The Lawyers' Role In Selecting The President: A Complete Legal History Of The 2000 Election, Lynne H. Rambo

Faculty Scholarship

This Article presents the factual and legal history of Bush v. Gore, in the detail that is warranted for a case of this magnitude and complexity. Part One sets forth the legal framework within which the case unfolded, acquainting the reader with the breadth of Florida and federal law that governed the controversy. Part Two reviews what happened--the factual and legal developments from the time Gore requested manual counts in four Florida counties through the Supreme Court's decision ending the statewide recount the Florida Supreme Court had ordered--and focuses on the attorneys' arguments at each stage. Part Three then …

Disputants' Decision Control In Court-Connected Mediation: A Hollow Promise Without Procedural Justice, Nancy A. Welsh Jan 2002

Disputants' Decision Control In Court-Connected Mediation: A Hollow Promise Without Procedural Justice, Nancy A. Welsh

Faculty Scholarship

Professor Deborah Hensler suggests in the lead article of this Symposium issue that the courts' embrace of facilitative, interest-based mediation may have been ill-conceived. She argues that there is insufficient evidence to conclude that litigants are more satisfied with mediation than with adjudicative alternatives such as arbitration and trial. She also urges that there is sufficient evidence to show that litigants prefer processes that vest decision control in third parties. Both of these assertions are subject to challenge,' but this Comment will focus upon the significance of giving decision control to the disputants in consensual processes.

Using available research, this …

Land Use, Environmental Quality And Public Policy: Interactions And Implications For Agricultural Sustainability., Ramkumar Bendapudi Jan 2002

Land Use, Environmental Quality And Public Policy: Interactions And Implications For Agricultural Sustainability., Ramkumar Bendapudi

Graduate Theses, Dissertations, and Problem Reports (ETD)

Population growth, combined with economic growth have been primary causes of urban sprawl and increased pressure on natural resources. Urban development often adversely affects land, water and air quality. Although not considered a threat to the nation's food production, land development and urbanization are critical issues because they can lead to fragmentation of agricultural and forest lands, loss of prime farmland, wildlife habitat and other resources, additional infrastructure costs for communities and regional authorities, and competition for water. These losses raise concerns about sustainability of land and agriculture. Various state-sponsored programs such as Purchase of Developmental Rights and Transfer of …

Stereotypes, Intolerance, And Policy Supports For Women, Minorities, And Gays: The Diversity Course Impact On Students Pursuing Higher Education In The Sreb States., Christine J. Brehm Jan 2002

Stereotypes, Intolerance, And Policy Supports For Women, Minorities, And Gays: The Diversity Course Impact On Students Pursuing Higher Education In The Sreb States., Christine J. Brehm

Graduate Theses, Dissertations, and Problem Reports (ETD)

Problematic stereotyping of women, minorities, and gays in the United States may become justification for prejudicial attitudes that lead to political intolerance toward members of these marginalized groups. While images of others and a sense of political tolerance develop through childhood and preadult socialization, education beyond high school can have a significant impact on one's reliance on stereotypes when considering the granting or withholding of basic civil rights from marginalized members of society, and may also affect the position one takes towards policies created to benefit women, minorities, and gays. During the fall semester of 2000, an investigation of these …

Sowing Barren Ground: Constructions Of Motherhood, The Body, And Subjectivity In American Women's Writing, 1928-1948., Virginia Blanton Broaddus Jan 2002

Sowing Barren Ground: Constructions Of Motherhood, The Body, And Subjectivity In American Women's Writing, 1928-1948., Virginia Blanton Broaddus

Graduate Theses, Dissertations, and Problem Reports (ETD)

This project considers the demands American women confront about their societal roles, particularly cultural discourses that urge women to become biological mothers. These discourses become especially compelling during eras when women transgress ideological boundaries, leaving the constructed domestic space and taking places in the public sphere. I analyze responses to these discourses as they are manifested in literature written between 1928 and 1948 as well as in the late twentieth century. My analysis, informed by cultural studies and feminist theory, depends upon my use of intersubjectivity theory, particularly as articulated by Jessica Benjamin. I discuss the role of the body …

A Helping Hand?: The United States, "Questions Of The Far East," & The Washington Conference, 1921-1922., David R. Buck Jan 2002

A Helping Hand?: The United States, "Questions Of The Far East," & The Washington Conference, 1921-1922., David R. Buck

Graduate Theses, Dissertations, and Problem Reports (ETD)

By examining in detail the conference records as well as a variety of personal collections and writings, this dissertation investigates the U.S. role at the Washington Conference, 1921-22, specifically the forgotten aspects of the “Questions of the Far East.” Historians have traditionally focused on the Five-Power Treaty (limitation of naval armaments) or the Four-Power Treaty (alliance in East Asia). So prominent has been this focus that some scholars have contended that the conference produced a so-called Washington system, which replaced the existing imperialist system and defined East Asian relations throughout the 1920s. Yet, the conference also produced the Nine-Power Treaty …

