Ending A Mud Bowl: Defining Arbitration’S Finality Through Functional Analysis, Amy J. Schmitz Jan 2002

Ending A Mud Bowl: Defining Arbitration’S Finality Through Functional Analysis, Amy J. Schmitz

Faculty Publications

The Federal Arbitration Act (FAA) and Uniform Arbitration Act (UAA), on the state level, prescribe a nearly identical procedural and remedial scheme for promoting independent, self-contained arbitration. To that end, both acts curtail courts' review of arbitration awards, by limiting the grounds for vacating awards to those aimed at ensuring only basic procedural fairness. Nonetheless, seemingly "pro-arbitration" impulses have driven some courts' eager application, or misapplication, of the FAA/UAA statutory scheme to enforce dispute resolution agreements that reject the acts' limited review prescriptions. This Article tackles this arguable abuse of the FAA/UAA scheme, by proposing a functional analysis for defining …

A Voice For Low-Income Children: Evaluating Guardians Ad Litem In Divorce And Parental Rights And Responsibilities Cases, Alison A. Beyea, Frank D' Alessandro

Children, Youth, & Families

The Muskie Guardian ad Litem Project evaluated the use of Guardians ad Litem (GALS) in divorce and parental rights and responsibilities cases in Maine.

The research suggests that there are significant benefits of GAL appointment for children in contested court proceedings. GALS effectively represent the best interests of children in family proceedings. They assist the Court in issuing custodial decisions, assist in settlement of highly contested cases and otherwise expedite the legal process. In addition to their investigative function, GALS report working with parents and children in an effort to reduce conflict between family members and to connect families with …

The Generation Beyond Print-On-Paper, Michael Kleper Jan 2002

The Generation Beyond Print-On-Paper, Michael Kleper

Books

The purpose of this paper is to: • Compare and contrast paper display with on-screen display. • Examine the state-of-the-art in electronic “paper-like” screen display technology. • Highlight the screen display technologies that are under development and most likely to affect or replace print. • Introduce the subject of printed electronics. • Present comments from leaders in the display technology field. Today’s printing and publishing process involves repurposing content, publishing through multiple channels, and applying XML coding to separate form from content. All of these operations can serve, in one way or another, to disassociate print output from other forms …

Money From Heaven: Should Qualified Air Rights Donations Be Characterized As Interests In Land Or Buildings - Why Does It Matter , Daniel Markey Jan 2002

Money From Heaven: Should Qualified Air Rights Donations Be Characterized As Interests In Land Or Buildings - Why Does It Matter , Daniel Markey

Cleveland State Law Review

Currently, the Internal Revenue Service (hereinafter I.R.S.) and the federal courts do not offer specific positive authority as to whether large amounts of easement value from donated air rights can be allocated against the capital account of "land" as opposed to a "building" on a given tract of real estate. A lack of authority in this area creates uncertainty in the real estate market. This uncertainty is not only with the payment of federal income, estate, and gift taxes, but it also has a ripple effect with the assessment of local property taxes. Most importantly, if a deal is on …

Interracial Cooperatives At The University Of Illinois. 1940-1960, Deirdre Cobb-Roberts

Educational and Psychological Studies Faculty Publications

Very little attention has been given to a discussion of interracial cooperatives on college and university campuses. In fact, the literature discusses interracial partnerships and organizations but does not ameliorate the value of these partnerships on college and university campuses. This paper will investigate interracial partnerships (e.g., Congress on Racial Equality - CORE, Student Community Interracial Committee - SCIC, and Student Community Human Relations Council - SCHRC) that were formed on the University of Illinois at Urbana-Champaign campus during the years of 1940-1960 in an effort to fight extant racial discrimination. Sources utilized for this paper will include institutional records, …
