Free Speech Rationales After September 11th: The First Amendment In Post-World Trade Center America, Marin Roger Scordato Jan 2002

Free Speech Rationales After September 11th: The First Amendment In Post-World Trade Center America, Marin Roger Scordato

Scholarly Articles

The tragic events of September 11th generated numerous proposals for greater security measures and increased police powers that might, if implemented, constrict the customary scope of free speech in the United States. Legitimate concerns for internal security have placed increased pressures on traditional constitutional protections for expressive activity. It is against this backdrop that this article presents a careful examination of the basic rationales for adopting constitutional level protections for free speech. The article analyzes the nature of, and many of the conflicts among, the traditional rationales for a constitutional right of free expression. It also suggests that much of …

Organophosphorous Insecticide Contamination In Streams: Insects As Bioindicators, Brian M. Andersen Jan 2002

Organophosphorous Insecticide Contamination In Streams: Insects As Bioindicators, Brian M. Andersen

Dissertations and Theses @ UNI

Organophosphorous (OP) insecticides are widely used around the world to control pests. These insecticides can enter streams and rivers and impact nontarget aquatic organisms by inhibiting acetylcholinesterase (ACE), a nervous system enzyme necessary for normal behavior and survival. However, these contamination events are usually brief and often missed by chemical analyses attempting to detect OP insecticides. Although ACE activity has been used as a bioindicator of OP insecticide exposure in humans and wildlife for many years, few studies have investigated using aquatic insect ACE activity as a potential bioindicator of OP insecticide contamination in streams. This study used the mayfly …

The Adequacy Of International Law For Arms Control – Post Sept. 11: Arms Control And Nonproliferation, Antonio F. Perez Jan 2002

The Adequacy Of International Law For Arms Control – Post Sept. 11: Arms Control And Nonproliferation, Antonio F. Perez

Scholarly Articles

Arms control was never an end in itself. Arms control and nonproliferation policy always had as their goals increasing international security. It may be worth recalling that, in response to having it called to his attention that he had changed his views on a matter, Lord Keynes is widely reported to have quipped, "When the facts change, what do you do?" Indeed, as Lord Keynes also once said, "There is no harm in sometimes being wrong-especially if one is promptly found out."

The question for this panel is whether the sea change in strategic thinking reflected in the arms control …

Attachment Object Effects On Children's Anxiety During School-Related Transitions, Lauriann M. Jones

UNF Graduate Theses and Dissertations

Because a child's first day of school can be anxiety provoking, familiar soothing inanimate objects, such as blankets, might help to minimize discomfort related to this novel situation. The current study examined the anxiety level of twenty-six one- to four-year-old children and their mothers at three times 1) before the first day of school, 2) during separation from their mother on the first day of school, and 3) after home from their first day of school. Maternal report was used to assess child and mother anxiety levels (Likert scale 0- 10) and child level of attachment to a familiar inanimate …

Constructing A Public Community College Presidency: A Retrospective Study, Annabel Brooks

UNF Graduate Theses and Dissertations

This retrospective, qualitative case study examined the complexities of leadership in a community college setting under a single, long-term president. Six critical events were identified by 16 key informants as a basis for reflection on their views of the 23-year presidency of Dr. William Seeker at Florida Keys Community College.

The researcher found a highly participatory leadership model and a college that functions in a less hierarchical manner than is traditionally encountered in community colleges. The study further revealed that the president of Florida Keys Community College expanded the role of president by giving priority to the construction of a …

Decision Makers' Thinking During The Design And Implementation Of A K-5 High-Computer-Access (Hca) Program, Constance Dianne Gutknecht

UNF Graduate Theses and Dissertations

As present trends in education indicate, learning with technology is increasingly being considered as a means of instructional delivery for K-1 2 learners. Educational leaders must be informed of how to provide the experiences, skills, and knowledge required of the learners for whom they are responsible.

