The Supreme Court's recent decision in Zelman v. Simmons-Harris appears to clear the way for a wide variety of educational and charitable choice plans. In this decision, the Court upheld against Establishment Cause Challenge a formally neutral school choice program that encompassed a wide variety of options in the public and private sector, including private sectarian schools. The Court reasoned that, when the government makes aid available to a broad class of recipients without regard to their religious or non-religious affiliation, and when the recipients have a genuine choice as to whether to obtain that aid from a religious or …

Using the Student Characteristics: Iowa Test of Basic Skills (ITBS) composite national percentile scores, repeating fourth grade, spring third grade Developmental Reading Assessment (DRA) scores, socioeconomic status, race, gender, and preschool attendance and the School Characteristics: teacher degree level, teacher experience, teacher professional development, and school Title I status, this study employed a stepwise multiple regression analysis to determine the best predictors of fourth grade scores on the Louisiana Educational Assessment Program for the 21st Century (LEAP 21). Georeferencing images is a laborious process so schemes for automating this process have been under investigation for some time. Among the most promising automatic registration algorithms aare those based on Fast Fourier Transform (FFT). The displacement between the two given images can be computed by computing the ratio F1*conj(F2)/|F1*F2|, and then applying the inverse Fourier transform. The result is an impulse-like function, which is approximately zero everywhere except at the displacement that is necessary to optimally register the images. Coverting from rectangular coordinates to log-polar coordinates, shifts representing rotation and scaling can be also determined to complete the georectification process. …

Research indicates that hundreds of thousands of people are injured each year as a result of poor communication between medical personnel, warning label information, and consumers when taking over the counter or prescription medication. Typically, as adults age, they are increasingly responsible for remembering the hazards of taking medications. If inadequate information exists in memory in regards to side effects, dosage, and other warnings, the likelihood of improper usage will increase. The purpose of this study was to analyze the performance effects of a low and high dose of caffeine on a Bakan cognitive vigilance task. 69 student volunteers participated in the experiment. Participants were randomly distributed among caffeine dosage levels of 0, 20, and 200 mg. The correct response score, which was chosen as the dependent variable, was collected by the vigilance program, however reaction time and false alarm data was also evaluated. These scores were analyzed over time blocks (first, second, third, or fourth ten minute period of the forty minute task). A 3x4 mixed design ANOVA was performed …

Preventing Driving Under The Influence Through Informal Interventions: An Examination Of The Decision Making Processes Common To Potential Dui Offenders, David John Williams

One novel approach to the driving under the influence (DUI) problem is the informal DUI intervention. Informal DUI interventions are any attempts made to prevent an alcohol-impaired individual from driving. The research to date has concentrated on the factors leading individuals to intervene, informally, in a DUI situation. Comparatively little research has investigated the factors leading potential drunk drivers to comply with informal intervention requests.

An interactional arousal/cost-benefit model was used to predict self-reported informal DUI intervention compliance. According to the model, potential DUI offenders' decisions to comply with intervention requests would be influenced by background variables, context variables, intervention …

There were two main objectives of this study. The first objective was to develop a theoretical model that will explain auditor resignations. To meet this objective, a model was developed which was primarily grounded in prior research related to auditor resignations as well as prior research addressing auditor switching. The second objective was to estimate the model at four different quarterly dates immediately prior to an event date (i.e., the resignation date) so that the effects of time on the explanatory power of the model and each independent variable could be ascertained. Sleep difficulties are becoming progressively more common among university students and may be related to increased academic and emotional difficulties. Psychoeducational interventions are among the most effective methods for reducing sleep difficulties and are significantly better than pharmacological treatments. Attempts to demonstrate the effectiveness of such treatments among university students are not present in the literature.

The purpose of this study was to develop the Sleep Treatment Education Program for Students (STEPS) and evaluate its effectiveness to improve sleep habits and reduce sleep complaints. Only The News That's Fit To Print: The Effect Of Hazelwood On The First Amendment Viewpoint-Neutrality Requirement In Public School-Sponsored Forums, Janna J. Annest

Washington Law Review

In Hazelwood School District v. Kuhimeier, the U.S. Supreme Court held that public school administrators can restrict expression in school-sponsored forums in a manner reasonably related to legitimate pedagogical concerns. Regulating First Amendment rights in any public forum usually requires that no point of view be suppressed in favor of its counterpoint, but the Hazelwood Court omitted the viewpoint-neutrality requirement from its holding. While the Sixth, Ninth and Eleventh Circuits continue to require viewpoint-neutral regulation of school-sponsored speech, the First and Third Circuits interpret Hazelwood as abrogating the viewpoint-neutrality requirement in school-sponsored forums. In Harjo v. Pro-Football Inc., the Trademark Trial and Appeal Board cancelled the federally registered trademarks THE WASHINGTON REDSKINS, REDSKINS, and REDSKINETIES after finding them to be disparaging matter under section 2(a) of the Lanham Act. Pro-Football has appealed the Board's decision to the U.S. District Court for the District of Columbia. This Note argues that Harjo's adoption of the "substantial composite" standard for analyzing disparaging trademarks potentially ignores the majority of the implicated group members' viewpoints and promotes section 2(a) trademark cancellations. Characteristics Of Shark Bycatch Observed On Pelagic Longlines Off The Southeastern United States, 1992-2000, Lawrence R. Beerkircher, Enric Cortes, Mahmood S. Shivji

Data collected by fisheries observers aboard U.S. pelagic longline vessels were examined to quantify and describe elasmobranch bycatch off the southeastern U.S. coast (lat. 22°-35°N, long. 71°-82°W). From 1992 to 2000, 961 individual longline hauls were observed, during which 4,612 elasmobranchs (15% of the total catch) were documented. Of the 22 elasmobranch species observed, silky sharks, Carcharhinus falciformis, were numerically dominant (31.4% of the elasmobranch catch). The catch status of the animals (alive or dead) when the gear was retrieved varied widely depending on the species, with high mortalities seen for the commonly caught silky and night, C. signatus …

Dephasing Model For Spatially Extended Atomic States In Cyclotronlike Resonances, R E. Wagner, S Radovich, J Gillespie, Q Su, Rainer Grobe

In recent work, the formation of ring-shaped electron distributions for hydrogen atoms in resonant static magnetic-laser fields has exclusively been associated with the impact of relativity. In this note we will generalize this statement and show that the nonlinearity associated with the nuclear binding force can trigger similarly shaped steady-state charge clouds in atoms under suitable conditions. The dephasing model, based on modeling the quantum-mechanical state by a classical ensemble of quasiparticles evolving with slightly different cyclotron periods, can recover features, in the two lowest-order resonances as well as the Coulomb-field-induced charge distributions.
