Something To Remember, Something To Celebrate: Women At Columbia Law School In, Barbara Aronstein Black Jan 2002

Something To Remember, Something To Celebrate: Women At Columbia Law School In, Barbara Aronstein Black

Faculty Scholarship

In this issue the Columbia Law Review joins in the celebration the 75th anniversary of the admission of women to the Columbia Law School. I am grateful to the editors of the Review for inviting me to contribute, and for the open-endedness of the invitation (or, in other words, what follows is my fault, not theirs). This has been an opportunity for me to do some research, some recalling and some reflection (and to tell a few stories). My research is incomplete, one might say sketchy, but I trust reliable as far as it goes. My recollections may well not …

Natural Law And Public Reasons, Kent Greenawalt Jan 2002

Natural Law And Public Reasons, Kent Greenawalt

Faculty Scholarship

In this Lecture I shall discuss the reasons that officials and citizens should rely upon in American politics. In recent years, various theorists have claimed that people in liberal democracies should rely in politics on "public reasons," reasons that are accessible to all citizens. Others have objected that such a counsel is unreasonable, if not incomprehensible. I shall concentrate on two facets of this issue. First, does the law exemplify a structure of public reasons – that is, do judges deciding cases draw on a stock of public reasons that is narrower than all the reasons one might give for …

Owen Fiss, Equality Theory, And Judicial Role, Susan P. Sturm Jan 2002

Owen Fiss, Equality Theory, And Judicial Role, Susan P. Sturm

Faculty Scholarship

This essay uses Owen Fiss’ treatment of equality doctrine in “Groups and the Equal Protection Clause” to demonstrate the influence of judicial role conceptions on equality jurisprudence. Fiss’ conception of the judiciary’s role in elaborating and enforcing public norms profoundly shapes his articulation of the anti-subordination principle. More specifically, Fiss looks to the federal judiciary unilaterally to declare public law truths and to impose those truths on noncompliant bureaucrats. This static, almost imperial role places great pressure on the judiciary to adopt unitary equality norms that can be implemented, at least in theory, through top-down imposition. Fiss’ commitment to a …

This Will Hurt Me More Than It Hurts You: Social And Legal Consequences Of Criminalizing Delinquency, Jeffrey Fagan Jan 2002

This Will Hurt Me More Than It Hurts You: Social And Legal Consequences Of Criminalizing Delinquency, Jeffrey Fagan

Faculty Scholarship

What happens to adolescents once placed in the criminal justice system and the potential violations of human rights that ensue is the focus of this essay. The pace of change, the severity of the new laws, the potential for unintended negative outcomes, and the empirical reality of adult punishment of juvenile offenders creates new urgency to these questions. Unfortunately, there has been little analysis of the comparative effects of statutes and administrative laws that relocate juvenile offenders to the adult court, and there has been virtually no research on the efficacy, impact and consequences of sentencing juveniles as adults. There …

Understanding Enron: "It's About Gatekeepers, Stupid", John C. Coffee Jr. Jan 2002

Understanding Enron: "It's About Gatekeepers, Stupid", John C. Coffee Jr.

Faculty Scholarship

What do we know after Enron's implosion that we did not know before it? The conventional wisdom is that the Enron debacle reveals basic weaknesses in our contemporary system of corporate governance. Perhaps, this is so, but where is the weakness located? Under what circumstances will critical systems fail? Major debacles of historical dimensions – and Enron is surely that – tend to produce an excess of explanations. In Enron's case, the firm's strange failure is becoming a virtual Rorschach test in which each commentator can see evidence confirming what he or she already believed.

A Qualitative Inquiry Into Why And How Special Educators Leave The Field, Jane E. Caraway Jan 2002

A Qualitative Inquiry Into Why And How Special Educators Leave The Field, Jane E. Caraway

Dissertations and Theses @ UNI

The purpose of this inquiry was to take an in-depth look at special educators’ decisions to leave the field of special education through their personal reflective stories. The study examined factors that influenced why these teachers made their decision to leave their chosen field. It also ventured into how those decisions were made in terms of the complex and personal events preceding their final departures. Throughout the inquiry the phenomena of special education teacher attrition was held up to a work adjustment framework. The framework explored the job satisfaction of these teachers during their experiences in special education and documented …

FOCUS on Boise State

In light of the 6oth anniversary of Pearl Harbor and the   9-11 terrorist attacks, Americans are reflecting on the role of patriotism and the military. For many in the Boise State community, military service was a duty and the horrors of war remained with them for the rest of their lives. In far-flung locations, some with exotic and unpronounceable names, they earned a new appreciation for the rights and freedoms we so often take for anted. In this issue of FOCUS, we look at a few of their stories.

The Traffic In Women, Emma Goldman Jan 2002

The Traffic In Women, Emma Goldman

UC Law SF Journal on Gender and Justice

This article originally appeared in print in 1910 and provides an historical perspective on the trafficking in women. Though it may seem to have been only recently discovered, the traffic in women has flourished for time immemorial. Structures of economic and social stratification directly produce the sale of bodies. Legislative remedies prove futile. The end of sexual trafficking requires both the replacement of outdated values regarding sex and gender, and the abolition of industrial slavery.

Asylum For Trafficked Women: Escape Strategies Beyond The T Visa, Tala Hartsough Jan 2002

Asylum For Trafficked Women: Escape Strategies Beyond The T Visa, Tala Hartsough

UC Law SF Journal on Gender and Justice

Trafficking in persons is a global trade sustained by the profits from forced labor. Human traffickers exploit poverty, disparate female rights and emergent political situations. Trafficking violates the human rights of people who are bought and sold, enslaved by debt bondage schemes, and manipulated by contracts. Increasingly, these human commodities end up in the United States. The U.S. government recognized the gravity of the situation by enacting the Victims of Trafficking and Violence Protection Act of 2000. This note examines how the Act protects victims and trafficking, and suggests an alternative route to protection under U.S. asylum jurisprudence. It examines …
