Judicial Mindfulness, Evan R. Seamone Jan 2002

Judicial Mindfulness, Evan R. Seamone

Journal Articles

Like all human beings, judges are influenced by personal routines and behaviors that have become second nature to them or have somehow dropped below the radar of their conscious control. Professor Ellen Langer and others have labeled this general state "mindlessness." They have distinguished "mindful" thinking as a process that all people can employ to gain awareness of subconscious influences, and thus increase the validity of their decisions. In this Article, I establish a theory of "judicial mindfulness" that would guard against two types of "cold" bias when interpreting legal materials. The first harmful bias involves traumatic past events that …

A Refreshing Jury Cola: Fulfilling The Duty To Compensate Jurors Adequately, Evan R. Seamone Jan 2002

A Refreshing Jury Cola: Fulfilling The Duty To Compensate Jurors Adequately, Evan R. Seamone

Journal Articles

This Article adopts a new perspective on the obligation of states to compensate jurors on the basis of their financial needs. It combs the nation’s history for answers to a variety of significant questions: Why do states compensate jurors? Have there ever been minimal levels of juror compensation among the states of the union? Have any legal challenges resulted in governments raising jury fees? Have states developed uniform standards for juror compensation in light of varied economic conditions? While, at times, the responses to these questions will be brief, answering them is crucial to understanding how jury fees can be …

Note, When Wishing On A Star Just Won’T Do: The Legal Basis For International Cooperation In The Mitigation Of Asteroid Impacts And Similar Transboundary Disasters, Evan R. Seamone Jan 2002

Note, When Wishing On A Star Just Won’T Do: The Legal Basis For International Cooperation In The Mitigation Of Asteroid Impacts And Similar Transboundary Disasters, Evan R. Seamone

Journal Articles

This Note uses the threat of collisions of large space bodies with the Earth as a vehicle to investigate the legal duties of nations to participate in collective efforts at megadisaster mitigation. Asteroids and comets are space bodies while meteors occupy a less-threatening category. Although they differ in chemical composition and in visibility to the naked eye, large space bodies can endanger multiple nations simultaneously. Space bodies are ideal topics of investigation because the magnitude of the threats they pose is inestimable. Legal obligations to mitigate Earth impacts apply equally well to other infrequent threats that are currently of the …

PERSPECTIVE: All we are and everything we do is a spiritual matter because we live in the context of God's presence, purpose, and power. In all we are, think, say, and do in this course, individually and collectively, we should seek to be conscious of God's constant and pervading presence. We should also consciously and consistently seek God's purpose for us in this course. We need to be open, receptive, and responsive to the power of the Holy Spirit at every level of this course as the mediator of God's presence and the actualizer of God's purposes. We must bathe …

Images Of Service: Reflections From The Campus Compact Midwest Collaboration Community Service Directors Fellowship Program 2000-2001, Beth Blissman, Jay Cooper

Higher Education

We Americans are people of the journey. From boats across the Atlantic by way of Pilgrim quest, to the holocaust of the middle passage, to classic travelogues such as On the Road or Travels with Charley (in Search of America}, the stamp of the mythic journey seems to be indelibly planted on our national psyche. And as we all know, journeys have several staple elements: anticipation, consumption of a variety of foods at exorbitant prices, wrestling with a roadmap, and children in the back crying, "Are we there yet?" A quintessentially American component to the journey, however, is the postcard.

Service-Learning On American Campuses: Challenges For Pedagogy And Practice, Sandra Enos Jan 2002

Service-Learning On American Campuses: Challenges For Pedagogy And Practice, Sandra Enos

Higher Education

Over the past twenty years, there has been a steady increase in the number of students involved in community service and service-learning programs on college campuses. A recent report by Campus Compact (2003) noted that 33 percent of college students on its member campuses were engaged in community service programs during the last academic year. Surveys by Compact found that eleven percent of higher education faculty offered an average of 30 service-learning courses on campuses (Campus Compact 2003, 2003a). Increasingly, institutions of higher education are supporting these efforts by establishing community service and service-learning offices, staffing them, and by providing …

