System And Lifeworld In Habermas's Theory Of Law, Hugh Baxter

Jürgen Habermas's recent work on law and democracy divides into two parts. With his "discourse theory of law and democracy," Habermas seeks to explain the conditions under which modern constitutional legal and political orders may claim legitimacy. Here Habermas's method is primarily philosophical and legal-theoretical. The second part of the project - the part on which this article focuses - develops what Habermas calls his "communication theory of society." Here Habermas seeks to "translate" the normative conclusions of his discourse theory into a substantive social-theoretical model. Lima Technical College specializes in offering career technical education programs in business, engineering, health technologies, and human services. Because of the emphasis on technical education, the strategic plan of the college has identified the use of technology in the classroom as an important teaching methodology since 1992.
The problem was that there was a need to develop additional courses incorporating the use of technology as a teaching strategy into the nursing curriculum so that the program would continue to be considered for funding of future initiatives. Correlation Of Baccalaureate Nursing Students’ Portfolio Evaluation Scores With Other Measures Of Academic Performance, Karen A. Karlowicz

A portfolio evaluation tool had been created by undergraduate nursing faculty at Old Dominion University School of Nursing to enable student portfolios to be used as an adjunct method of program evaluation. While the tool was previously judged to have face validity and high inter-rater reliability, the lack of evidence to show that portfolio scores were comparable to other measures of academic performance used to determine the attainment of program outcomes was a problem. Thus, the purpose of this project was to investigate the extent to which portfolio evaluation scores correspond with other measures of academic performance.

Strategies And Techniques To Impact Teachers’ Ability To Improve Students’ Reading Skills, Helen E. Martinez

This study examines strategies and techniques intended to update 5th-grade target students’ reading skills at Our Lady of Victory (OLV) Catholic School. A comparative analysis of the reading comprehension subtest results from the Stanford Achievement Test of successive cohorts of OLV 4th-grade students showed a decline during the students’ 4th-grade year. An effort to identity this decline in performance led the researcher to possible factors: teacher quality and degree of parental involvement. To address this problem, Brandt, Farmer, and Buckmaster’s (1993) cognitive Apprenticeship Model program, in which instruction is modeled and adult learners gradually take responsibility for instructing young learners, …

Instructional practice at Bonny Eagle Middle School in Buxton, Maine, did not fully integrate IEP goals with curriculum and Maine Learning Results developed by the Maine Department of Education in 1997. Students with disabilities were prohibited from optimal learning experiences. In this study, the relationship between a sample group of students, language arts individual education plan goals, and curricular standards were attempted to be strengthened through enhanced instructional methodologies and assessments. The intended results of this study were to impact these students' levels of classroom involvement in addition to building collaboration among special and regular education teachers. Positive Attitudes Lead to Success: An Intervention Program for Elementary Discipline-Challenged Male Students
This dissertation describes the Positive Attitudes Lead to Success Club (PALS), a program designed to help 20 5th-grade male students in an elementary school of 760 students improve their behavior and achieve academic success. An analysis of the Discipline Report data for the last 3 years reveals that Campostella Elementary (CES) has had an unacceptable amount of referrals by the standards set forth by Norfolk Public Schools (NPS) for unacceptable behavior. These 20 students have received 80% of all referrals for the past school year. Such information …

This applied dissertation was developed to meet the use objective of a video teleconferencing room. The dissertation searched for an understanding into the perceptions, attitudes, and behaviors of corporate personnel toward using video teleconferencing to conduct business meetings. The applied dissertation was designed to report on a solution strategy for changing the perceptions, attitudes, and behaviors of corporate personnel to conduct efficient and effective business meetings using video teleconferencing as the delivery medium.

This dissertation was designed to provide better understanding of the student centered approach to learning and to assist teachers in operationalizing different approaches across the disciplines thereby overcoming the difficulties they previously encountered. The 15 Grade 7 teachers were not previously trained to use the student centered approach to learning. They were challenged in the various classes because the new curriculum is student centered. As a result, they found it difficult to identify creative ways to design dynamic learning environments that involve students in doing and thinking.

OBJECTIVE: To establish the prevalence of fear of fatness (the desire to be thinner) and associated factors, including obesity, reported energy, iron and folate intakes. The difficulties in defining overweight among Irish children and an assessment of dietary and socio-economic factors related to dental caries and also reported in the group. METHODS: A one-year follow up study of 251 healthy schoolchildren at baseline (119 boys and 132 girls; mean age 11 years) attending 7 fee-paying (6 single- and 1-mixed sex) and 8 non-fee-paying (4 single- and 4 mixed-sex) schools in Dublin city center. An individual's aging and human development always occur within a particular cultural context, but given the dominance of Western culture, the environment of non-Western societies is cross-cultural - it includes not only a non-Western dimension, but also Global and Western dimensions. The Western dimension is made up of those characteristics associated with Western societies, which are now found in non-Western societies, for example, Western education, healthcare services, and industrialization. The non-Western dimension, on the other hand, is made up of those attributes that are indigenous to the people, e.g., traditional healing. This issue of the Saint Louis University Law Journal traces, in some sense, to two events that occurred a quarter century ago. On February 6, 1977, Richard J. Childress, professor and former dean, of Saint Louis University School of Law died at the age of fifty-five. When Voluntary, Incentive-Based Controls Fail: Structuring A Regulatory Response To Agricultural Nonpoint Source Water Pollution, Douglas R. Williams

This article is part of the Symposium, Sustainable Agriculture: Food for the Future. Recognizing that, to date, farms had largely escaped regulation under the Clean Water Act, and that agricultural nonpoint source pollution is a leading contributor to impaired water quality, this article advocates for a regulatory response to such pollution. It considers existing programs to control nonpoint source pollution and demonstrates that they are inadequate. The article makes three recommendations: (1) an increased federal regulatory presence is needed; (2) the costs of implementing nonpoint source controls should be distributed in a pragmatic way that recognizes the extraordinary organizational presence …

Disability, Doctors And Dollars: Distinguishing The Three Faces Of Reasonable Accommodation, Elizabeth Pendo

Despite a decade of litigation, there is no consistent understanding of the reasonable accommodation requirement of Title I of the Americans with Disabilities Act of 1990 (the 'ADA'). Indeed, there are three inconsistent distributive outcomes that appear to comport with the reasonable accommodation requirement: cost-shifting, cost-sharing, and cost-avoidance.
One reason for such inconsistent outcomes is a failure to develop a coherent and consistent theory of disability. Because disability has been and continues to be medicalized, this Article takes a fresh look at the medical literature on health, illness, and disability. The engineering classification of karst defines various complexities of ground conditions, in terms of the hazards that they provide to potential construction. Karst is divided into five classes (from immature to extreme). The three key parameters within the classification are caves (size and extent), sinkholes (abundance and collapse frequency) and rockhead (profile and relief). As one component of karst, caves are a hazard to foundation integrity, though natural surface collapses over caves are extremely rare. A cave roof is normally stable under engineering loading where the roof thickness is greater than 70% of the cave width. Construction can proceed over …
