Quantification Of Land-Use Impact On Stream Water Quality, Scott Dennis, Indrajeet Chaubey, Brian Haggard
Quantification Of Land-Use Impact On Stream Water Quality, Scott Dennis, Indrajeet Chaubey, Brian Haggard
Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences
Accelerated eutrophication of Beaver Lake in northwest Arkansas is a major environmental concern. When developing watershed-management plans to protect lake water quality, it is important that linkages among land-use activities and water quality of tributary streams be quantified. This study assessed longitudinal base-flow and storm-flow water quality at War Eagle Creek and quantified linkages between stream water quality and land-use conditions within the War Eagle Creek sub-watershed of the Beaver Lake watershed. We collected six water samples: three from base-flow conditions and three from storm-flow conditions during Spring 2002. In general, concentrations of nitrate nitrogen (NO3-N), total N (TN), total …

Juvenile Justice Systems: A Need For Improved Research And Treatment, Tenethrea Thompson, Jean Turner
Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences
The characteristics of juveniles who commit crimes and a variety of treatment philosophies for juvenile offenders were examined through literature and individual case studies. The literature review and three case studies provided insight into the difficult challenge of providing effective treatment programs for juvenile offenders.
Procedural Justice: Tempering The State’S Response To Domestic Violence, Deborah Epstein
Procedural Justice: Tempering The State’S Response To Domestic Violence, Deborah Epstein
Georgetown Law Faculty Publications and Other Works
Part I of this Article documents the recent legal reforms implemented on behalf of battered women in the criminal and civil justice systems. These include warrantless arrest, mandatory arrest laws, and no-drop prosecution policies, as well as civil protection order statutes and statutory modifications recommended by the Model State Code on Domestic and Family Violence. Part II describes the ways in which these reforms have improved the state's responsiveness to victims, yet simultaneously entailed serious costs by diminishing batterers' perceptions of procedural justice. Part III defines the building blocks of procedural justice and reviews the social science data demonstrating its …
Protecting Plaintiffs' Sexual Pasts: Coping With Preconceptions Through Discretion, Jane H. Aiken
Protecting Plaintiffs' Sexual Pasts: Coping With Preconceptions Through Discretion, Jane H. Aiken
Georgetown Law Faculty Publications and Other Works
Part I of this Article traces the development of the civil application of Rule 412, the so-called “Rape Shield Rule”. Part II analyzes the inconsistencies within the cases decided under the new civil rule and links those inconsistencies to the language of the rule. It identifies the trends within the cases about what constitutes probative value for purposes of the rule and how courts assess prejudice. The Article concludes that rules of evidence designed to remedy bias of fact finders should not be cast as discretionary. Many of the problems that arise in the interpretation of Rule 412 could be …

Effect Of Childcare Facilities On Vigorous Physical Activity In Preschool Aged Children, Nicole Kelly-Goreham
Dissertations and Theses @ UNI
The purpose of this study was to determine the effect of childcare centers with differences in outdoor space and play equipment upon the amount of time spent at vigorous physical activity by children. The research questions guiding this research were:
1. Is there a difference among childcare centers in the amount of time spent in vigorous physical activity by preschool age children?
2. Is there any relationship between the amount of time spent in vigorous physical activity at the childcare center and the child's BMI, the time spent outdoors time spent in vigorous physical activity outside the center, parental BMI, …

The Mead Doctrine: Rules And Standards, Meta-Rules And Meta-Standards, Thomas W. Merrill
Faculty Scholarship
United States v. Mead Corp. is the U.S. Supreme Court's most important pronouncement to date about the scope of the Chevron doctrine. According to Justice Scalia's dissenting opinion, Mead is "one of the most significant opinions ever rendered by the Court dealing with the judicial review of administrative action." Justice Scalia also thought that the consequences of "the Mead doctrine," as he called it, "will be enormous, and almost uniformly bad."
Justice Scalia's indictment of Mead was driven by his attachment to rules and dislike of standards. He saw Mead as shifting the practice of deference away from the …
Educating Citizens, Peter L. Strauss
Educating Citizens, Peter L. Strauss

Socrates and his followers, the Cynics among them, put great store in educating the youths who would become the leaders of the Athenian republic. The Athenians agreed that education of their youth was of the utmost importance for their state, and executed Soc-rates for corrupting them. As I thought about how these concluding remarks could do more than cast a pale reflection of the extraordinary learning and thought that have preceded them, talking about education leapt to mind.

