a part of, and life functioning. This macro-level investigation is then followed by a more detailed, variable specific micro-level delineation of relationships.

Recognizing the fact that spirituality cannot be discussed without an implicit reference to the overall concept of religion, the connections between spirituality and religion is explicitly discussed, although this connection is not the focus of this study. Thus, by way of …

International Regulation Of Underwater Sound: Establishing Rules And Standards To Address Ocean Noise Pollution, Elena Marie Mccarthy Jan 2003

International Regulation Of Underwater Sound: Establishing Rules And Standards To Address Ocean Noise Pollution, Elena Marie Mccarthy

Open Access Dissertations

An increasing awareness of anthropogenic sound in the ocean has generated international concern that it is affecting marine mammal behavior and could affect entire marine ecosystems as well. Presently there is a lack of a coherent policy framework for evaluating the environmental impacts of underwater noise pollution. No international treaties or laws specifically address the transmission of sound in waters under national jurisdiction or on the high seas. This dissertation examines the issue of underwater noise pollution in a global context and considers the extent to which the international legal and environmental community has addressed it. The sharp increase in …

Understanding Prehistoric Ceramic Technology From The Grand River Valley, Jeff Chivis Jan 2003

Understanding Prehistoric Ceramic Technology From The Grand River Valley, Jeff Chivis

McNair Scholars Journal

This research focused on understanding the production process of ceramic construction (technological choices of potters) during the Woodland Period in western Michigan. This ultimately provided information regarding choices not only pertaining to style but also to material choices and firing strategies of early societies. The research involved the replication of pottery sherds, which were then compared to a sample of Early Woodland, Middle Woodland, and Late Woodland sherds from sites in the Grand River valley by using petrographic analysis. These sherds were extracted from the Prison Farm (20IA58), Norton Mounds (20KT1), Spoonville (20OT1), and the Converse Mounds sites (20KT2). Technological …
