The Potential For Public Opinion To Generate Change In Policy Formation, Peter M. Roguszka
The Potential For Public Opinion To Generate Change In Policy Formation, Peter M. Roguszka
Theses
Towards the end of the Twentieth Century there were a number of examples of change to public policy that were not the product of political debate and public consideration. Rather, they appear to have originated in another less visible, and therefore less open to critique manner. It is argued that it is changes to the general thrust of public opinion that have given validity to these policy changes. The ways in which changes to public opinion are caused to change and by whom are investigated and a theory of 'Australian Public Opinion Change' is developed. This theory is applied to …

Conceptions Of The Corporation And The Prospects Of Sustainable Peace, Jeffrey Nesteruk
Conceptions Of The Corporation And The Prospects Of Sustainable Peace, Jeffrey Nesteruk
Vanderbilt Journal of Transnational Law
This Article examines the role of corporate law in promoting sustainable peace. The Author argues that corporate legal theory can make a distinctive contribution to a more peaceful world by exposing some deeper roots of corporate law doctrines. Beginning with a brief overview of the corporation in legal discourse, the Article addresses the corporation as property, person, contract, and community. Next, the Article explores the significance of legal language, detailing the ways the law, through language, constructs and impacts the "character," "culture," and "community" of society. The Article then analyzes the dominance that the property and contract conceptions of the …
Global Antitrust And The Evolution Of An International Standard, William Sugden
Global Antitrust And The Evolution Of An International Standard, William Sugden
Vanderbilt Journal of Transnational Law
This Note explores recommendations for developing a global antitrust regime and ultimately rejects those suggestions in favor of more traditional nationally-based applications of antitrust rules. Part II introduces an economic model of global antitrust to show the systemic difficulties inherent in creating a global regime. Part III contrasts the difficulties in creating a global regime with the greater historical success of developing regional antitrust authorities. Part IV tracks the history of the extraterritorial application of antitrust laws by the United States and the European Union. Part V argues that the path to effective global antitrust lies not in the creation …
Spontaneous Tax Coordination: On Adopting A Comparative Approach To Reforming The U.S. International Tax Regime, Anthony C. Infanti
Spontaneous Tax Coordination: On Adopting A Comparative Approach To Reforming The U.S. International Tax Regime, Anthony C. Infanti
Vanderbilt Journal of Transnational Law
The excessive complexity of the U.S. international tax regime is well documented. Although many commentators have cited the need for simplification, their proposals often maximize other policy goals at the expense of simplicity. Even reform proposals aimed principally at clarifying the tax code are ordinarily focused on the "internal" complexity of the code, seeking improvements only for U.S. taxpayers struggling with a single complex provision of the code or the baffling interaction, of two U.S. rules. This Article focuses on the interaction between U.S. tax law and the rules of other nations, and is intended to illustrate the benefits that …

Colombian Army Adaptation To Farc Insurgency, Thomas A. Marks Dr.
Colombian Army Adaptation To Farc Insurgency, Thomas A. Marks Dr.
Books, Monographs & Collaborative Studies
The author points out that Revolutionary Armed Forces of Colombia (FARC) insurgents actively are pursuing a strategy to mobilize the disaffected and disposed people of Colombia, and to control the entire national territory. At the same time, he argues that no one in the national political establishment has taken the initiative to conduct an appropriate effort to deny FARC its objective. As a result, the Colombian Army has been left alone to direct the fight, without a coordinated and integrated national campaign plan or other resources that would allow for success. The author concludes that the Army has bought time, …
The Intervention Debate: Towards A Posture Of Principled Judgment, John Garofano Dr.
The Intervention Debate: Towards A Posture Of Principled Judgment, John Garofano Dr.
Books, Monographs & Collaborative Studies
The author argues that American policymakers must take an approach based on "principled judgment" when deciding on the use of force. The 1990s showed the extremes of deciding when and how to use force, one of the central elements of strategy. Throughout American history, debate has raged over whether force is appropriate only in defense of the homeland and vital national interests or whether it should also be used to promote more expansive objectives like regional security and stopping humanitarian disasters in regions with few tangible U.S. interests. He concludes with a discussion of Army roles and requirements for future …