Psychometric Investigation Of The Validity And Reliability Of The Beliefs About Voices Questionnaire-Revised In A Sample Of Psychotic Outpatients, John James Blue
PCOM Psychology Dissertations
Refractory auditory hallucinations are a continuing problem in the treatment of schizophrenic, schizoaffective and psychotically depressed patient populations as well as patients with psychotic disorder, not otherwise specified. To date, little is known about the assessment of such hallucinatory states. Currently there are only a few instruments designed to examine the characteristics of auditory hallucinations. The study examined the reliability and validity of the Beliefs About Voices Questionnaire-Revised (BAVQ-R) in a sample of psychotic outpatients experiencing refractory auditory hallucinations. The present study consisted of 91 subjects; 57 men and 34 women selected from four separate community outpatient settings, who experienced …

Peer Nutrition Education: A Model For Nutrition Education Among Spanish-Language Participants Of The Special Supplemental Nutrition Program For Women, Infants And Children (Wic), Maximino Alfredo Mejía
Loma Linda University Electronic Theses, Dissertations & Projects
Despite the steady improvement in the health status of Americans, Hispanics are a minority in the United States with greater prevalence of several infectious and chronic diseases and less health knowledge than the average citizen. Nearly half of the Hispanics living in this country die of preventable nutrition-related conditions, with heart disease and cancer being the leading causes. Since this minority has limited access to health care and preventive services, there is a need for an inexpensive, viable model of health education for this underserved segment of the population in order to lower the excess of preventable diseases. We trained …

Pregnant, postpartum and lactating women who are clients of the Arizona Women, Infants and Children (WIC) program have a 22% rate of tobacco use. This is 8% above the national average for this population. The purpose of this study was to measure changes in training curriculum participants' reported levels of self-confidence to deliver brief tobacco cessation interventions before and immediately after participation in the WIC tobacco cessation training curriculum. The research question investigated was: Does participation in a one day, six hour training curriculum designed to teach the skills necessary to deliver brief tobacco cessation interventions increase the participant' s …

Evaluation Of The Preceptors’ Perceptions Of Benefits, Rewards, And Support At All Children’S Hospital, Carol Botwinski
Abraham S. Fischler College of Education ETD Archive
Preceptor programs have been shown to produce nurses, who stay with their jobs, have increased confidence, and competence in the clinical setting. The nurse preceptors are an integral part of these programs. Professional burnout is risked if preceptors are repeatedly asked to assume additional responsibilities without appropriate rewards and support. The purpose of the study was to evaluate the relationship between the preceptor's perception of benefits, rewards, support, and their commitment to the preceptor role.
The research questions that guided the study were was there a relationship between the preceptor's perception of benefits, rewards, and support associated with the preceptor …
The Storrs Lectures: Liberals And Romantics At War: The Problem Of Collective Guilt, George P. Fletcher
The Storrs Lectures: Liberals And Romantics At War: The Problem Of Collective Guilt, George P. Fletcher
Faculty Scholarship
Somehow we in the West thought the age of war was behind us. After nuking Hiroshima, after napalming Vietnam, we had only distaste for the idea and the practice of war. The thought of dying for a noble cause, the pursuit of honor in the name of patria, brotherhood in arms – none of this appealed to us anymore. "I hate war and so does Eleanor," opined FDR in the oft-repeated lyrics of Pete Seeger. War became a subject for ironic disdain. As Tom Lehrer caught the mood of the 1960s: "We only want the world to know that …
Trust And Betrayal In The Medical Marketplace, Maxwell Gregg Bloche
Trust And Betrayal In The Medical Marketplace, Maxwell Gregg Bloche
Georgetown Law Faculty Publications and Other Works
The author argues in this Comment that disingenuity as first resort is an unwise approach to the conflict between our ex ante and our later, illness-endangered selves. Not only does rationing by tacit deceit raise a host of moral problems, it will not work, over the long haul, because markets reward deceit's unmasking. The honesty about clinical limit-setting that some bioethicists urge may not be fully within our reach. But more candor is possible than we now achieve, and the more conscious we are about decisions to impose limits, the more inclined we will be to accept them without experiencing …

