Treaty Fishing Rights: A Habitat Right As Part Of The Trinity Of Rights Implied By The Fishing Clause Of The Stevens Treaties, O. Yale Lewis Iii Jan 2002

Treaty Fishing Rights: A Habitat Right As Part Of The Trinity Of Rights Implied By The Fishing Clause Of The Stevens Treaties, O. Yale Lewis Iii

American Indian Law Review

The fishing right guaranteed by the fishing clause of the Stevens Treaties between the United States and the Indians of Western Washington should be considered a trinity of rights: a right of access, a right of equitable apportionment, and a habitat right. While seven different Supreme Court decisions and scores of lower court decisions examine the contours of the first two elements of the fishing right, the contours of the final element of the right remain unsettled. No appeals court has ruled on whether there, is an implied habitat right. While some trial courts have skirted the issue, only one …

Non - Legitimate Illness, Embodied Experience And The Moral Career: The Case Of Me/Cfs, Tracey Collett Jan 2002

Non - Legitimate Illness, Embodied Experience And The Moral Career: The Case Of Me/Cfs, Tracey Collett

School of Law, Humanities and Social Sciences Theses

The condition known as myalgic encephalomyelitis or chronic fatigue syndrome (ME/CFS) is an illness of unknown aetiology which affects over 150 000 persons in the UK. Whilst the cause of the condition is the subject of intense medical debate, the official view is that it is a form of atypical depression or somatisation disorder. This view is at odds with the views of many sufferers who claim that ME/CFS is a pathological disease that renders them severely incapacitated. Sufferers' maintain that, because their condition is regarded as a minor, psychological illness, its' severity is not recognised. Thus, rather than being …

Working Caregivers: Issues, Challenges, And Opportunities For The Aging Network, Margaret B. Neal, Donna Wagner

Institute on Aging Publications

This paper provides an overview of the issues associated with working caregivers. We will examine the social and demographic trends influencing the growth of this group, their characteristics and their contributions to elders, and the consequences of caregiving for caregivers and their work. Next, we will briefly describe the various employer-initiated programs currently in place to support working caregivers and the evolution of these programs, followed by federal and state governments’ response to working caregivers, to date. The remainder of the paper details the potential role of the aging network in better supporting working caregivers, including current best practices and …

Proposed Statement On Auditing Standards : Auditing Fair Value Measurements And Disclosures;Auditing Fair Value Measurements And Disclosuses; Exposure Draft (American Institute Of Certified Public Accountants), 2002, June 28, American Institute Of Certified Public Accountants. Auditing Standards Board

Exposure Drafts, Comment Letters, and Statements of Position

In recent years, generally accepted accounting principles (GAAP) have required entities to significantly increase the use of fair value for measuring, presenting, and disclosing in their financial statements assets, liabilities, and specific components of equity. The business environment and GAAP that apply to the transactions and events in that environment have become more complex. Along with that complexity and the increased use of fair value measurements and disclosures comes an increasing acknowledgment of the importance of fair values in the financial reporting process. The ASB believes that a Statement on Auditing Standards (SAS) providing overall guidance on auditing considerations relating …

In Thought, Word, And Deed: Suicidal Behaviors Of Adjudicated Youth, Kevin Corcoran, Thomas Crofoot Graham Jan 2002

In Thought, Word, And Deed: Suicidal Behaviors Of Adjudicated Youth, Kevin Corcoran, Thomas Crofoot Graham

School of Social Work Faculty Publications and Presentations

This study examines suicide ideation, plans, and attempts by youth in two juvenile justice settings: incarcerated youth (n=83) and youth with community service sentences (n=144). The incarcerated sample reported 51% suicide ideation while the community sample reported 22%. For both samples, suicide contemplators were quite likely (60-70%) to have a suicide plan, while about 35% reported a suicide attempt in the past 12 months. Contemplators were distinguishable from noncontemplators on scores for external problems of delinquency and aggression, internal problems of anxiety, depression, withdrawal and somatic complaints, general depression, and general health status. The results have implications for assessment, triage, …

