GW Law Faculty Publications & Other Works
This article reviews two books: Rulemaking, Participation and the Limits of Public Law in the USA and Europe by Theodora Th. Ziamou and Governing by Numbers by Edward C. Page. In Rulemaking, Ziamou compares the law of rulemaking in the United States, Germany, Greece, and England. Ziamou covers the distinction between administrative rules and other administrative acts, the constitutional law of rulemaking, rulemaking procedure, the ability of private organizations to adopt rules that bind themselves and third parties, and judicial review. Readers are left with a better understanding of American and European rulemaking but may not be convinced that Europe …

Sounding The Death Knell For In Loco Parentis, W. Burlette Carter
GW Law Faculty Publications & Other Works
The article examines the history of the regulation of student athletes playing intercollegiate athletics through the lens of the in loco parentis doctrine. It argues that the doctrine has been abandoned in the larger college and university context, but continues to survive in the intercollegiate arena. Part I investigates the role of the in loco parentis doctrine in early college and university life. Part II discusses the general demise of the doctrine in the 1960s and 1970s and the resulting expansion of freedoms that came to college and university students. Part III demonstrates how the doctrine is reflected in modern …

Abraham S. Fischler College of Education ETD Archive
In the Learning Enhanced Adult Degree (LEAD) program at Ohio Dominican College (ODC), a cohort based accelerated delivery format, students who complete the Associate of Science (AS.) degree had only one bachelor's degree program to choose from, the B.S. in Business Administration. Because Ohio Dominican is a bachelor degree granting institution, classified as Baccalaureate General by the Carnegie Commission, it is desirable to see all enrolled students through to the bachelor degree. The problem addressed by this practicum was that with only one degree program to choose from at the bachelor level, retention of AS. students who desired the accelerated …

In 1999, the Maryland Higher Education Commission (MHEC) had called into question the admission of students in the automotive and the heating, air conditioning, and refrigeration (HVAC) technology programs at Lincoln Technical Institute based on their admission scores. The problem under investigation was that it was unknown if there was a relationship between the minimum scores of those students in the automotive and HVAC technology programs who scored between 101-129 on the admissions test and their student outcomes (persistence and graduation versus withdrawal). The purpose of the study was to determine the effect of minimum admission scores on student outcomes. …

The Development Of A Workshop To Promote A Team Approach To Fundraising At Tri-County Community College, Terrie Kelly
Abraham S. Fischler College of Education ETD Archive
Tri-County Community College is operating in an environment of severe economic hardship, just at a time when the college community needs the college the most. The state of North Carolina is grappling with a projected 900 million dollar budget shortfall (McKnight, 2002). This fiscal year, all North Carolina community college budgets have suffered a four percent budget reversion with another reversion of up to eight per cent expected before the year ends (North Carolina Association for Community College Presidents, 2002).
At the same time, Tri-County Community College enrollment has soared due to several manufacturing plant closures. Since the year 2000, …

A Study To Determine The Relationship Between Where African American Students Graduated High School In New Jersey And Their Participation In Co-Curricular Activities In College, Jocelyn D. Briddell
Abraham S. Fischler College of Education ETD Archive
African American women at Douglass College do not seem to be involved in mainstream campus organizations and activities. It has been suggested the students who come from urban areas in New Jersey are less involved in co-curricular activities because of a lack of state funding. Therefore, the purpose of this study is to determine whether there is a relationship between where African American Douglass women graduated from high school in New Jersey and their participation in co-curricular activities.
There was one research question for this study: Is there a relationship between student participation in co-curricular activities based upon whether the …

Abraham S. Fischler College of Education ETD Archive
Lima Technical College specializes in offering career technical education programs in business, engineering, health technologies, and human services. Because of the emphasis on technical education, the strategic plan of the college has identified the use of technology in the classroom as an important teaching methodology since 1992.
The problem was that there was a need to develop additional courses incorporating the use of technology as a teaching strategy into the nursing curriculum so that the program would continue to be considered for funding of future initiatives. Senior administrators, at the College stated that unless nursing faculty members designed ways to …

Development Of A Handbook For Implementing Distance Learning Programs At Mcintosh College, James K. Dowding
Abraham S. Fischler College of Education ETD Archive
As the world of higher education is abuzz with the concept of distance education and online courses, many colleges see the Internet as the goose that lays the golden egg. McIntosh College and the Career Education Corporation would also like to develop on-line and distance education programs. The key to developing a successful program requires a comprehensive process model to follow. The problem is that McIntosh College does not have a procedure to develop online courses or online supplements.
The need for distance education comes from several factors. First is the changing profile of students. As McIntosh College has grown, …

Abraham S. Fischler College of Education ETD Archive
In 1997 a Nursing Computer Learning Resource Laboratory (NCLRL) was established 2 for nursing students at Contra Costa College (CCC) by the nursing faculty to serve as a resource to help support the students in their studies. Prior to the establishment of the NCLRL the nursing program did not have computer equipment or nursing software available for student use. The lack of a NCLRL placed the nursing program at CCC behind other San Francisco Bay area and national nursing programs in using computer technology and computer-assisted instruction to enhance nursing student education and as an attraction for new and potential …