Yale Rosenberg: The Scholar And The Teacher Of Jewish Law, Sherman L. Cohn
Georgetown Law Faculty Publications and Other Works
In the early 1980s, when he was a young professor at the University of Houston Law Center, the author had the occasion to meet Yale Rosenberg. It was clear from their discussion that Professor Rosenberg had a strong interest in Jewish law as well as a strong knowledge base. They discussed teaching such a course at the University of Houston Law Center. Professor Rosenberg was doubtful about teaching a course in Jewish law at a secular law school, particularly one in Texas. But that conversation began a series of conversations where Yale explored in some depth the course that we …
The Organizational Psychology Of Hyper-Competition: Corporate Irresponsibility And The Lessons Of Enron, Donald C. Langevoort
The Organizational Psychology Of Hyper-Competition: Corporate Irresponsibility And The Lessons Of Enron, Donald C. Langevoort
Georgetown Law Faculty Publications and Other Works
What I want to do here is first explain my fears and then explore the Enron story from the standpoint of both social psychology and organizational behavior. My sense going in, at least, is that the social forces and selfish norms that emerge fairly naturally in highly competitive settings such as these dominate as behavioral influences over anything but high-powered legal controls. The kind of firm that I want to concentrate on is the "new economy" sort that requires a high rate of creative productivity from a large number of key managers and employees. Thus, I will put to the …

Are Judges Motivated To Create "Good" Securities Fraud Doctrine?, Donald C. Langevoort
Georgetown Law Faculty Publications and Other Works
‘How Do Judges Maximize? (The Same Way Everybody Else Does – Boundedly): Rules of Thumb in Securities Fraud Opinions’, by Stephen M. Bainbridge and G. Mitu Gulati, confronts the reader with a theory about judicial behavior in the face of complex, "unexciting" cases such as those involving securities fraud. The story is simple: few judges find any opportunity for personal satisfaction or enhanced reputation here, so they simply try to minimize cognitive effort, off-loading much of the work that has to be done to their clerks. The evidence that Bainbridge and Gulati offer is the creation of some ten or …
When Litigation Is Not The Only Way: Consensus Building And Mediation As Public Interest Lawyering, Carrie Menkel-Meadow
When Litigation Is Not The Only Way: Consensus Building And Mediation As Public Interest Lawyering, Carrie Menkel-Meadow
Georgetown Law Faculty Publications and Other Works
British social philosopher Stuart Hampshire recently articulated the fundamental and foundational principles of the modem conflict resolution movement (and I do call it a movement). He asserted that, "there will always be a plurality of different and incompatible conceptions of the good and there cannot be a single comprehensive and consistent theory of human virtue. Correspondingly, "our political enmities in the city or state will never come to an end while we have diverse life stories and diverse imaginations.'' Hampshire, a socially progressive, socialist philosopher hoped to articulate universal conceptions of the good. In his lifetime of reflection on this …

The Lawyer As Consensus Builder: Ethics For A New Practice, Carrie Menkel-Meadow
Georgetown Law Faculty Publications and Other Works
In this Article, I explore the roles of lawyers in alternative dispute resolution ("ADR"), including traditional roles in arbitration and "new" roles in mediation and facilitation. I also discuss how conventional ethics rules for lawyers fail to provide guidance and "best practices" for lawyers who serve in these new roles. State legislatures and professional associations, such as the American Arbitration Association ("AAA"), the Center for Public Resources Institute for Dispute Resolution ("CPR"), and the Association of Conflict Resolution, have adopted ethical codes for mediators and arbitrators. Select professional associations are also developing "best practice" guides for the provision of ADR …

Interactive Virtual Laboratory For Experience With A Smart Bridge Test, Elizabeth C. Eckhoff, Vicki M. Eller, Steve Eugene Watkins, Richard Hall
Electrical and Computer Engineering Faculty Research & Creative Works
Virtual laboratory experiments can be cost effective, convenient instructional resources that have appeal to a wide range of learning styles. Expensive, time-consuming laboratory tests can be experienced repeatedly and remotely using interactive simulations and original video footage or animations. A virtual experiment can incorporate meaningful exercises, procedural options, and background hyperlinks to create a comprehensive "hands on" environment. Also, it may be used as preliminary training for the actual experiment.
An interactive LabVIEW-based laboratory for a load test simulation of an existing demonstration bridge was created. This smart truss bridge is instrumented with fiber optic strain sensors situated on the …

Engineers interact in the workplace with technical peers in other disciplines at all stages of design, development, and application. Awareness of the constraints and needs of the other disciplines can be key in many situations. Such interdisciplinary activity and the associated communication are facilitated if the all participants have a solid knowledge of discipline-specific terminology and an understanding of connecting concepts. Consequently, experience relating to interdisciplinary teamwork is a necessary component of engineering education. The Smart Engineering Group at the University of Missouri-Rolla was established to conduct interdisciplinary research and to create interdisciplinary educational resources. The topical interest area is …
