The Social Construction Of Personal Protection Orders: Gendered Differences?, Kristen E. Devall Dec 2002

The Social Construction Of Personal Protection Orders: Gendered Differences?, Kristen E. Devall

Masters Theses

Personal Protection Orders (PPOs) were enacted as one method of responding to the issue of domestic violence that was thought to be escalating in epidemic proportions across the United States. This research was grounded in social constructionist theory and sought to examine the perspectives of judges who authorize/deny PPOs and the implications these perspectives have for the legal process as well as the larger criminal justice system. Through my examination of the petitioning process, I gained insights about the relationships that exist between petitioners and respondents as well as the reasons petitioners cite for why s/he is seeking a PPO. …

Open For Business: Exploring The Life Stages Of Two Canadian Street Youth Shelters, Jeff Karabanow Dec 2002

Open For Business: Exploring The Life Stages Of Two Canadian Street Youth Shelters, Jeff Karabanow

The Journal of Sociology & Social Welfare

Youth shelters have emerged as significant resources for homeless and runaway adolescents. Through participant observations of shelter culture, review of agency archival materials, and in-depth interviews with 21 shelter workers (front line staff, middle managers, and upper-level executives), this analysis explores the life stages of two Canadian street youth shelters, highlighting the dramatic transformations in their internal operations and external environments. This paper also offers an understanding of organizational evolutionary processes.

Road Work: Racial Profiling And Drug Interdiction On The Highway, Samuel R. Gross, Katherine Y. Barnes Dec 2002

Road Work: Racial Profiling And Drug Interdiction On The Highway, Samuel R. Gross, Katherine Y. Barnes

Michigan Law Review

Hypocrisy about race is hardly new in America, but the content changes. Recently the spotlight has been on racial profiling. The story of Colonel Carl Williams of the New Jersey State Police is a wellknown example. On Sunday, February 28, 1999, the Newark Star Ledger published a lengthy interview with Williams in which he talked about race and drugs: "Today . . . the drug problem is cocaine or marijuana. It is most likely a minority group that's involved with that. " Williams condemned racial profiling - "As far as racial profiling is concerned, that is absolutely not right. It …

Reply: Criminal Law's Pathology, William J. Stuntz

Michigan Law Review

I thank Kyron Huigens for devoting his time and his considerable talent to responding to my article, The Pathological Politics of Criminal Law. I also thank editors of the Michigan Law Review for giving me the opportunity to reply. It is best to begin by defining the contested territory. Huigens and I agree (I think) on three propositions. First, American criminal law, both federal and state, is very broad; it covers a great deal more conduct than most people would expect. Second, American criminal law is very deep: that which it criminalizes, it criminalizes repeatedly, so that a single …

Flouting The Law: Does Perceived Injustice Provoke General Non-Compliance?, Janice Nadler Nov 2002

Flouting The Law: Does Perceived Injustice Provoke General Non-Compliance?, Janice Nadler

Law and Economics Papers

What happens when people's common sense view of justice diverges from the sense of justice they see enshrined in particular legal rules and legal outcomes? In particular, does the perception of one particular law as unjust make people less likely to comply with unrelated laws? This article reports an experiment that empirically tested the Flouting Thesis - the idea that the perceived justice of one law can influence the intention to comply with unrelated laws. Participants who were exposed to laws they perceived as unjust were more willing, as a general matter, to flout unrelated laws, compared to participants exposed …
