Ways Of Criticizing Public Choice: The Uses Of Empiricism And Theory In Legal Scholarship, Tom Ginsburg Jan 2002

Ways Of Criticizing Public Choice: The Uses Of Empiricism And Theory In Legal Scholarship, Tom Ginsburg

Articles

Public choice theory has been used to explain a wide range of observable facts. It has also been influential in legal scholarship. In Part I of this article, Tom Ginsburg reviews the main premises behind public choice theory and discusses how these premises have fared when tested empirically. In this section, for example, the author discusses how casual empirical observation of the "free rider" problem suggests that individuals do not always seek to maximize their own self-interest. The author further points out that additional studies, like Ostrom's empirical observations of a Turkish fishery, are necessary in order to explain why …

Measured Interpretation: Introducing The Method Of Correspondence Analysis To Legal Studies, Bernard E. Harcourt Jan 2002

Measured Interpretation: Introducing The Method Of Correspondence Analysis To Legal Studies, Bernard E. Harcourt

Articles

Professor Harcourt develops and advocates a method to more rigorously measure and evaluate how qualitative "social meaning" variables relate to legal practices and public policies. The method integrates in-depth qualitative interviews with an experimental free associational component, map analysis of the interviews, and a methodology, correspondence analysis, that remains little known in the United States despite its acceptance in other parts of the world. Correspondence analysis, according to Professor Harcourt, is a tool that allows researchers to visually represent the relationship between structures of social meaning and the contexts and practices within which they are embedded. This method opens up …

Writing An Important Body Of Scholarship: A Proposal For An Embodied Rhetoric Of Professional Practice, Jane Hindman

Publications and Research

Identifies a set of professional discursive practices of rhetoric teachers that reveal gendered power relations. Proposes an "embodied rhetoric" characterized and authorized in part by specific sorts of personal author- and context-saturated gestures. Concludes that an embodied rhetoric regenders academic discourse, assures agency and power to feminist theory and praxis, and facilitates efforts to effect change in teachers and students' lives.

Factors Influencing Job Satisfaction Of Repatriated Managers, Michael A. Duoto Edd Jan 2002

Factors Influencing Job Satisfaction Of Repatriated Managers, Michael A. Duoto Edd

Dissertations

Turnover due to repatriation is an increasingly costly occurrence for multinational corporations. Understanding why repatriates decide to leave their companies upon being called back from abroad may help to devise ways in which organizations can mitigate such turnover and reduce cost in hiring and training new personnel. To that end, this study examines the impact of training and orientation programs on the job satisfaction of repatriated managers. In general the study looks at whether or not training, orientation, and family support programs have an impact on the job satisfaction of repatriated managers. The study puts forward the hypothesis that training …

The Development Of The Tavistock And Tavistock-Inspired Group Relations Movement In Great Britain And The United States: A Comparative And Historical Perspective, Amy L. Fraher Edd Jan 2002

The Development Of The Tavistock And Tavistock-Inspired Group Relations Movement In Great Britain And The United States: A Comparative And Historical Perspective, Amy L. Fraher Edd

Dissertations

In order to gain a deeper understanding of authority, people must analyze human behavior in groups. To study these behaviors, a group relations movement was spawned approximately 60 years ago and has influenced people's thinking about leadership and authority in groups and organizations ever since. This study analyzed primary and secondary historical sources, including data from extended videotaped interviews the researcher conducted with thirteen group relations experts throughout the United States and Great Britain, as a way to reconstruct the history of a significant part of the group relations movement. These videotaped interviews are available for viewing. Specifically, the study …

Modeling The Effects Of Financial Aid On Student Enrollment Decisions: A Quantitative Case Study Of A Private Catholic University, Linda Siefert Edd Jan 2002

Modeling The Effects Of Financial Aid On Student Enrollment Decisions: A Quantitative Case Study Of A Private Catholic University, Linda Siefert Edd

Dissertations

Over the last two decades, many institutions of higher education have experienced admissions-related problems due to fluctuations in student enrollment and the increasing need for institutional financial aid. Because of this, administrators need tools that can help them modify policy as the market changes. The purpose of this research was to develop a tool for a private, more selective institution that would answer the following questions: (1) what is the probability of enrollment for each admitted student, and (2) how would changes in the financial aid package affect this probability? The model in this research was based on both economic …

Bibliography Of Hate Materials, Elizabeth Thweatt Jan 2002

Bibliography Of Hate Materials, Elizabeth Thweatt

Journal of Hate Studies

Interest in working on this bibliography stems from involvement with the Collection Development Committee of the Institute for Action Against Hate at Gonzaga University as we sought to create a collection of materials to support study and research. Not being able to find a bibliography in print suggested that an annotated one would be valuable. Defining hate is problematic. Its scope is so broad that it touches almost all aspects of life and it dwells within the hearts and minds of each one of us. Although many of us cling subconsciously to it, hate harms and sometimes kills its victims. …

Peer Group Instructional Conversation: Collaboration In Context, Linda Greene Capalbo Jan 2002

Peer Group Instructional Conversation: Collaboration In Context, Linda Greene Capalbo

Open Access Dissertations

American schools traditionally have reflected and promoted societal values of autonomy and independence in the development of the individual child. This limited perspective on how humans come to know focuses on the accrued cultural capital of each learner and neglects the role of 'the other' in the construction of meaning. Such a view can be especially debilitating for students who have been identified as marginal learners. This study examines how social interaction organizes participation opportunities and strategies for members of a peer learning group, including a student designated language learning disabled. The study documents the development and negotiation of individual …

A Participant Observation Study Of Experienced Nurses' Presence In Daily Care, Paulette Anne Osterman Jan 2002

A Participant Observation Study Of Experienced Nurses' Presence In Daily Care, Paulette Anne Osterman

Open Access Dissertations

As important as presence is to nursing, it often lacks conceptual clarity and systematic empirical observation in nursing practice. However, in the few qualitative studies with presence as a focus researchers have not considered both nurse and patient in interaction in present time nor included the nature of the patient's perception of the nurse's presence. In an earlier project in a long-term care setting, nurses were observed to be present in more than one way (presence, partial presence, full presence, and transcendent presence). In addition, nurses' employed presence for assessing impending health care changes early in the shift, and used …
