Why Relative Economic Position Does Not Matter: A Cost Benenit Analysis, Thomas J. Kniesner, W. Kip Viscusi Oct 2002

Why Relative Economic Position Does Not Matter: A Cost Benenit Analysis, Thomas J. Kniesner, W. Kip Viscusi

Center for Policy Research

The current debate over cost-benefit concerns in agencies’ evaluations of government regulations is not so much whether to consider costs and benefits at all but rather what belongs in the estimated costs and benefits. Overlaid is the long-standing belief that the distribution of costs and benefits needs some consideration in policy evaluations. In a recent article in the University of Chicago Law Review, Robert Frank and Cass Sunstein proposed a relatively simple method for adding distributional concerns to policy evaluation that enlarges the typically constructed estimates of the individual’s willingness to pay for safer jobs or safer products. One might …

A Copernican View Of Health Care Antitrust, William M. Sage, Peter J. Hammer Oct 2002

A Copernican View Of Health Care Antitrust, William M. Sage, Peter J. Hammer

Faculty Scholarship

Sage and Hammer use the analogy of Copernican astronomy to suggest that understanding the dramatic change wrought by managed care requires a conceptual reorientation regarding the meaning of competition in health care and its appropriate legal and regulatory oversight. Both share the belief that misperceiving the world limits potential for technical and social progress.

A Jurisprudential Analysis Of Government Intervention And Prenatal Drug Abuse, Susan Saab Fortney Oct 2002

A Jurisprudential Analysis Of Government Intervention And Prenatal Drug Abuse, Susan Saab Fortney

Faculty Scholarship

This article addresses the serious public health problem of substance abuse among pregnant women. Part I of this article introduces the national problem of prenatal drug abuse. Part II discuses the appropriateness of government intervention. The article explains the medical consequences of prenatal drug abuse, and then, describes the justification of government intervention. The article details both existing criminal law and new legislation regarding prenatal drug abuse. Part III addresses constitutional concerns and the conflict between a woman’s right on the one hand and the state interest and “fetal rights” on the other. Part IV considers the moral and legal …

Fair Use And Market Failure: Sony Revisited, Glynn S. Lunney Jr Oct 2002

Fair Use And Market Failure: Sony Revisited, Glynn S. Lunney Jr

Faculty Scholarship

With the development and dissemination of digital technology, the importance of private copying and its legal status, whether fair or unfair under copyright law, has only increased. Yet, despite its status as the Court's first and only pronouncement on the issue, Sony has played surprisingly little role in this ongoing debate. Even in cases bearing seemingly close similarity to the home-taping at issue in Sony itself, such as the private, home copying of musical works, courts have refused to follow Sony's fair use outcome. Having been narrowly construed as an exceptional instance of market failure, Sony seldom appears to …

Stochastic 2-D Navier-Stokes Equation, J. L. Menaldi, S. S. Sritharan Oct 2002

Stochastic 2-D Navier-Stokes Equation, J. L. Menaldi, S. S. Sritharan

Mathematics Faculty Research Publications

In this paper we prove the existence and uniqueness of strong solutions for the stochastic Navier-Stokes equation in bounded and unbounded domains. These solutions are stochastic analogs of the classical Lions-Prodi solutions to the deterministic Navier-Stokes equation. Local monotonicity of the nonlinearity is exploited to obtain the solutions in a given probability space and this signi cantly improves the earlier techniques for obtaining strong solutions, which depended on pathwise solutions to the Navier-Stokes martingale problem where the probability space is also obtained as a part of the solution.