Geostatistical Analysis Of The Small-Scale Distribution Of European Corn Borer (Lepidoptera: Crambidae) Larvae And Damage In Whorl Stage Corn, Robert J. Wright, Terry A. Devries, Linda J. Young, Keith J. Jarvi, Ronald C. Seymour
Department of Entomology: Faculty Publications
The small-scale spatial distribution of European corn borer, Ostrinia nubilalis (Hübner), larvae and damage in whorl stage corn, Zea mays L., was characterized using geostatistics. Spatial distribution of O. nubilalis larval feeding damage was studied at Clay Center, North Platte, and Concord, NE, during June-July 1992-1994, and spatial distribution of O. nubilalis larvae and damage was studied at Clay Center in June 1997. Semivariograms were calculated to model the change in spatial correlation with increasing distance between samples. Spatial distribution of larval damage during 1992-1994 was best described using a spherical model. Damage was spatially correlated among plants at distances …

Reduction Of Moniliformin During Alkaline Cooking Of Corn, Graciela Pineda-Valdes, Dojin Ryu, David S. Jackson, Lloyd B. Bullerman
Department of Food Science and Technology: Faculty Publications
The incidence of moniliformin (MON) producing Fusarium spp. in selected corn (Zea mays L.) samples from Mexico and the United States and the effects of alkaline cooking and the tortilla manufacturing processes on the reduction of MON were determined. The percentage of infected kernels with Fusariumspp. ranged from 0 to 22% in eight food-grade corn samples, including six from Mexico and two from the United States. Complete (100%) reduction of MON was observed when a naturally contaminated com sample containing 1.4 µg of MON/g of corn was used in a pilot-scale alkaline cooking and tortilla manufacturing process. In …

Alcohol And Young People: Promoting Benefits And Reducing Risks, Ian Newman
Alcohol And Young People: Promoting Benefits And Reducing Risks, Ian Newman
Department of Educational Psychology: Faculty Publications
For young people, alcohol used in ways prescribed by tradition and indigenous practices are suggested to be of lower risk than those encouraged by modem marketing and western images. Data from the USA and China are presented and discussed to support this hypothesis. Limited data suggest Chinese adolescents may be adopting higher-risk Western-style drinking practices and moving away from traditional drinking styles. It is suggested that policies which promote traditional and indigenous alcohol use should be encouraged and high-risk Western-style drinking practices discouraged.
Assemblages Of Breeding Birds As Indicators Of Grassland Condition, Sharon Freshman Browder, Douglas H. Johnson, I. J. Ball
Assemblages Of Breeding Birds As Indicators Of Grassland Condition, Sharon Freshman Browder, Douglas H. Johnson, I. J. Ball
United States Geological Survey, Northern Prairie Wildlife Research Center: Publications
We developed a measure of biological integrity for grasslands (GI) based on the most influential habitat types in the Prairie Pothole Region of North Dakota. GI is based on proportions of habitat types and the relationships of these habitat types to breeding birds. Habitat types were identified by digital aerial photography, verified on the ground, and quantified using GIS. We then developed an index to GI based on the presence or abundance of breeding bird species. Species abundance data were obtained from 3 min roadside point counts at 889 points in 44, 4050 ha study plots over a 2-year period. …

Spotted Knapweed, J. Story
United States Department of Agriculture, Forest Service / University of Nebraska-Lincoln: Faculty Publications
Spotted knapweed, Centaurea maculosa Lamarck, is a purple-flowered, herbaceous, perennial weed, living three to five years on average. It infests semiarid range lands in the western United States and roadsides and fields in the eastern part of the country. Infested areas are dominated by the plant, reducing their grazing value and suppressing native plant communities. The plant, originally from Central Asia, has been in North America for over 120 years.

Swallow-Worts, L. Tewksbury, R. Casagrande, A. Gassmann
United States Department of Agriculture, Forest Service / University of Nebraska-Lincoln: Faculty Publications
There are three European species of swallow-worts found in North America: Vincetoxicum nigrum (L.) Moench (black swallow-wort), Vincetoxicum rossicum (Kleo.) Barb. (pale swallow-wort or dog strangling-vine), and Vincetoxicum hirundinaria Medik. (white swallow-wort) (Sheeley and Raynal, 1996). Swallow-worts are in the family Asclepiadaceae. Vincetoxicum nigrum and V. rossicum now are naturalized in northeastern North America, and both are invasive in natural areas and abandoned pastures (Lawlor, 2000). Swallow-worts are found in gardens and fields, along fencerows, roadways, grassy slopes, wooded edges, and streambanks. Tangled masses of swallow-wort vines shade and suppress native plants (Sheeley and Raynal, 1996). In Rhode Island, heavy …
