Redistricting In A Post-Shaw Era: A Small Treatise Accompanied By Districting Guidelines For Legislators, Litigants, And Courts, Katharine Inglis Butler Jan 2002

Redistricting In A Post-Shaw Era: A Small Treatise Accompanied By Districting Guidelines For Legislators, Litigants, And Courts, Katharine Inglis Butler

University of Richmond Law Review

Legislators in jurisdictions with even modest minority populations will find adopting a challenge-resistant redistricting plan to be more difficult than ever before. The problem is how much consideration to give to race. Too little consideration may produce a plan subject to challenge under the Voting Rights Act (the "Act"). Too much consideration may produce a plan subject to challenge on constitutional grounds.

Norms And Signals: Some Skeptical Observations, Paul G. Mahoney Jan 2002

Norms And Signals: Some Skeptical Observations, Paul G. Mahoney

University of Richmond Law Review

Law and Social Norms is just what the growing field of norms scholarship needed. Legal scholars have generated an impressive body of observations about the myriad situations in which individuals pressure one another to act civilly. Eric Posner's book provides a simple, elegant model with very few working parts and promises to go a long way toward connecting these observations to form a coherent whole.

Defending The Jackson Purchase: The History Of Camp Beauregard, Kentucky, Dieter C. Ullrich Jan 2002

Defending The Jackson Purchase: The History Of Camp Beauregard, Kentucky, Dieter C. Ullrich

Faculty Research at Morehead State University

The series of events that led to the creation of Camp Beauregard was initiated on September 3, 1861, as Confederate forces under Brigadier General Gideon Pillow entered Kentucky from Tennessee to secure the riverport cities of Hickman and Columbus. In response, Union forces under Brigadier General Ulysses S. Grant crossed the Ohio River and seized Paducah on September 6. The following day Confederate Major General Leonidas Polk issued orders to organize troops into field brigades in preparation for a Union advance upon Columbus. For the next two weeks both sides began to build earthworks and position artillery to fortify their …

The Paradox Of Auxiliary Rights: The Privilege Against Self-Incrimination And The Right To Keep And Bear Arms, Michael S. Green Jan 2002

The Paradox Of Auxiliary Rights: The Privilege Against Self-Incrimination And The Right To Keep And Bear Arms, Michael S. Green

Faculty Publications

According to Locke's theory of the social contract, which was widely accepted by the Founders, political authority is limited by those natural moral rights that individuals reserve against the government. In this Article, I argue that Locke's theory generates paradoxical conclusions concerning the government's authority over civil disobedients, that is, people who resist the government because they believe it is violating reserved moral rights. If the government lacks the authority to compel the civil disobedient to abide by its laws, the result is anarchism: The limits on governmental authority are whatever each individual says they are. If the government has …

Philosophizing With Teenagers, Susan Verducci Jan 2002

Philosophizing With Teenagers, Susan Verducci

Faculty Publications

Part of a special section on connecting with adolescents. Although few adolescents are ever formally exposed to philosophy at middle or high school, almost all are philosophers in the sense that they ask and seek answers to questions that are fundamentally philosophical. Furthermore, studying philosophy can be quite useful for adolescents as it requires that they practice developing clear and coherent reasons for believing or doing something, provides the tools with which they can follow the logic of any ideological stance, and provides models of alternative answers and a way of examining how the historical period in which one lives …

Changing The Quality Of Conflict Interaction: The Principles And Practice Of Transformative Mediation, Robert A. Baruch Bush, Sally Ganong Pope

Hofstra Law Faculty Scholarship

Many practitioners now identify themselves as transformative mediators, who practice from the transformative perspective in some or all of their work. This article explains the unique character of transformative mediation by offering answers to three basic questions: Why is transformative mediation being sought and used by parties in conflict? What is the basic nature of the mediation process, especially the mediator's role, according to this model? How does a mediator work with the parties in transformative mediation? Answering these three questions why, what and how-will provide the reader a good overview of the transformative model in theory and practice. We …

How Does The Community Feel About Problem-Solving Courts?, Michele Bertran, Mary Barr, Charles Grodin, Monroe H. Freedman, Jacqueline Nolan-Haley

Hofstra Law Faculty Scholarship

When I was a young man, I was doing a lot of civil rights, civil liberties, and indigent criminal defense work, and I believed in the constitutionalized adversarial system. I believed in the constitutional rights of the Fifth Amendment and the Sixth Amendment, due process of law, the right to the effective assistance of counsel, the right to trial including an advocate who was going to be your champion against a hostile world.

