The Communities That Make Standards Of Care Possible, Anita Bernstein
The Communities That Make Standards Of Care Possible, Anita Bernstein
Chicago-Kent Law Review
This Article argues that negligence law depends on "communities" in order to fulfill its agenda of promoting both security and freedom. Although many disciplines and discourses favor divergent understandings of the word "community," for purposes of the law the defining trait of community is group-based constraint. Communities can include various human aggregations. As far as the law understands this term, members need not have joined communities voluntarily, and the community need not have any leadership or power to change the lives of its members. Negligence law reaps benefits from the fact that certain groups exist. Their constraints make individuals less …
Posner's Pragmatism And Payton Home Arrests, Matthew A. Edwards
Posner's Pragmatism And Payton Home Arrests, Matthew A. Edwards
Washington Law Review
In recent years, Richard A. Posner, a respected federal appellate judge and prolific scholar, has been at the vanguard of a resurgence of interest in legal pragmatism. Posner and other scholars have called for judges to expand their horizons beyond conventional legal reasoning and to embrace interdisciplinary methodology and empirical research in the legal decisionmaking process. At the same time, however, prominent jurisprudential scholars have expressed both practical and philosophical objections to Posner's controversial prescription for increased judicial reliance on social science research. This Article seeks to explore the value and limits of Posner's pragmatism and empirical inquiry in the …

Legislating Apology: The Pros And Cons, Jonathan R. Cohen
Legislating Apology: The Pros And Cons, Jonathan R. Cohen
UF Law Faculty Publications
Should apologies be admissible into evidence as proof of fault in civil cases? While this question is a simple one, its potential ramifications are great, and legislative and scholarly interest in the admissibility of apologies has exploded. Shortly after the idea of excluding apologies from admissibility into evidence was raised in academic circles three years ago, it rapidly spread to the policy arena. For example, California and Florida enacted laws in 2000 and 2001 respectively excluding from admissibility apologetic expressions of sympathy ("I'm sorry that you are hurt") but not fault-admitting apologies ("I'm sorrythat I injured you") after accidents. Eight …

The Effects Of Family, Social And Background Factors On Children's Educational Attainment, Megan De Serf '02
The Effects Of Family, Social And Background Factors On Children's Educational Attainment, Megan De Serf '02
Honors Projects
In a perfect world, children of all races, socioeconomic backgrounds, and family types would not only have the opportunity to receive a higher education, but they would also take full advantage of these opportunities. The educational level of children in the ghettos of Chicago or St. Louis would be equal to their suburban counterparts. However, it is not a perfect world, and educational attainment of children and young adults from varying backgrounds differ greatly.
English Language Proficiency And The Earnings Of Mexican Immigrants, Jeremy Sanford '02
English Language Proficiency And The Earnings Of Mexican Immigrants, Jeremy Sanford '02
Honors Projects
Since 1965, the US has seen increasingly large numbers of immigrants crossing its borders. Indeed, more immigrants are arriving now than at any point in the past; the 1990's saw a higher number of immigrants enter the US than any previous decade (INS 1999). A disturbing corollary to the recent explosion in immigration is the corresponding decline of immigrant earnings relative to the earnings of natives. A cursory glance at the literature strongly suggests the changing national origin of immigrants as the main cause of this relative earnings decline. As a prime example, Mexican immigrants now outnumber any other national …

English Language Proficiency And The Earnings Of Mexican Immigrants, Jeremy Sandford '02
The Park Place Economist
This paper studies the effect of English language deficiency on the wage rates of Mexican immigrants. Using a sample of 81,059 labor market male Mexican immigrants taken from Census PUMS data, I find that the direct effect of English language deficiency on earnings is virtually nonexistent for immigrants with low education and experience levels. These results show that only immigrants with at least a high school education or some US labor market experience will make less than their immigrant counterparts who speak English very well.

Assessment of Student Learning Reports
In April of 2002, an online survey entitled “Assessment of Your Learning Experience: General Education” was administered via the Internet to UMM seniors. The Office of Institutional Research and Reporting in the Twin Cities coded the questionnaire into HTML format and prepared the statistical report. There were 138 responses to the survey. Satisfied Correctional Staff : A Review Of The Literature On The Correlates Of Correctional Staff Job Satisfaction, Eric G. Lambert, Nancy L. Hogan, Shannon M. Barton
Peer Reviewed Publications
During the past decade, there has been increasing pressure on correctional agencies to attract and keep quality staff. Raising worker job satisfaction is seen as a fundamental way of decreasing turnover. There has been a considerable amount of research in the area of the possible causes of correctional staff job satisfaction and, to a lesser extent, the possible consequences of job satisfaction. However, due to the numerous studies, some with conflicting results, it is difficult to understand clearly the factors associated with job satisfaction. A review of the literature is presented to provide a better understanding of correctional staff job …

Mechanical Angel: Carolyn Forché And The Material Projection Of Messianic History, Alan Clinton
Reconstruction: Studies in Contemporary Culture
[First paragraph]
The work of Carolyn Forché has always retained a political edge, with works such as the exploration of her Czech background in Gathering the Tribes (1976) and her account of visits to El Salvador in The Country Between Us (1981). Forché has been one of the leading poets who, in her own words, has combatted the self-censorship operative among American poets and writers that seemed to preclude writing about...historical events when those events were still unsafe (qtd. in Stein 147). Her third book of poems The Angel of History (published 13 years later), however, represents a new turn …

A Way With Words: A Unique Approach To Literacy And Career Development, Allyson D. Brathwaite
Special Topics, General
This article describes a unique collaboration between the Career Center at the University of Missouri-Columbia, Columbia Public Schools and the community. A WAY WITH WORDS is an "America Reads" community literacy program that has enriched the educational experience of graduate, undergraduate and K-5 students since 1996. Teams of undergraduate volunteers led by graduate students in Counseling Psychology and Educational Leadership (ELPA) tutor local children in an effort to increase literacy. The teams interact and communicate with children, parents, teachers and principals as they serve during school and in after-school programs that they co create with school administrators and community members. …