Why National Missile Defense: A Test Of Three Competing Models., Christopher Lee Campbell Jan 2002

Why National Missile Defense: A Test Of Three Competing Models., Christopher Lee Campbell

Graduate Theses, Dissertations, and Problem Reports (ETD)

This dissertation seeks to answer the question of why the United States is pursuing the deployment of a national missile defense (NMD) system at the present time. The explanation most often given by national security policy makers is that it is being constructed in response to the weapons programs of “rogue states.” States such as North Korea, Iran, and Iraq are seen as actively developing weapons of mass destruction (WMD) and the capability to deliver these weapons to the U.S. mainland. However, the proposal of this system poses problems. First, it has made many U.S. allies fear that its foreign …

Birch Rod To Arsenal: A Study Of The Naval Ordnance Plant At South Charleston, West Virginia And The Search For A Government Industrial Policy., Joe Hardin Camp Jan 2002

Birch Rod To Arsenal: A Study Of The Naval Ordnance Plant At South Charleston, West Virginia And The Search For A Government Industrial Policy., Joe Hardin Camp

Graduate Theses, Dissertations, and Problem Reports (ETD)

In 1917, the Navy Department authorized a factory to manufacture battleship armor plate. Although the plant failed in its intended purpose, its example reflected both the government's search for a way to regulate the growth of monopoly and cartels, and the changing face of military-industrial relations. Difficulties with the steel industry began in the late 1800s, but the influence of Wilsonian “New Freedom,” precedents for government ordnance manufacture established by Navy Secretary Josephus Daniels, and attachment to the 1916 naval build program, helped assure the armor plant's construction. Franklin Roosevelt's experience in the Navy Department under Daniels, provided continuity of …

The Efficacy Of A Media Literacy Program For The Prevention And Treatment Of Eating Disturbances: Implications For The Continuum Model Of Eating Disorders., Janelle Wilder Coughlin Jan 2002

The Efficacy Of A Media Literacy Program For The Prevention And Treatment Of Eating Disturbances: Implications For The Continuum Model Of Eating Disorders., Janelle Wilder Coughlin

Graduate Theses, Dissertations, and Problem Reports (ETD)

The purpose of the current study was to determine whether a two-session media literacy program, A.R.M.E.D. (Acknowledging and Rejecting the Media's Influence on Eating and Body Image Disturbances), was an effective intervention for individuals who fell at various points on the eating disorder continuum. Ninety-three female college students participated in the study, with 46 experimental participants attending A.R.M.E.D and 47 participants serving as a control group. Between-subjects analyses did not reveal differences between the experimental and control group on each of the seven dependent variables. Within-subjects repeated measures analyses did, however, reveal that women who attended A.R.M.E.D. significantly reduced their …

The Effect Of Student Verses Teacher Instruction On Motor Skill Acquisition., Mary Ann Deluca Jan 2002

The Effect Of Student Verses Teacher Instruction On Motor Skill Acquisition., Mary Ann Deluca

Graduate Theses, Dissertations, and Problem Reports (ETD)

The primary purpose of this analysis was to evaluate whether student assistants in the gymnasium could assist the teacher in improving skill development. In this study, six novice students were chosen from a 5 th grade class based on scores from a pretest of juggling catches and cascades. One other fifth grade student from the same class was chosen as a student assistant by the physical education teacher based on leadership, maturation, respect, and maturity. Six single case studies were conducted for approximately 16 days. Supplementary dependent variables such as feedback, verbal cues, and modeling were also examined. These dependent …

The Great Awakening And Religious Freedom., Heather Cunningham Jan 2002

The Great Awakening And Religious Freedom., Heather Cunningham

Graduate Theses, Dissertations, and Problem Reports (ETD)

The first Great Awakening was a series of revivals which spread through England’s mainland colonies in the mid eighteenth century. These revivals sparked the growth of sects, such as Baptists and Quakers who believed in religious freedom and separation of church and state. The growth of these sects brought a greater religious diversity, which led individuals to realize it was possible to live peacefully in a religiously diverse society. This realization led to futher demands for religious liberty and separation of church and state.