I believed in the standard of proof beyond a reasonable doubt. I believed in the right to confront witnesses against you, the privilege against self-incrimination, equal protection …

Investigation Into The Control Of An Upper-Limb Myoelectric Prosthesis, Steven Michael Roberts Jan 2002

Investigation Into The Control Of An Upper-Limb Myoelectric Prosthesis, Steven Michael Roberts

School of Engineering, Computing and Mathematics Theses

This thesis presents research that extends current knowledge in the area of upper-limb prosthesis design and control. A study of myoelectric signals (MES)'s using both NHS and other equipment has resulted in identification of the signal source and transmission/detection issues. A globally comprehensive and up to date survey of myoelectric research has revealed new and long-term research paths. This thesis challenges the old model in interpreting the MES signals by providing and collecting evidence to suggest a new approach to future investigation. The historical description of a stochastic, non-deterministic MES has been shown by this research to be incomplete. An …

Digital Watermarking For Compact Discs And Their Effect On The Error Correction System, Kay Rydyger Jan 2002

Digital Watermarking For Compact Discs And Their Effect On The Error Correction System, Kay Rydyger

School of Engineering, Computing and Mathematics Theses

A new technique, based on current compact disc technology, to image the transparent surface of a compact disc, or additionally the reflective information layer, has been designed, implemented and evaluated. This technique (image capture technique) has been tested and successfully applied to the detection of mechanically introduced compact disc watermarks and biometrical information with a resolution of 1.6um x l4um. Software has been written which, when used with the image capture technique, recognises a compact disc based on its error distribution. The software detects digital watermarks which cause either laser signal distortions or decoding error events. Watermarks serve as secure …

Evaluation Of Lntelligent Medical Systems, Julian Bernard Tilbury Jan 2002

Evaluation Of Lntelligent Medical Systems, Julian Bernard Tilbury

School of Engineering, Computing and Mathematics Theses

This thesis presents novel, robust, analytic and algorithmic methods for calculating Bayesian posterior intervals of receiver operating characteristic (ROC) curves and confusion matrices used for the evaluation of intelligent medical systems tested with small amounts of data. Intelligent medical systems are potentially important in encapsulating rare and valuable medical expertise and making it more widely available. The evaluation of intelligent medical systems must make sure that such systems are safe and cost effective. To ensure systems are safe and perform at expert level they must be tested against human experts. Human experts are rare and busy which often severely restricts …

A Generic Network And System Management Framework, Martin Hans Knahl Jan 2002

A Generic Network And System Management Framework, Martin Hans Knahl

School of Engineering, Computing and Mathematics Theses

Networks and distributed systems have formed the basis of an ongoing communications revolution that has led to the genesis of a wide variety of services. The constantly increasing size and complexity of these systems does not come without problems. In some organisations, the deployment of Information Technology has reached a state where the benefits from downsizing and rightsizing by adding new services are undermined by the effort required to keep the system running. Management of networks and distributed systems in general has a straightforward goal: to provide a productive environment in which work can be performed effectively. The work required …

Linking Performance Requirements With Process Improvement Actions For Business Process Re-Design, Cita Lorraine Wood Jan 2002

Linking Performance Requirements With Process Improvement Actions For Business Process Re-Design, Cita Lorraine Wood

School of Engineering, Computing and Mathematics Theses

This thesis presents research that extends current knowledge in the area of business process re-design, with a specific focus on the 'Make Product' process within manufacturing organisations. Current business process re-design approaches offer only limited guidance on the specific changes that can be made to a process when re-designing it to achieve the desired performance improvements and often overlook any strategically derived performance requirements when re-designing the process. Case experience suggests that practitioners do not consider the performance requirements of their business processes when re-designing them and that the actions they take to achieve performance improvements are not selected with …

Precision Control Of A Sensorless Brushless Direct Current Motor System, Matthew John Knight Jan 2002

Precision Control Of A Sensorless Brushless Direct Current Motor System, Matthew John Knight

School of Engineering, Computing and Mathematics Theses

Sensorless control strategies were first suggested well over a decade ago with the aim of reducing the size, weight and unit cost of electrically actuated servo systems. The resulting algorithms have been successfully applied to the induction and synchronous motor families in applications where control of armature speeds above approximately one hundred revolutions per minute is desired. However, sensorless position control remains problematic. This thesis provides an in depth investigation into sensorless motor control strategies for high precision motion control applications. Specifically, methods of achieving control of position and very low speed thresholds are investigated. The developed grey box identification …

After/Word(S): 'Violations Of Human Dignity' And Postmodern International Law, Barbara Stark Jan 2002

After/Word(S): 'Violations Of Human Dignity' And Postmodern International Law, Barbara Stark

Hofstra Law Faculty Scholarship

"Never again!" was the crie de coeur of the world leaders after World War II. "Never again" would they tolerate death camps, mass graves, or other crimes against humanity. Several genocides later, however, the phrase has become ironic. Innumerable international as well as national laws have been enacted, but they have failed to stop the carnage. This was the subject of a recent symposium in the American Journal of International Law, which assembled some of the leading minds in international law to analyze the problem from seven different perspectives. Postmodern International Law (PIL) was not among them.

As this Article …

Use And Limits Of Syllogistic Reasoning In Briefing Cases, Wilson R. Huhn Jan 2002

Use And Limits Of Syllogistic Reasoning In Briefing Cases, Wilson R. Huhn

Akron Law Faculty Publications

During the nineteenth century, law was equated with science, and legal reasoning was thought to be a species of deductive logic. Consistent with this notion, judicial opinions have traditionally been summarized in the form of syllogisms, that is, as arguments of deductive logic. More specifically, judicial opinions have been described as chains of syllogisms, reasoning from base premises to ultimate conclusions. The principal thrust of this article is to demonstrate that in hard cases, judicial reasoning proceeds not by way of deduction, but by evaluation and balancing.

Accordingly, Part II of this article compares law with science. Historically, law was …
