Rascals, The State, And Civil Society In Papua New Guinea, Nand E. Hart Nibbrig Sep 2002

Rascals, The State, And Civil Society In Papua New Guinea, Nand E. Hart Nibbrig

Pacific Studies

This article contends that as conditions worsen in Papua New Guinea's urban areas, it is apparent that the escalating crime and violence associated with rascal gangs are creating new rules of authority. The cumulative effects of criminal activities associated with gangs are negating the existing social order, spreading fear deep within civil society. In so doing, these activities deliver yet another blow to the legitimacy of the state. Continuous migration and the concomitant expansion of the newly urbanized population are defining a new urban landscape. Likewise, the persistent drain of national wealth by pervasive corruption, civil war, or domestic unrest …

Northeast Community Survey: Final Report, Brad A. Myrstol

Reports

East Anchorage is currently the only site in Alaska under the nationwide Weed & Seed initiative, which is intended to “weed out” criminals who undermine quality of life for community residents in high-crime neighborhoods and to “seed in” positive practices, programs and institutions that contribute to a better quality of life for neighborhoods. The East Anchorage Weed & Seed site, located in a racially and ethnically diverse neighborhood in the northeast part of Anchorage, had an estimated population in 2001 of more than 20,000 people living in nearly 7,600 households. On behalf of East Anchorage Weed & Seed, the Justice …

Domestic Violence Law Reforms: Reactions From The Trenches, Carol Bohmer, Jennifer Brandt, Denise Bronson, Helen Hartnett Sep 2002

Domestic Violence Law Reforms: Reactions From The Trenches, Carol Bohmer, Jennifer Brandt, Denise Bronson, Helen Hartnett

The Journal of Sociology & Social Welfare

In recent years, feminists have worked hard to pressure society and the criminal justice system into taking domestic violence seriously. These efforts have resulted in more government funding and increased services to victims. In addition, there have also been legal and policy reforms which have affected the way cases are handled in the criminal justice system. This article reports on research on the reactions to those reforms by those most directly affected by them, the victims themselves and those who provide services to them.

The Rehnquist Court, Structural Due Process, And Semisubstantive Constitutional Review, Dan T. Coenen Sep 2002

The Rehnquist Court, Structural Due Process, And Semisubstantive Constitutional Review, Dan T. Coenen

Scholarly Works

Semisubstantive review, as I use that label, entails four key features. First, the subject matter of judicial inquiry is not the process applied in adjudicating a discrete dispute; rather, the matter at hand is the constitutionality of a statute or other generalized expression of legal policy. Second, some procedural omission by the lawmaker -- rather than an incurably substantive flaw in the end product of its work -- lays the groundwork for a judicial intervention that invalidates the challenged rule or negates how that rule otherwise would operate. It may be, for example, that a federal statute read as a …

Are Hung Juries A Problem?, Paula Hannaford-Agor, Valerie P. Hans, Nicole L. Mott, G. Thomas Munsterman

Faculty Publications

Providing an empirical picture of hung juries was the principal objective for this 4-year study by the National Center for State Courts (NCSC) with funding by the National Institute of Justice (NIJ). The research methodology was envisioned as a two-phase process. In the first phase, the NCSC proposed to conduct a broad-based survey of hung jury rates in state and federal courts while the second phase consisted of an in-depth examination of jury behavior in 10 jurisdictions to compare case and jury characteristics in felony trials that result in a verdict to those that result in jury deadlock. The types …
