United States Citizens Detained As "Enemy Combatants": The Right To Counsel As A Matter Of Ethics, Jesselyn A. Radack

William & Mary Bill of Rights Journal

The Supreme Court will decide as a matter of law whether an American citizen detained as an enemy combatant has the right to counsel. The author argues that as a matter of ethics, the answer is clear - there is a right to counsel. In this Article, the author analyzes the cases regarding Jose Padilla and Yaser Esam Hamdi discusses ABA Model Rule 4.2, and its application, and proposes an amendment to Rule 4.2's Comment.

Ischemic heart disease is the leading cause of mortality and morbidity in Western societies. Thus, understanding the molecular mechanisms to reduce myocardial ischemia and limit infarction size are of great importance. Ample evidence has shown that protein kinase C epsilon (PKCepsilon) play an essential role in the genesis of cardioprotection. In particular, our laboratory has shown that activation of PKCepsilon in the heart is sufficient to significantly reduce myocardial infarction due to coronary artery occlusion. However, the molecular mechanism responsible for PKCepsilon-induced cardioprotection remain unclear. Recently, functional proteomic analysis have demonstrated that PKCepsilon forms signaling complexes with various of proteins, …

Oxygen is critical to aerobic metabolism, but hyperoxia is cytostatic and cytocidal. The precise mechanisms involved in hyperoxic cell injury remain incompletely understood although there is substantial support for the possibility that hyperoxia increases the 'leak' of electrons from the mitochondrial electron transport chain and the resulting increased generation of reactive oxygen species (ROS) might explain the toxic effects of high oxygen. To evaluate the possible role of mitochondria in oxygen toxicity, we used cloned HeLa cells having no functional mitochondria (?° cells) as a model. Na,K-ATPase is essential for the regulation of cytoplasmic Na+ and K+ levels in lens cells. Insufficient Na,K-ATPase activity is associated with cataract formation. Based on earlier studies in which Src-tyrosine kinase inhibitors were found to suppress Na,K-ATPase activity changes that occur in response to either thrombin, endothelin, or dopamine, I hypothesize that regulation of Na,K-ATPase activity might occur through phosphorylation of the Na,K-ATPase a1 (catalytic) subunit by Src-family tyrosine kinases. Here, I tested the influence of Src-kinase family members on tyrosine phosphorylation and Na,K-ATPase activity in membrane material isolated from porcine lens epithelium. Age, Growth And The Annual Cycles Of Lipogenesis And Reproduction Of Acanthurus Bahianus In Southeastern Florida, Stacy M. Wolfe

The ocean surgeon, Acanthurus bahianus, is a coral reef fish inhabiting the tropical and subtropical waters of the western Atlantic, including southeastern Florida. This study was a 23-month analysis of the reproductive cycle correlated with the annual build up and depletion of fat reserves in the fish. In addition, an age and growth analysis of this species was conducted. A total of 507 fish were analyzed for length, weight, gonad weight and fat body weight. 478 were aged by microscopic examination of the transverse section of the sagittae otolith. Another Sandhill Crane Breeding Record In The Eastern Rainwater Basin, Joel G. Jorgensen

Nebraska Bird Review

Jorgensen (2002) recently summarized breeding-season occurrences of the Sandhill Crane (Grus canadensis) in the Eastern Rainwater Basin (eRWB). Summering birds were first detected in 1992 (The Nebraska Bird Review 60: 145). Breeding first occurred in 1994 with four additional nesting or breeding records in subsequent years. The most recent breeding records were in 1999 when breeding activity was detected at both Kissinger Basin Wildlife Management Area (WMA) (Hoffman 1999) and Harvard Waterfowl Production Area (WPA) (Silcock and Jorgensen 1999), both in Clay County. On 21 July 2003, I was mapping wetland vegetation on Funk Waterfowl Production Area (WPA), Phelps County, when I encountered two adult Black-necked Stilts and two young on the Teal Unit, NE 1/4 of Section 16, T-6-N, R-17-W. I was using an airboat to map pockets of open water throughout the WPA. When I launched the airboat on the Teal Unit, I immediately noticed an adult Black-necked Stilt flying above the small pool. While driving the perimeter of this pool, I noticed two adult Black-necked Stilts continually flying over a small point of cattails surrounded by shallow water. As I …

Forty-one NOU members and friends gathered at the 4-H Camp at Halsey in the Nebraska National Forest on September 26–28, 2003, for the annual Fall Field Days. Fall colors were beautiful and the weather was generally good except for a brisk wind on Friday and Saturday. The ongoing drought was evident in the low level of lakes and ponds, with some of the smaller bodies of water being completely dry.

There has been extensive, research in the Monteverde area that has shown that both the abundance and range of lizards, amphibians, and birds have been affected global warming (Pounds (1999). Although there have been studies showing changes in abundance of arctic and temperate invertebrates, there have not been any studies that have shown invertebrate response to climate change in Monteverde. The four species of Azteca ants (xanthochroa, constructor, coeruleipennis, and alfari) were collected along roads in Monteverde and nearby Santa Elena and San Luis at elevations ranging from 700-1500m. Monteverde Institute: Tropical Ecology and Conservation

The intraspecific distributions of microhabitats in territorial lizard species is determined largely by differing behavior among sexes and age classes. In this project I study a population of Norops oxylophus along the Río Alondra of the San Luis Valley towards the end of the rainy season. I caught individuals, recording their age, sex, size, perch substrate and location, and escape method. I found that adult males prefer to be perched on live tree branches overhanging the water; the larger the individual, the higher he is above the stream. Juveniles are found to inhabit lower areas along the stream banks. Males …

The purpose of this study was to determine the community composition, S, H, E, N, and Smarg of arthropods living in epiphytic moss mats on vertical gradients, in the elfin forest of Monteverde, Costa Rica. Past studies have shown that moss mats alter biotic factors of the surrounding environment by increasing moisture and decreasing temperature variation. Moss samples were collected from 1 m, 7 m, and 15 m from nine trees between 1725 m and 1800 m and dried using Berlese funnels. Arthropods were separated by order and morphospecies. Assessing The Benefits Of Misting-Cooling Systems For Growing-Finishing Swine In Kentucky As Affected By Environment And Pig Placement Date, Thomas C. Bridges, R. S. Gates, Douglas G. Overhults, Larry W. Turner

Agricultural Engineering Extension Publications

The growth performance of animals is often affected by extreme environmental conditions. In the case of swine, generally a cold environment will increase feed intake as the pig strives to maintain body temperature, while warmer environments may reduce growth, increase body maintenance demands, and subject the animal to environmental stress. Confinement houses are widely used as a primary means of modifying the environment to improve conditions for the growth of swine. Environment in these structures is usually controlled by natural or mechanical ventilation and by insulation for cold climates and limited use of evaporative cooling for summertime conditions.