This qualitative study examined the conceptualization of a school district's attempt to design and implement a high-computer-access (HCA) program. Research methodologies included interview, observation, and analysis of related documents. The results comprised the thinking of the HCA program designers and how they viewed learning theory and effective instruction principles in relationship to the HCA …

The Science, Law, And Politics Of Fetal Pain Legislation, Kevin C. Walsh Jan 2002

The Science, Law, And Politics Of Fetal Pain Legislation, Kevin C. Walsh

Scholarly Articles

Most people prefer not to inflict gratuitous pain on other sentient beings, especially other humans. What, then, should be the legal system's reaction to the mounting evidence that in late-term abortions doctors are inflicting just such pain on fetuses who have the anatomical, physiological, and neurological capacity to experience it? The pain being inflicted is gratuitous because it can be easily avoided with no significant increases in cost or health risk by the administration of tar geted fetal pain relief. If informed that an abortion is likely to cause pain to the fetus and given a choice between a procedure …

A Study Of The Validation Of The Constructive Inquiry Science Reasoning Skills Test, Matthew John Stier Jan 2002

A Study Of The Validation Of The Constructive Inquiry Science Reasoning Skills Test, Matthew John Stier

Dissertations and Theses @ UNI

The development of student's science reasoning abilities is a central goal of science education. To meet this goal researchers have investigated the development of science reasoning abilities using a variety of instruments, Classroom Test of Formal Reasoning, Objective Referenced Evaluation in Science, clinical interviews or laboratory process tests. However, while many of these instruments have been designed to test logical thinking, scientific reasoning, and inquiry skills, problems with them include restriction of student choices, guidance, encouragement of guessing, content dependence, testing of cognitive level only, decontextualized questions, developmental inappropriateness, and time/monetary expense. A novel instrument was developed to fill a …

Feminist Issues And Concerns In The Fictions Of Two Egyptian Women Writers: Alifa Rifaat And Nawal El-Saadawi, Shafiqa Anwar Fakir Jan 2002

Feminist Issues And Concerns In The Fictions Of Two Egyptian Women Writers: Alifa Rifaat And Nawal El-Saadawi, Shafiqa Anwar Fakir

Dissertations and Theses @ UNI

This thesis involves an examination of feminist issues and concerns in the fictions of two contemporary Egyptian women writers: Alifa Rifaat and Nawal el-Saadawi. The main focus will be on illuminating the social, sexual, economical problems that the literary female characters encounter and how they deal with these various forms of oppressions. Examination of these author's lives and works illustrates the complexity of women within the boundaries of the same nation in matters of gender justice and equality. This further, implicitly, illustrates the complexity of Arab women who tend to be viewed as a cohesive whole.

A Pneumatically Actuated Manipulandum For Neuromotor Control Research, Aaron J Suminski, Kristina M. Ropella, Robert A. Scheidt Jan 2002

A Pneumatically Actuated Manipulandum For Neuromotor Control Research, Aaron J Suminski, Kristina M. Ropella, Robert A. Scheidt

Biomedical Engineering Faculty Research and Publications

Functional magnetic resonance imaging (fMRI) techniques have great potential for identifying which neural structures are involved in the control of goal-directed reaching movements. However, fMRI techniques alone are not capable of probing the neural mechanisms involved in acquisition of novel motor behaviors because such studies require that the moving limb be perturbed in a controlled fashion. We outline a plan to design and develop a non-metallic, pneumatically actuated tool that, along with systems identification techniques and functional magnetic resonance imaging (fMRI), will characterize and quantify how the human central nervous system uses sensory information during practice-based motor learning.