Models Of Inclusion: Standing At The Cross Roads. Building Inclusive Child Care Through Child Care Development Funds, Eileen M. Brennan, Shane Ama, Elizabeth Haran Caplan, Olivia Warfield, Sherry Archer Jan 2002

Models Of Inclusion: Standing At The Cross Roads. Building Inclusive Child Care Through Child Care Development Funds, Eileen M. Brennan, Shane Ama, Elizabeth Haran Caplan, Olivia Warfield, Sherry Archer

School of Social Work Faculty Publications and Presentations

The passage of the Americans with Disabilities Act (ADA) in 1990 has produced a growing recognition that children with disabilities have the same rights as other children to participate in community-based child care settings (Whitney, Grozinsky, & Poppe, 1999). But even a legal mandate is not sufficient to guarantee access to realistic and suitable child care options for every family, particularly those having children with emotional or behavioral disorders (National Child Care Information Center [NCCIC], 1997). The presentation addressed governmental policy and planning efforts to include children with emotional or behavioral challenges in settings with typically developing children. Particularly, presenters …

Evaluation Of Radionuclide Induced Damage In Marine Invertebrates, Josephine Anne Hagger Jan 2002

Evaluation Of Radionuclide Induced Damage In Marine Invertebrates, Josephine Anne Hagger

School of Biological and Marine Sciences Theses

Limited studies have been carried out to assess the potential effects of ionising radiation on marine organisms. Therefore the general aims of this thesis were, (a) to assess the cytotoxic, genotoxic and developmental effects of ionising radiation on the embryo-larvae of two ecologically relevant marine invertebrates Mytilus edulis and Platynereis dumerilii, (2) to assess the effects of an environmentally relevant cocktail of radionuclides (3) to monitor the potential impact of radiation in the natural environment and finally (4) attempt to predict the potential effects of radiation at a population level. Following validation of developmental stages and mammalian based cytotoxic and …

Factors Affecting The Production Of E1 Type Particleboard, Gökay Nemli̇ Jan 2002

Factors Affecting The Production Of E1 Type Particleboard, Gökay Nemli̇

Turkish Journal of Agriculture and Forestry

This study aimed to determine the best manufacturing variables for the high physical and mechanical properties, and formaldehyde emission of particleboards produced from E_1 type adhesive. In the production of particleboards, two different press temperatures, press times, pressures and three different adhesive use ratios were used. The best manufacturing variables were determined for the particleboard produced from E_1 type adhesive. The effects of these manufacturing variables on formaldehyde emission, bending strength, internal bonding strength and thickness swelling were investigated. According to the results, when the E_1 type adhesive was employed, the use of 11% and 9% adhesive use ratios for …

An Evaluation Of Physically Based And Empirically Determined Evapotranspiration Models For Nursery Plants, Hali̇l Kirnak, R. C. Hansen, H. M. Keener, Ted Henry Short

Turkish Journal of Agriculture and Forestry

A lysimeter study was conducted to determine the evapotranspiration (ET) rates of Red Sunset red maple (Acer Rubrum 'Red Sunset') nursery trees under outdoor conditions in August and September 1997. The average ET rate was 0.084 mm day^{-1}. This measured ET rate was compared with calculated ET rates based on four physical ET (i.e., Penman, Penman-Monteith, Stanghellini and Fynn) and two empirically determined ET models (vapor pressure deficit (VPD) and solar radiation based empirical ET models). The Penman-Monteith and Penman models overestimated the measured ET rate by 15% and 31%, respectively while the Stanghellini and Fynn models underestimated the measured …

Vertex-Unfoldings Of Simplicial Manifolds, Erik D. Demaine, David Eppstein, Jeff Erickson, George W. Hart, Joseph O'Rourke

Computer Science: Faculty Publications

We present an algorithm to unfold any triangulated 2-manifold (in particular, any simplicial polyhedron) into a non-overlapping, connected planar layout in linear time. The manifold is cut only along its edges. The resulting layout is connected, but it may have a disconnected interior; the triangles are connected at vertices, but not necessarily joined along edges. We extend our algorithm to establish a similar result for simplicial manifolds of arbitrary dimension.