Summaries Of Arkansas Cotton Research In Progress In 2001, Derrick M. Oosterhuis Oct 2002

Summaries Of Arkansas Cotton Research In Progress In 2001, Derrick M. Oosterhuis

Arkansas Agricultural Experiment Station Research Series

Cotton yields in Arkansas increased steadily during the eighties, but in recent years there has been a leveling off. Of more significance, however, is that extreme year-to-year variability in yields has occurred in the last decade, which is a major point of concern with cotton producers. It has been suggested that this may be related to extreme weather conditions during the boll development period in July and August. Average maximum temperatures in the 2001 season were a few degrees above normal. Recent research in Arkansas has indicated that elevated night temperatures during boll development may be a major contributory factor …

Performance Evaluation Of Path Searching Heuristics For Multicast Qos Routing, Daniel Zappala, Dayi Zhou Oct 2002

Performance Evaluation Of Path Searching Heuristics For Multicast Qos Routing, Daniel Zappala, Dayi Zhou

Faculty Publications

Quality of Service routing for multicast enables a group member to find and install a branch of the multicast tree that can meet its QoS constraints. The most promising protocols in this area use receiver-oriented path searching heuristics to find feasible routes. In this paper, we examine the performance of the path searching heuristics used by these protocols, to determine which techniques are the most effective. We find that several low-overhead path searching heuristics are effective, and that generic path searching can work as well as targeted, QoS-specific searching.

The Aminopeptidase From Aeromonas Proteolytica: Structure And Mechanism Of Co-Catalytic Metal Centers Involved In Peptide Hydrolysis, Richard C. Holz Oct 2002

The Aminopeptidase From Aeromonas Proteolytica: Structure And Mechanism Of Co-Catalytic Metal Centers Involved In Peptide Hydrolysis, Richard C. Holz

Chemistry Faculty Research and Publications

Enzymes containing multi-metal active sites are central to numerous biological processes and, consequently, characterization of their structure and function is a problem of outstanding importance. One of the least-explored groups of enzymes is the hydrolases that contain dinuclear metal centers. These enzymes play key roles in carcinogenesis, tissue repair, and protein degradation processes. In addition, some of these enzymes can catalyze the hydrolysis of phosphorus(V) compounds found in nerve gases and agricultural neurotoxins. The determination of detailed reaction mechanisms for these enzymes is required for the design of highly potent, specific inhibitors that can function as potential pharmaceuticals. Hydrolytic enzymes …

Teaching The "Heart And Soul" Of Citizenship: Service-Learning As Citizenship Education, Bernadette Sun Chi Oct 2002

Teaching The "Heart And Soul" Of Citizenship: Service-Learning As Citizenship Education, Bernadette Sun Chi

Thesis, Dissertations, Student Creative Activity, and Scholarship

Troubling trends in political disengagement among young people include decreasing knowledge of and interest in political issues as well as lower rates of voting compared to previous generations. To potentially address this CO~ service-learning has often been promoted in public schools as a means of educating active citizens, among other outcomes.

Despite the expansion of service-learning programs, the relationship between service-learning and citizenship outcomes deserves further study. This dissertation examines the following questions: Do teachers consider "citizenship" an explicit goal for service-learning experiences in K-12 schools? How do teachers and students define what it means to be a "good citizen"? …

Using Managed Care Tools In Traditional Medicare — Should We? Could We?, Robert A. Berenson, Dean M. Harris Oct 2002

Using Managed Care Tools In Traditional Medicare — Should We? Could We?, Robert A. Berenson, Dean M. Harris

Law and Contemporary Problems

Berenson and Harris consider whether the most controversial tools of managed care, including selective contracting, gatekeeping, and prior authorization, should be adopted in the Medicare program. On policy and practical political grounds, they do not recommend selective contracting or gatekeeping. Nevertheless, Medicare should be granted the authority to have preferred providers and case management programs that could treat providers differently and could permit certain beneficiaries to receive additional, off-policy benefits.

The Theory And Practice Of Disclosing Hmo Physician Incentives, Mark A. Hall Oct 2002

The Theory And Practice Of Disclosing Hmo Physician Incentives, Mark A. Hall

Law and Contemporary Problems

Despite the widespread consensus that physician incentives under managed care should be disclosed, there is little agreement on the who, what, when, and how of disclosure, nor is there agreement on the primary purpose of disclosure. Three forms of market failure point to three distinct, but overlapping purposes of disclosure, each of which points toward different forms, sources and contents of disclosures.