The Effects Of School Size And Gender On Adolescents’ Perception Of Stress, Dixie K. Nederhoff Jan 2002

The Effects Of School Size And Gender On Adolescents’ Perception Of Stress, Dixie K. Nederhoff

Dissertations and Theses @ UNI

Due to financial difficulties many communities have consolidated their schools. Consolidation has resulted in larger schools than in the past and, possibly, a more stressful environment for adolescents. This study examined the perceived stress level of adolescents attending schools classified as IA, 2A, 3A, and 4A. The secondary purpose was to investigate gender differences in perceived stress. It was hypothesized that school size would have no effect on perceived stress as reported by adolescents. Also, based on previous literature, it was hypothesized that there would be gender differences in the perceived stress of adolescents.

The participants (N = 732) in …

Dimensions Of Servant-Leadership In American Not-For-Profit Hospitals, William C. Mason Jan 2002

Dimensions Of Servant-Leadership In American Not-For-Profit Hospitals, William C. Mason

UNF Graduate Theses and Dissertations

The leadership of American not-for-profit hospitals is one context in which servant-leadership finds appropriate expression. However, little research exists that explores the sources of servant-leadership within the leader, what processes leaders use to engage in servantleadership, or what impact servant-leadership has on organizations and communities. This research presents a new perspective offering insight into those questions.

The Dimensions of Servant-Leadership in American Not-for-Profit Hospitals is a qualitative study of the lives and works of four chief executive officers of successful not-for-profit health systems identified as exemplars of servant-leadership. The researcher further examined perceptions of servant-leadership among colleagues of each of …

Privacy, Eh! The Impact Of Canada's Personal Information Protection And Electronic Documents Act On Transnational Business, Juliana M. Spaeth, Mark J. Plotkin, Sandra C. Sheets

Vanderbilt Journal of Entertainment & Technology Law

In 2002, the requirements imposed by PIPEDA will extend to encompass all personal health information. PIPEDA will ultimately extend to the collection, use, or disclosure of all personal information in the course of any commercial activity within a province in 2004. This change in Canadian law carries significant consequences for the general business practices of American companies that conduct, or may conduct, business with Canadians. It is therefore crucial for lawyers with clients collecting personal data on- and offline to familiarize themselves with its requirements in order to counsel clients effectively about their current and future obligations under this privacy …

On The Ropes: New Regulations And State Cooperation Step Into The Ring To Protect Boxing From Itself, David Altschuler

Vanderbilt Journal of Entertainment & Technology Law

It is the central thesis of this Note that the NAAGs recommendations represent the necessary linchpin in creating a coherent regulatory regime for ensuring that professional boxing is both safe and legitimate. In order to place a discussion of regulatory solutions in a proper frame, this Note begins by describing the problems that have long plagued professional boxing. This Note next explicates two federal laws designed to redress the corruption and abuses lawmakers found to be inherent in professional boxing. These laws are the Professional Boxing Safety Act ("PBSA") and the Muhammad Ali Boxing Reform Act ("Ali Act"). This Note …

The Government Tunes In To Tune Out The Marketing Of Violent Entertainment To Kids, Shannon Mccoy Jan 2002

The Government Tunes In To Tune Out The Marketing Of Violent Entertainment To Kids, Shannon Mccoy

Vanderbilt Journal of Entertainment & Technology Law

This Note examines the recent investigation conducted by the Federal Trade Commission ("FTC" or "Commission") and its 2001 Follow-Up to that inquiry. The September 2000 Report ("Report") concluded that the entertainment industry intentionally and aggressively advertises both R and PG-13 movies to children under the age of 18. As a solution, the FTC recommended self-regulation by the entertainment industry. The 2001 Follow-Up to the Report ("Follow-Up") found that although the movie industry has made progress, a greater effort must be exerted to successfully eliminate the marketing of violent entertainment to children.' Both the Report and the Follow-Up demonstrate that self-regulation …

From Subway Stations To The Information Superhighway: Compliance Strategies For Musicians To Avoid The Worldwide Entanglement Of Privacy Laws, Yvenne M. King

