What Do We Do When We Do Law And Popular Culture, Jessica Silbey
What Do We Do When We Do Law And Popular Culture, Jessica Silbey
Faculty Scholarship
"What We Do When We Do Law and Popular Culture" establishes a theoretical framework for analyzing legal popular culture, taking as its point of departure Richard Sherwin's book "When Law Goes Pop." The article stresses what Professor Silbey considers to be three major stumbling blocks in the growing interdiscipline of law and popular culture. She argues that if we are to advance our understanding of the relationship between law and popular culture, we must follow at least three simple charges: (1) demarcate our beginning concepts, such as law or culture, so that amidst the vast phenomena that may be called …
Preparing For The Clothed Public Square: Teaching About Religion, Civic Education, And The Constitution, Jay D. Wexler
Preparing For The Clothed Public Square: Teaching About Religion, Civic Education, And The Constitution, Jay D. Wexler

Although law and religion scholars have long argued about whether American culture marginalizes religious belief, many important indicators suggest that religion indeed plays a prominent role in contemporary American life. America is an extremely religious nation. Polls consistently show that about ninety percent of Americans continue to believe in God, and both church attendance and membership remain at high levels. This religiosity, moreover, spills out into the public square. A great many Americans rely on religious reasons when thinking and talking about public issues. Ninety percent of the members of Congress, by one report, consult their religious beliefs when voting …
Transracial Adoption (Tra) And The Development Of Ethnoracial Identity, Mairi Mckenna
Transracial Adoption (Tra) And The Development Of Ethnoracial Identity, Mairi Mckenna
Theses and Dissertations (Comprehensive)
Research on the experience of transracial adoption and the development of identity has indicated that supports for this process are required. Research that has not named transracial adoption as negatively impacting on identity has also recommended these kinds of family supports. There has, however, been a disquieting absence of such support programs. It is for these reasons that I have set out to start the process of identifying the best practices for such supports and begin the process of creating such a program. The methodology is influenced by a number of different theories: participatory action research (PAR), needs assessment, capacity …

Dynamical Systems Theory As Applied To War-Ravaged Bosnia And Its People: Stage One Of A Multistrategy Research, Kristin T. Trotter
Theses and Dissertations (Comprehensive)
Using the theoretical underpinnings of dynamical systems theory and the construct of self-organization, this study uses a multistrategy research design to explore coping and adaptive mechanisms in a group of 26 Bosnian refugees. Qualitative findings indicated that in spite of tremendous losses this group of Eastern European refugees restructured their lives in Canada in creative, unexpected, and novel ways. This study specifically focused on issues of post traumatic growth and explored exactly how refugees manage to rebuilt their lives and self-organize. Quantitative measures looked at symptoms of trauma over a 200-day period. Using the Impact of Events Scale - Revised, …
Evaluating The Sex Discrimination Argument For Lesbian And Gay Rights, Edward D. Stein
Evaluating The Sex Discrimination Argument For Lesbian And Gay Rights, Edward D. Stein
Articles
The sex discrimination argument for lesbian and gay rights analyzes laws that discriminate on the basis of sexual orientation in terms of sex discrimination. For example, sodomy laws that prohibit only same-sex sexual activities are analyzed as discriminating on the basis of sex because they prohibit women from doing something men are permitted to do, that is, have sex with women. This argument has been championed by some scholars and litigators, and it has persuaded some judges. Edward Stein shows that there are sociological, theoretical, moral, and practical problems facing the sex discrimination argument. He suggests that there are better …

Improving Student Achievement And Attitude In Middle Grade Social Studies Classes Through Learning Style Instruction And Design, Jennifer D. Vincent
Improving Student Achievement And Attitude In Middle Grade Social Studies Classes Through Learning Style Instruction And Design, Jennifer D. Vincent
Abraham S. Fischler College of Education ETD Archive
This applied dissertation was designed to improve student achievement and attitude in a middle school social studies class. Students were not performing well on tests and exams after experiencing traditional visual and auditory instructional methods. The Jack of diversity and creativity in delivery of instruction resulted in limited academic achievement and poor attitude towards social studies learning. Furthermore, long-term memory was also negatively affected because the traditional teaching approaches did not emphasize higher level thinking that promotes greater retention. The study integrates theoretical research concerning how students learn to the development of a strong historical rationale for implementing learning styles …

A Discipline Intervention Program At Jones Elementary School, Mike B. Campbell
Abraham S. Fischler College of Education ETD Archive
Will a staff-development program that includes an emphasis on conflict resolution, positive-discipline approaches, and proactive supervision lead to a reduction in discipline referrals for the school? In addition, will the development of the planning-room concept as a replacement for in-school suspension lead to fewer repeat offenders? Those were the research questions that guided this study. The school climate was measured through the discipline referral reviews and administrative observation.
The setting for this applied dissertation implementation was an elementary school serving 700 students in kindergarten through 5th grade. The school is located in a small community that is included in the …