Women's Roles In Fairy Tales: A Comparison Of The Portrayal Of Women In "Marienkind" Of The Brothers Grimm And Benedikte Naubert's "Ottilie"., Astrid Munder Jan 2002

Women's Roles In Fairy Tales: A Comparison Of The Portrayal Of Women In "Marienkind" Of The Brothers Grimm And Benedikte Naubert's "Ottilie"., Astrid Munder

Graduate Theses, Dissertations, and Problem Reports (ETD)

Gender roles have always been and will always be, explicitly or implicitly, a topic of literature. The different ways in which gender roles are depicted in the literature of a given period reflect the political and societal state of affairs of that period. Literary works must therefore be critically analyzed to understand them in the context of their times. German fairy tales provide important examples of this. In this thesis I will examine the literary genre of the fairy tales in order to illustrate how differently female and male authors approached the topic of the woman’s role. To do so, …

Daniel Defoe And The Reform Of The English Nation: An Examination Of His Moralistic Writings., Tiphanie N. Stocks Jan 2002

Daniel Defoe And The Reform Of The English Nation: An Examination Of His Moralistic Writings., Tiphanie N. Stocks

Graduate Theses, Dissertations, and Problem Reports (ETD)

Daniel Defoe (1660-1731) advocated social and moral reform in early eighteenth century England through his novels, pamphlets, essays, and other moralistic writings. This work traces Defoe’s reform efforts by analyzing his religious education and those political actions that helped him to develop his beliefs. While Defoe’s writings reflect religious and moral concerns that were typical of the era and addressed by other polemicists, he differed from contemporary reformers in that he used fiction as well as essays and pamphlets to disseminate his beliefs. While other writers quickly followed suit, up until 1720, only Paul Bunyan in The Pilgrim’s Progress, published …

The Effects Of Feedback On The Behavioral Profile Of Preservice Teachers Across Three Educational Levels Of The Physical Education Student Teaching Experience., Joseph Scott Townsend Jan 2002

The Effects Of Feedback On The Behavioral Profile Of Preservice Teachers Across Three Educational Levels Of The Physical Education Student Teaching Experience., Joseph Scott Townsend

Graduate Theses, Dissertations, and Problem Reports (ETD)

The student teaching experience represents one of the most important components of a novice physical educator's preservice preparation. However, current research raises several important issues regarding the cooperating teacher's role as clinical supervisor. At the present time a less than complete picture exists of the effect of feedback using systematic behavioral data by cooperating teachers on their assigned preservice teacher in a variety of settings. This study adds to a research base that has rarely used behavior analytic designs in the past decade. A reversal to baseline research design was used to determine whether cooperating teachers could provide systematically collected …

The Relationship Between West Virginia School Principals' Self-Perceived Brain Hemispheric Cognitive Styles/Leadership Styles And Identified Schools Of Excellence., James Perry Varner Jan 2002

The Relationship Between West Virginia School Principals' Self-Perceived Brain Hemispheric Cognitive Styles/Leadership Styles And Identified Schools Of Excellence., James Perry Varner

Graduate Theses, Dissertations, and Problem Reports (ETD)

The purpose of this study was to identify the predominant self-perceived brain hemispheric cognitive styles and leadership styles of principals of schools identified as a West Virginia School of Excellence and to compare these with principals of schools that have not been identified as a West Virginia School of Excellence. The following research questions provided the focus for this study: Is there a difference between West Virginia principals of schools identified as a West Virginia School of Excellence and principals of schools not identified as a School of Excellence who perceive themselves as: (1) Right brain hemispheric cognitive style and …

Challenging A Tradition Of Exclusion: The History Of An Unheard Story At Harvard Law School, Luz E. Herrera Jan 2002

Challenging A Tradition Of Exclusion: The History Of An Unheard Story At Harvard Law School, Luz E. Herrera

Faculty Scholarship

In a series of lectures at Harvard University, Professors Lani Guinier and Gerald Torres posited that people of color are the "miner's canary" in American society. Guinier and Torres argue that pursuing color blindness policies is dangerous because it ignores racial differences that affect every aspect of our society. According to Guinier and Torres, like the miner's canary that uses a call of distress to warn the miner of the hazardous atmosphere in the mine, the critiques people of color offer our institutions are warning signals to alert us to the presence of more systemic problems. Instead of relegating the …

Tempest In A Teacup Or The Mystique Of Sexual Legal Discourse, Dana Neacsu Jan 2002

Tempest In A Teacup Or The Mystique Of Sexual Legal Discourse, Dana Neacsu

Law Faculty Publications

This article is about sex; but not about sex meaning gender, an adjective, or “that thing we are.” It is about sexual behavior. It is, in Professor Franke's words, about sex as verb--“that thing we do”--or, to quote Judge Posner, it is about that “quintessential private activity [of] our culture.” However, it does not focus on sex as “the ultimate animal necessity.” That would be the realm of today's talk shows headed by Jerry Springer and his ilk. Instead, it focuses on the pervasiveness of sexual discourse in the legal realm and tries to explain the reason behind it. This …
