Private Ordering And Workers Rights In The Global Economy: Corporate Codes Of Conduct As A Regime Of Labour Market Regulation, Harry W. Arthurs Jan 2002

Private Ordering And Workers Rights In The Global Economy: Corporate Codes Of Conduct As A Regime Of Labour Market Regulation, Harry W. Arthurs

Articles & Book Chapters

New technologies, new patterns of consumption and production, new levels of intensity, magnitude, and volatility in the movement of people, information, and capital are transforming the global political economy. Many effects of this transformation become manifest in the domain of public policy, where parties across the political spectrum have embraced the nee-liberal agenda. That agenda has been characterized, perhaps hyperbolically, as the 'hollowing out of the state': fac ilitation of transnational business activity; reduction of corporate and personal taxes and cuts in public expenditures, especially on social welfare; deregulation of domestic markets. These developments in turn are weakening, perhaps fatally, …

Organized Corporate Criminality: The Creation Of A Organized Crime Smuggling Market: Tobacco Smuggling Between Canada And The Us, Margaret E. Beare

Articles & Book Chapters

The intention of this paper is to serve in part as a warning to the international community concerned about corruption, to keep the focus based on the critical analysis of empirically verifiable information. In ways similar to how theorists spoke about organized crime in the 1960s and 1970s, articles today attempt to refer to corruption as if there were one agreed upon definition. However, like the concept “organized crime”, the term “corruption” involves diverse processes which have different meanings within different societies. Corruption (or a focus on corruption), may be the means toward very diverse ends and each may have …

New Complexity Theories: From Theoretical Innovation To Doctrinal Reform, Darren L. Hutchinson Jan 2002

New Complexity Theories: From Theoretical Innovation To Doctrinal Reform, Darren L. Hutchinson

Faculty Articles

This Article examines the work of the new complexity or multidimensionality scholars. Most of these scholars are "race-sexuality-genderclass" critics - or scholars whose research introduces sexuality and "queer" theories to the race, gender, and class project initiated by intersectional scholars. This Article seeks to identify concrete points of intervention for multidimensional theorizing. Part II offers an "intellectual history" of the new complexity theories. This section explores the distinctions and similarities among intersectionality literature and the recent contributions of authors in the multidimensionality school. Parts III considers some of the doctrinal implications of new complexity theory and concludes that this work …

So Young And So Untender: Remorseless Children And The Expectations Of The Law, Martha Grace Duncan Jan 2002

So Young And So Untender: Remorseless Children And The Expectations Of The Law, Martha Grace Duncan

Faculty Articles

A nine-year-old speaks with apparent callousness as he walks by the body of the girl he has killed. A fourteen-year-old jokes about "body parts in her pocket" after bashing in her mother's head with a candlestick holder. And a fifteen-year-old laughingly names his accomplice ''Homicide" after participating in a robbery that culminated in the victim's death. Seemingly remorseless acts such as these can have a crucial impact on the way a child or adolescent fares in the juvenile justice or criminal system. Yet, when one looks closely at what the courts interpret as indicators of remorselessness -- taking into account …

Progressive Race Blindness: Individual Identity, Group Politics, And Reform, Darren L. Hutchinson Jan 2002

Progressive Race Blindness: Individual Identity, Group Politics, And Reform, Darren L. Hutchinson

Faculty Articles

This Article responds to the advocates of "progressive race blindness" with several critiques of their central claims. Part I examines the contours of progressive race blindness in greater detail, giving centrality to the emergence of this theory in legal scholarship. Part I sets forth the common themes articulated in progressive race blindness arguments and highlights important differences among its proponents. Part II isolates several problems with the progressive race blindness literature and demonstrates that these weaknesses make the literature unhelpful as a political or legal theory and even dangerous to the cause of antiracism. Part III offers suggestions for future …

Transnational Liftoff And Juridical Touchdown: The Regulatory Function Of Private International Law In An Era Of Globalization, Robert Wai

Articles & Book Chapters

Globalization is sometimes considered to have led to the liftoff of international business transactions from national regulatory oversight. This Article is concerned with the connection between a liftoff of transnational business processes and the laws related to international economic transactions. In particular, the Article examines the "governing" role that national private laws play in transnational business relations through an examination of the regulatory function of private international law.The Article describes how recent "internationalist" reforms in private international law contribute to a possible liftoff and discusses representative policy justifications for these reforms, such as the facilitation of international commerce, the attainment …

Transformational Leadership And Moral Discourse In The Workplace And Civil Society, John W. Frank Jan 2002

Transformational Leadership And Moral Discourse In The Workplace And Civil Society, John W. Frank

UNF Graduate Theses and Dissertations

This study was grounded in the theory and practice of transformational leadership, where leaders function as moral agents of change as they facilitate values talk (moral discourse) among their constituents. The study took its cue from Rost's call for a new paradigm for leadership ethics that calls for methods of group moral decision making to assess organizational and social ends. The inquiry sought to better understand how leaders engage others in moral conversation and how such processes influence organizational culture and democratic civil society.

The methodology was qualitative and phenomenological as it was centered on leaders' perceptions of their experiences …

An Examination Of The Perceived Need And Recommended Competencies For A Secondary School Principal Internship Program In The Seventh-Day Adventist Educational System, Robert L. Caskey Jan 2002

An Examination Of The Perceived Need And Recommended Competencies For A Secondary School Principal Internship Program In The Seventh-Day Adventist Educational System, Robert L. Caskey

Dissertations

Purpose. The of this study was to examine the perceived need for, the recommended competencies of, and the delivery systems suggested, for a secondary school principal internship program in the Seventh-day Adventist educational system.

This study evolved from the belief that the significant turnover of principals represents a challenge for Adventist education. Because of this, the supply of qualified and experienced candidates is not available in sufficient numbers to meet the current personnel needs for secondary school administrators.

The review of related literature traced the history of principal internship training in the public school system from the early 1800s to …

The Refugee Jurist And American Law Schools, 1933-1941, Kyle Graham Jan 2002

The Refugee Jurist And American Law Schools, 1933-1941, Kyle Graham

Faculty Publications

This paper documents an important episode in the development of the “modern” American law school. Starting in 1933, law schools were invited to “host” or permanently welcome onto their faculties European jurists displaced by the German National Socialist government. At first, law schools sensed an opportunity to affiliate themselves with some of the leading lights of German “scientism.” Over time, however, these same institutions concluded that younger émigré scholars were more capable than their older counterparts were of embracing “American” practices of law teaching and scholarship. This article, drawing upon various archival sources, traces this transition, its causes, and its …

Community Enforcement Of Informal Contracts: Jewish Diamond Merchants In New York, Barak D. Richman Jan 2002

Community Enforcement Of Informal Contracts: Jewish Diamond Merchants In New York, Barak D. Richman

Faculty Scholarship

The diamond industry is home to many unusual features: the predominance of an ethnically homogeneous community of merchants, the norm of intergenerational family businesses, and a rejection of public courts in favor of private contract enforcement. This paper explains that the diamond industry's unique attributes arise specifically to meet the particularly rigorous hazards of transacting in diamonds. Since diamonds are portable, easily concealable, and extremely valuable, the risk associated with a credit sale can be especially costly. However, the industry enjoys valuable organizational efficiencies if transactions occur on credit between independent, fully incentivized agents. Thus, an efficient system of exchange …