Moving Mountains: Institutional Culture And Transformational Change, Judith A. Ramaley Jan 2002

Moving Mountains: Institutional Culture And Transformational Change, Judith A. Ramaley

Higher Education

Our institutions are changing all the time but for the most part these changes do not make a big difference, either because the results are confined to an isolated segment of the organization or because the environment is not responsive. To be considered truly transformational, the initiative must alter the culture of the institutions by changing select underlying assumptions and institutional behaviors, processes, and products; it must be deep and pervasive, affecting the whole institution; it must be intentional; and it must occur consistently over time (Eckel, Hill, & Green, 1998).

Principles Of Best Practice In Community Service Work-Study, Erin Bowley, Marsha Adler

Higher Education

The following document outlines best practice in combining college and university work-study experiences with community service and service-learning. The principles were created by Erin Bowley and Marsha Adler for Campus Compact after conducting focus groups with practitioners from 52 colleges and universities in May and June, 2002. Ten principles that help construct an effective community service work-study program are listed below, then explained in greater detail with key points and specific campus examples. Representatives from the campuses used as examples are willing to be contacted for further information; their contact information appears at the end of the document.

Causation In Context: Interpreting The Nexus Clause In The Refugee Convention, Michelle Foster Jan 2002

Causation In Context: Interpreting The Nexus Clause In The Refugee Convention, Michelle Foster

Michigan Journal of International Law

The aim of this Article is to explore current approaches to identifying and applying the causation test inherent in the "for reasons of" clause and to attempt to devise a sui generis test appropriate to the unique aims and objects of the Convention. Part I begins by reviewing both the principles governing the causation analysis and their methods of application in different jurisdictions. Part II then proceeds to review the considerations that might inform the development of a causation standard in refugee law, including guidance that might be obtained from other areas of law, against the background of the need …

New Complexity Theories: From Theoretical Innovation To Doctrinal Reform, Darren Lenard Hutchinson Jan 2002

New Complexity Theories: From Theoretical Innovation To Doctrinal Reform, Darren Lenard Hutchinson

UF Law Faculty Publications

During the latter part of the twentieth century, progressive scholars in various fields of study have developed a large body of works analyzing identity politics. Within legal scholarship, critical race, feminist, anti-heterosexist, and other progressive theorists have demonstrated how legal doctrines and policies perpetuate social hierarchy and reinforce the domination of oppressed classes. The efforts of progressive scholars (and activists) to launch a unified critique of injustice, however, has proved difficult - due in part to the variety of theoretical and doctrinal options available to counter subordination and also to the intractable nature of institutionalized oppression. Yet, progressive scholars have …

The Politics Of Research Access To Federal Court Data, Lynn M. Lopucki Jan 2002

The Politics Of Research Access To Federal Court Data, Lynn M. Lopucki

UF Law Faculty Publications

This 11-page paper argues that the problems of empirical researchers in accessing federal court data are principally political, not technological or economic. The technological advances of the past twenty years - computerization of court records and internet access through PACER - have been offset almost entirely by political restrictions on data access. Additional restrictions, ostensibly to protect privacy, now threaten to reduce access further. The data access problem discourages research that might produce results critical of the judges or the functioning of the legal process. The problem thus restricts public access to critical evidence of the courts' failures and limits …

The Crisis Of Child Custody: A History Of The Birth Of Family Law In England, Danaya C. Wright Jan 2002

The Crisis Of Child Custody: A History Of The Birth Of Family Law In England, Danaya C. Wright

UF Law Faculty Publications

This article attempts to show that the inter-spousal custody cases of the nineteenth century created such a crisis in equity that they eventually demanded a new court structure and a new set of legal doctrines. The custody cases posed such a profound threat to the stability and authority of the Chancery courts that within fifty years an entirely new court system was required. That court system combined the tripartite jurisdictions of the law, equity, and ecclesiastical courts in matrimonial matters. While many scholars and historians have applauded that moment, I would suggest that the new court was merely a way …