Starting Over: A Tentative Theory Exploring The Effects Of Past Relationships On Postbereavement Remarried Couples, Andrew Scott Brimhall, Michelle Engblom-Deglmann
Faculty Publications - Graduate School of Counseling
Using grounded theory methodology 24 participants were asked to discuss how the death of a previous spouse, either theirs or their partner’s, was currently affecting their second marriage. Participants were interviewed individually and as a couple. The central category was memories of the deceased spouse. Six additional categories emerged from the data: past spouse on pedestal, current/past comparison, insecurity of current spouse, curiosity about past spouse/relationship, partner’s response to curiosity, and impact on the current relationship. Existing literature, auditors, and participant feedback were all used to validate the results. Expanding on a tentative theory (Brimhall, Wampler, & Kimball, 2008), provisional …

The Bridge Builders Of Luther Memorial, Wilber J. Williamson
The Bridge Builders Of Luther Memorial, Wilber J. Williamson
The Bridge
The congregation of Luther Memorial Church in Des Moines, Iowa, celebrated its centennial anniversary in 1999, during which time there was a good deal of reflection concerning the historical roots and activities of the church during the preceding one hundred years. Much of the early history of the congregation was closely associated with Grand View College. During the first decades, the school provided worship facilities as well as the pastor services for the emerging congregation. With financial support from the Danish Evangelical Lutheran Church, a building was erected in 1917, which has served as the home for the congregation since …

The Bridge
1£ you were to peruse the pages of Danneuirke, the Danish language weekly, for the first half of the year 1923, you would find the pages filled with articles pro and con concerning the pastoral pledge (praesteloflet). The pastoral pledge is not to be confused with the pastoral vow to remain true to the Orristian faith. No one objected to this. The pledge, on the other hand, was a promise to remain true to the canonical books of Lutheranism. Some had refused to take this pledge and had, accordingly, been denied ordination. This matter was to be dealt with at …

Emigration From Jystrup And Valsolille, Pia Viscor
The Bridge
Traveling eastwards across the Danish island of Sjrelland, you turn off superhighway E66 at Ringsted and take highway Al towards Roskilde. Soon, you see a sign pointing to Jystrup and take the short side road to that village. The rolling countryside is idyllic, dotted with small lakes and ponds, tidy farmland alternating with forest. Jystrup lies on the eastern shore of a lake, with the church and village of Valselille on the opposite shore. On a peninsula at the northern end of the lake are ruins of Skjoldenres castle, beseiged and conquered by King Valdemar Atterdag in the mid-fourteenth century. …

The Bridge
Kristian Pedersen 0stergaard (Ostergaard in English) was born 1855 in Volstrup, Hjerm parish, near the little town of Struer on the southern shore of the Limfjord. He grew up on the family farm and, like many other Danish farm boys of that day, went to work as a hired hand after eight years of schooling and confirmation. As a farmhand, he spent all of his spare time in reading. At an early age, he began to teach in private schools, first on Fyn and later on Langeland, though he had no formal training as a teacher. Time and again, he …

Determining The Relationship Between Educational Level And College Plans Between Different Types Of Child Care Providers For Southwest Missouri State University-West Plains, Renee S. Moore
Abraham S. Fischler College of Education ETD Archive
The problem for this study was that enrollment numbers in the child and family development program at Southwest Missouri State University-West Plains were unexplainably low. At the request of the University 's Chancellor, survey data was analyzed to explore the relationship between key variables.
There were two research questions for this study. First, "Is there a relationship between types of child care providers and their college plans?" Second, ''Is there a relationship between the respondent's level of education and their college plans?"

THE CORPS OF DISCOVERY awakened to a damp morning on July 14, 1804. Rain had fallen all night and the wetness delayed departure until 7 a.m. A half-hour later, an ominous black cloud blew in, accompanied by wind and rain that pummeled the 55-foot keelboat and two pirogues. Unable to seek safety on either shore - because of banks caving in on one side and snags lining the other - the men anchored the keelboat midstream and braced for the squall to pass.
Factors For Effective Learning Groups In Face-To-Face And Virtual Environments, Charles R. Graham
Factors For Effective Learning Groups In Face-To-Face And Virtual Environments, Charles R. Graham
Faculty Publications
Group work has been a powerful instructional method used in face-to-face learning environments. To date, group work has not reached the same prominence in distance learning environments where there is a strong emphasis on independent or individualistic learning. This may be due in part to the perceived difficulty of engaging students in working together at a distance, as well as a general lack of knowledge about the factors that contribute to effective virtual group work. This paper reviews the literature related to creating effective learning groups in face-to-face and virtual environments. Research from the following four areas was used: cooperative …

Children who experience difficulties with peers also tend to experience both concurrent social–psychological difficulties and long-term negative developmental outcomes. Specifically, a significant amount of research has identified peer rejection and isolation as significant precursors to academic troubles and socially deviant behavior (DeRosier, Kupersmidt, & Patterson, 1994; Kupersmidt, Coie, & Dodge, 1990; Parker & Asher, 1987; Parker, Rubin, Price, & DeRosier, 1995). Substantial research and intervention efforts have consequently been dedicated to an understanding of the problem behaviors commonly identified as correlates or antecedents of peer rejection. Childhood aggression is one of the most significant predictors of peer rejection, and has …
