The second era started in 1938 when the Federal Housing Administration began working on a national code. The article identifies these sprawling second era towns as deficient. A third era is now underway and is heavily influenced by the first era towns.

This Article is a response to Steven Goldberg's article and lecture "Religious Contributions to the Bioethics Debate: Utilizing Legal Rights while Avoiding Scientific Temptations," 30 Fordham Urb. L.J., 35 (2002) (available at http://new.fordhamj.org/demonstration/dc/v30/13_30FordhamUrbLJ35(2002-2003).pdf). Assisted Reproductive Technologies And The Constitution, Carl H. Coleman Jan 2002

Assisted Reproductive Technologies And The Constitution, Carl H. Coleman

Fordham Urban Law Journal

This Article discusses potential policies regarding assisted reproductive technologies (ARTs). The initial question is whether ARTs should be viewed as private matters or as issues that affect overall social good. The author explains that this question may be answered by the Supreme Court's interpretation of the principles of procreative liberty. He then examines Supreme Court decisions regarding reproductive rights, including the unstated right to bear children as well as abortion rights. He extrapolates from these cases the Court's possible views on ARTs and what constitutional protections should be afforded reproductive technologies.

Protestant Perspectives On The Uses Of The New Reproductive Technologies, Cynthia B. Cohen Jan 2002

Protestant Perspectives On The Uses Of The New Reproductive Technologies, Cynthia B. Cohen

Fordham Urban Law Journal

This Article explores the emerging positions that Protestants may have on new reproductive technologies (NRTs). Although there is no central teaching, there are main points of agreement among Protestants and other Christians regarding the morality of using reproductive technology. The author examines Protestant teachings on the meaning of procreation, the good of the resulting children and the integrity of family bonds to show that these technologies are generally morally acceptable, but with certain limitations.

The Goodness-Of-Fit Ethic For Informed Consent, Celia B. Fisher Jan 2002

The Goodness-Of-Fit Ethic For Informed Consent, Celia B. Fisher

Fordham Urban Law Journal

This Essay argues that informed consent policies for adults with mental disorders need to reflect a relational approach that re-conceptualizes consent vulnerability in terms of a "goodness-of-fit" between patient characteristics and the consent context. The author explains the concept of consent vulnerability and how it applies to individuals with mental disorders and may itself impair their ability to make informed decisions. She then examines four psycho-legal standards of informed consent and how to enhance their usefulness and accuracy. Finally, she provides three hypothetical situations and applies the "goodness-of-fit" model to them to illustrate the function of the concept.

The Physician's Conscience, Conscience Clauses, And Religious Belief: A Catholic Perspective, Edmund D. Pellegrino

Fordham Urban Law Journal

Examining The Psychometric Properties Of The Toronto Alexithymia Scale -20 With A Sample Of Domestic Violence Offenders, Bernard James Kniery

All-Inclusive List of Electronic Theses and Dissertations

This study explores the psychometric qualities of the twenty-item Toronto Alexithymia Scale (TAS-20) with a sample of 262 men who have battered their female partners and have attended a court recommended domestic violence program. Specifically, this study explores the three-factor structure, proposed by the authors of the TAS-20 (Bagby et al., 1993; Bagby, et al., 1994a), with a sample of domestic violence offenders. The study seeks to determine if the subscales of the TAS-20 demonstrate internal consistency and if the variables of age,Education, and income correlate with alexithymia scores. The study also explores the relationship between alcohol and drug use …

Serotonin Transporter Promoter Polymorphism, Peripheral Indexes Of Serotonin Function, And Personality Measures In Families With Alcoholism, Scott F. Stoltenberg, Geoffrey R. Twitchell, Gregory L. Hanna, Edwin H. Cook, Hiram E. Fitzgerald, Robert A. Zucker, Karley Y. Little Jan 2002

Serotonin Transporter Promoter Polymorphism, Peripheral Indexes Of Serotonin Function, And Personality Measures In Families With Alcoholism, Scott F. Stoltenberg, Geoffrey R. Twitchell, Gregory L. Hanna, Edwin H. Cook, Hiram E. Fitzgerald, Robert A. Zucker, Karley Y. Little

Department of Psychology: Faculty Publications

A functional polymorphism in the regulatory region of the serotonin transporter gene (5-HTTLPR) is considered to be a plausible candidate gene for anxiety-related personality traits and for alcoholism. Empirical support for the association between 5-HTTLPR and psychological traits has been somewhat inconsistent; however, observations of the functional dominance of the low-activity s-allele over the l-allele have been more consistent. When studying the influence of particular genes on psychological traits, it seems useful also to assess more biological intermediate traits that may mediate the effects of those genes on the traits of interest. The present study examined relationships between 5-HTTLPR genotype, …

Thirteen Ways Of Looking At The Law, Bert I. Huang Jan 2002

Thirteen Ways Of Looking At The Law, Bert I. Huang

Faculty Scholarship

I was of three minds
Like a tree
In which there are three blackbirds.

The emergence of external disciplines within legal scholarship seems to have fractured its intellectual focus. Technical and specialized academic writing, moreover, appears to be drifting ever farther from the theaters of legal action. Judge Richard Posner's latest book of essays, Frontiers of Legal Theory, challenges such perceptions: Even as it celebrates the breadth of interdisciplinary legal scholarship, it seeks coherence among myriad methodologies. Even as it delights in the abstract constructs of social science, it emphasizes their practical impact. And as one might expect of Judge …

Marital Commitment And The Legal Regulation Of Divorce, Elizabeth S. Scott Jan 2002

Marital Commitment And The Legal Regulation Of Divorce, Elizabeth S. Scott

Faculty Scholarship

The question of the appropriate role of law in regulating marriage and divorce is the subject of much controversy in the United States – a raging battle of the “Culture Wars” (Hunter, 1991). On one side are social conservatives, who view divorce and family instability as an important source of societal decline. These advocates of “family values” adopt a somewhat punitive tone, arguing that the family can be saved only if the government restricts divorce, by reinstituting fault grounds and discouraging unhappy spouses from selfishly defecting from their responsibilities. Liberals tend to oppose all restrictions on divorce, partly on the …

Quantification Of Land-Use Impact On Stream Water Quality, Scott Dennis, Indrajeet Chaubey, Brian Haggard Jan 2002

Quantification Of Land-Use Impact On Stream Water Quality, Scott Dennis, Indrajeet Chaubey, Brian Haggard

Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences

Accelerated eutrophication of Beaver Lake in northwest Arkansas is a major environmental concern. When developing watershed-management plans to protect lake water quality, it is important that linkages among land-use activities and water quality of tributary streams be quantified. This study assessed longitudinal base-flow and storm-flow water quality at War Eagle Creek and quantified linkages between stream water quality and land-use conditions within the War Eagle Creek sub-watershed of the Beaver Lake watershed. We collected six water samples: three from base-flow conditions and three from storm-flow conditions during Spring 2002. In general, concentrations of nitrate nitrogen (NO3-N), total N (TN), total …

Is There A Constitutional Right To Clone, Cass R. Sunstein Jan 2002

Is There A Constitutional Right To Clone, Cass R. Sunstein

UC Law Journal

Recent scientific innovations, and proposed legislation have raised - questions about the nature of the constitutional right to reproductive freedom, and in particular about whether there is a constitutional "right to clone." This Essay urges that as a matter of substantive due process, rationality review is probably appropriate, and that restrictions on both reproductive and therapeutic cloning would and should survive constitutional scrutiny. At the same time, many of the arguments for banning both forms of cloning are based on ignorance, myths, and speculation. It is extremely important to distinguish between reproductive and nonreproductive cloning, and it is equally important …