Vanderbilt Journal of Entertainment & Technology Law

In light of the fact that operating a website raises many complex legal issues covering numerous areas of law, this Article focuses on one area that musicians, as website owners, should address: their potential liability for third-party claims based upon violation of consumer privacy laws. This Article first discusses the importance for musician website operators of protecting consumers' privacy rights. Second, it addresses the need to establish a "global privacy compliance plan" to limit musicians' legal liabilities. Finally, it explains how musicians can go about creating such a plan by developing "minimum guidelines" and "privacy practices." ... For purposes of …

Book Publishing In The Age Of The E-Book, Nancy B. Vermylen Jan 2002

Book Publishing In The Age Of The E-Book, Nancy B. Vermylen

Vanderbilt Journal of Entertainment & Technology Law

Whatever role e-publishing is ultimately to assume in the publishing world, its emergence calls for the (re)evaluation of significant legal issues affecting the contractual relationship of authors and publishers. This Note identifies some of those issues, and where appropriate, suggests some tentative solutions. Part II of this Note sets e-publishing and the concerns it raises in context by providing a brief discussion of the traditional book publishing industry and the roles that publishing contracts and personal relationships play in that industry. Part III provides an introduction to the emerging world of e-publishing and e-books. Part IV discusses the legal issues …

Crossing The (Blue) Line: Is The Criminal Justice System The Best Institution To Deal With Violence In Hockey?, John Timmer

Vanderbilt Journal of Entertainment & Technology Law

This Note argues that the criminal justice system is ill-equipped to, and thus should refrain from, prosecuting professional hockey players for violent acts committed during the course of play. Part II examines professional hockey and provides background regarding the nature of violence in the sport. Part III then discusses the history of prosecution of violent acts committed during professional hockey games, both in Canada and in the United States, providing some context for the type of violent actions that are prosecuted. Part IV examines some of the problems that arise in the prosecution of professional hockey players, including all applicable …

Nfl General Counsel Adolpho Birch Speaks On The Nfl's Drug Policy, Adolpho Birch, Journal Of Entertainment & Tech. Law Editor Jan 2002

Nfl General Counsel Adolpho Birch Speaks On The Nfl's Drug Policy, Adolpho Birch, Journal Of Entertainment & Tech. Law Editor

Vanderbilt Journal of Entertainment & Technology Law

Our standards are set in stone and frankly I think that's the best way to do it. The Commissioner obviously has discretion to alter the discipline, but it is not the type of discretion that is used lightly. It is better in our view to have a defined system with delineated consequences that occur from the use of a prohibited substance. For example, a positive test for a performance-enhancing substance nets a four-game suspension without pay. That is the rule for a first violation and everybody knows it. And when it happens to you, you will be treated the same …

The Voluntary Practices: The Last-Gasp Of Big Time College Football And The Ncaa, Sarah Lemons Jan 2002

The Voluntary Practices: The Last-Gasp Of Big Time College Football And The Ncaa, Sarah Lemons

Vanderbilt Journal of Entertainment & Technology Law

College football is desperately in need of new NCAA rules governing voluntary practices and the real problem is that coaches will always find a way to slip around the rules in order to seize the rewards of winning. Therefore, the NCAA must perform its duty and reform the rules to protect the health and well being of the collegiate football player, because as a voluntary association of a coalition of 960 member colleges, it has been given the authority to adopt rules governing its member institutions' recruiting, eligibility, financial aid and admissions.

Part II of this Note will begin by …

Shadowing Silva, David Laraway Jan 2002

Shadowing Silva, David Laraway

Faculty Publications

The dark eroticism of Jose Asunci6n Silva's "Nocturno m" has scarcely been domesticated by over a century of criticism and the poem's canonization in countless literary anthologies. The reasons for the spell it has held over readers are apparent. Not only is the poem highly innovative from a metrical standpoint, its composition shortly after the death of Silva's sister Elvira has invited some critics to find images of incest and even necrophilia in the text.1 Others have stridently opposed such readings.2 In fact, the history of the poem's critical reception has in large measure been the history of …