Abraham S. Fischler College of Education ETD Archive
The Assemblies of God (AOG) in Victoria is a diverse fellowship of Churches, ministers, and non-Church organizations. The fellowship has been growing in numbers and diversity significantly over the last 20 years. This diversity has made it increasingly difficult to run training programs that are relevant to individual needs. The problem is that the perceived professional development needs of AOG in Victoria ministers are unknown. It is also unknown if past professional development programs have met the perceived needs of the ministers.
The purpose of this study was to evaluate the perceived needs of credentialed ministers of the AOG in …

A Comparison Of Perceived Social Responsibility Standards With Perceived Social Responsibility Performance In The Australian Banking Industry : A Stakeholder Analysis, William J. Phillips
Theses: Doctorates and Masters
The purpose of this study is to investigate extent to which Australian banking corporations embrace social responsibility. It endeavours to establish the meaning of social responsibility generally and corporate social responsibility (CSR) in particular. In view of the multiple definitions of the concept of ‘social responsibility’ offered by various authors Such.1 Boatright (1993), Freeman (1994), Walters (1977), and Wheeler (1998), the views of power dependent Australian bank stakeholders were solicited to form an operational definition for the study. This created a collective conception of social responsibility as it is applied to Australian banks, allowing corporate social responsibility standards to be …

Designing A Framework For The Alignment Of E-Business Strategy And Consultant Engagement Processes For Australian Smes : A Cross-Case Analysis, Shirley A. Bode
Theses: Doctorates and Masters
The majority of SMEs have neither the internal expertise nor financial resources to enable in-house development of electronic commerce and therefore turn to the services of website design consultants to assist them. Unfortunately, they often engage consultants without any clear idea of their intended e-business strategy and without due care as to effective engagement processes. This frequently leads to ineffective e-business development and a highly disaffected group of small entrepreneurs. The study suggests that there is a significant gap between the intended strategies of SMEs and the actual e-business strategy implemented. The study aimed to investigate the relationship between Australian …

Theses: Doctorates and Masters
The thesis establishes the contribution to feminism and the peace of Western Australian broadcaster, (Dr.) Irene Greenwood (AM). In spite of efforts by organised peace groups to persuade governments of the social, political and environmental consequences of violence and warfare, ours is still a violent and war-torn world. In a global climate where violence and warfare are the media’s currency, Irene Greenwood’s broadcasting career provides opportunities to explore the historical connections …
Home And Away: The Tourist, The Flâneur And Everyday Life, John S. Gates
Home And Away: The Tourist, The Flâneur And Everyday Life, John S. Gates
Theses: Doctorates and Masters
This thesis examines the role and status of the tourist in the present day. It argues that the tourist, and the touristic experience, is emblematic of the consumption-based economy of late capitalism. It analyses tourism as a practice of, rather than opposed to, everyday life, for many subjects in late-capitalist Western society. The argument is developed by comparing and contrasting the tourist with the flâneur. The flâneur is regarded as a representative subjectivity of early modernity who developed visual and spatial practices, methodologies of movement and observation, which interpreted the city. The tourist's relationship with the global spaces of the …

Church, Chapel And Clergy In Margaret Oliphant's Chronicles Of Carlingford, Karen A. King
Church, Chapel And Clergy In Margaret Oliphant's Chronicles Of Carlingford, Karen A. King
Theses: Doctorates and Masters
This thesis examines the fictional works of Magaret Oliphant’s Chronicles of Carlingford in order to explain her understanding of the significance of Church and Chapel communities and their clergymen within an insular and atypical provincial community in mid-nineteenth century England. By drawing on a variety of examples in the novels and in real life, the thesis argues that Oliphant was a serious commentator on religious matters and controversies and not just a teller of tales. The thesis will address the significance of Oliphant’s engagement with a range of religious and social matters concerning the Church of England with a qualified …

How Green Is Your Hotel? : An Examination Of Environmentally Friendly Practices Of The Phuket Hotel Industry, Aungkan Thongkao
Theses: Doctorates and Masters
The global hospitality industry is currently facing many challenges from the external business environment. These include the effects of global recession, a downturn in overall trade and an increased demand for service excellence from a much more quality conscious clientele. A more recent challenge, however, relates to an increase in global awareness of environmental issues. Contemporary consumers require goods and services to be produced, or delivered, in environmentally friendly ways. As a result, managers are being forced to reconsider their business strategies and activities. Indeed a wide range of industries has already responded to consumers' dictates on conservation issues. Insertion of source text (henceforth: ST) acronyms and single words/terms (henceforth: item/s) into target text (henceforth: TT) is relatively, so far, a neglected issue in translation studies. In the case of translating a text from English into Modern Standard Arabic (henceforth MSA) in Australia, we are dealing with the issue of inserting an item of a source text (English source text, henceforth EST) into a target text (Arabic target text, henceforth ArTT). The ArTT has newly introduced items in their Roman Letters (henceforth R.I), The ArTT has newly introduced items in their Roman letters (henceforth R.I), transliterated and/or translated with …
Cross-Cultural Pragmatics: Politeness For The Customer In Spoken Aspects Of Service In The Restaurant In Australian English And Japanese, Chieko Imaeda
Theses: Doctorates and Masters
In listening to members of different cultures, it is possible to feel bad, even while recognising that the speaker is trying to speak politely. Sometimes we do not feel very comfortable with someone else’s speech, even though their expressions might be very polite with the choice of specific linguistic forms to show a high level of formality such as terms of address and specific types of formulaic expression such as ' I (don 't) think ... ' or ' I (don't) believe' . The speaker may be intending to speak politely in a considerate way. But the hearer's reaction may …
