Comparisons Between Enron And Other Types Of Corporate Misconduct: Compliance With Law And Ethical Decision Making As The Best Form Of Public Relations, Cheryl L. Wade Jan 2002

Comparisons Between Enron And Other Types Of Corporate Misconduct: Compliance With Law And Ethical Decision Making As The Best Form Of Public Relations, Cheryl L. Wade

Faculty Publications

(Excerpt)

One of the most important lessons that Enron offers is that sometimes managers lie and boards fail to do their jobs. Enron’s most valuable lessons relate to corporate governance, financial disclosure, accounting practices, and the management of pension funds. One of the most illuminating lessons that Enron offers, however, may be found in the reaction of jurists, legal scholars, the media, corporate professionals, elected officials, and the investing public to the Enron collapse. The general sense of public outrage is as large as the huge financial loss suffered by investors and employees.

There is a lesson to be derived …

Vicarious Snitching: Crime, Cooperation, And "Good Corporate Citizenship", Michael A. Simons Jan 2002

Vicarious Snitching: Crime, Cooperation, And "Good Corporate Citizenship", Michael A. Simons

St. John's Law Review

(Excerpt)

This Article will examine corporate cooperation and the difficulties it can create for corporate decision-makers. Part I describes the principles of vicarious guilt that give prosecutors the power to demand corporate cooperation. Part II examines how prosecutors exercise their discretion in deciding whether to charge corporations with crimes. In Part III, the Article examines the cooperators. Just as a corporation's guilt is only vicarious, so too its cooperation can be only vicarious. In the end, it is not the corporation that cooperates, but its officers and directors-the men and women who make decisions for the corporation. For these vicarious …

Breaking The Mimetic Contract: Notes On Ideology, Intersubjectivity, And Film Theory, Giorgio Bertellini, C. Paul Sellors

Reconstruction: Studies in Contemporary Culture

[First paragraph]

In this essay we would like to sketch out a few notes outlining historical and theoretical trajectories of the confusing, and often confused, relationships between ideology, history and subjectivity in Marx, Marxism and post-Marxism. Marx and Engels' approach to ideology in The German Ideology (1845-46), spawned and influenced a variety of interpretations and philosophical positions from not only the numerous schools of Marxism proper, but also structuralism, semiotics and psychoanalysis up to the very raison d'être of discourse theory and new historicism. This reaching influence occurs only at the cost of contradiction, however, between Marxist factions -- disagreements …

See Me, Touch Me, Feel Me':(Im)Proving The Bodily Sense Of Masculinity, Marc Ouellette Jan 2002

See Me, Touch Me, Feel Me':(Im)Proving The Bodily Sense Of Masculinity, Marc Ouellette

Reconstruction: Studies in Contemporary Culture

[First paragraph]

Ultimately, this paper stems from two cultural strands which intersect in one cultural form, self-improvement advertising aimed at men. The first of these is the figure of the new man, which appeared in the mid-1980s. The novelty lies in the positioning of masculine bodies precisely for the purpose of being seen. The available criticism was not equipped to account for these positionings. The second cultural strand, the proliferation of technologies which alter the body itself, as opposed to its coverings, makes the gap in the criticism more apparent. The two cultural trends intersect most noticeably in the advertisements …

C.L.R. James, Mid-Century Marxism, And The Popular Arts, Kenton W. Worcester Jan 2002

C.L.R. James, Mid-Century Marxism, And The Popular Arts, Kenton W. Worcester

Reconstruction: Studies in Contemporary Culture

[First paragraph]

“Popular culture” has played a decidedly important role for many prominent Marxist thinkers: For Fredric Jameson, it is increasingly important in his work, for Terry Eagleton, a counterpoint to more high brow culture, and for Marx himself a potentially distracting area of inquiry. In the following examination of C.L.R. James’ interest in popular culture, Kenton Worcester argues that he was, contrary to the thought of some, very interested -- both in popular culture per se, and the relation of race to modes of expression which can only be considered “popular” in the finest sense.

Fiber Performance And Quality Of Angora Rabbits (Oryctolagus Cuniculus) In Different Trims, Juan Jaime Blacutt Toledo Jan 2002

Fiber Performance And Quality Of Angora Rabbits (Oryctolagus Cuniculus) In Different Trims, Juan Jaime Blacutt Toledo

Theses and Dissertations

In 132 rabbits belonging to the Cunicola La Esperanza Farm of the city of El Alto in the department of La Paz, the principle physical characteristics of the angora rabbit fiber were determined in a period of 3 shearings. As such they were organized into 2 groups, clearly differentiated by their sex (female and male). The obtained fiber of the different shearings were weighed in order to determine the performance of each animal and subsequently analyzed the wool in the Experimental Station of Patacamaya, where they determined the diameter, length of hair and marrow composition. The results were subjected to …

Book Of Mormon Stories Diglot Reader On Computer, Neal S. Harmon Jan 2002

Book Of Mormon Stories Diglot Reader On Computer, Neal S. Harmon

Theses and Dissertations

This report describes the design, development, and evaluation of a computer-based diglot reader of the Book of Mormon Stories of the Church of Jesus Christ of Latter-day Saints. Di means two and glot means language, thus a diglot reader combines two languages into one reader in order to teach a person to read in a new language. The program, which runs on both Macintosh and Windows computer platforms, contains fifteen chapters of the Book of Mormon Stories and introduces about four hundred Spanish words. This report includes a literature review on the diglot method and related materials, a description of …

Balance And Conflict: Variation In Attaining Work-Family Fit Among A Homogeneous Population, Laura C. Koch Jan 2002

Balance And Conflict: Variation In Attaining Work-Family Fit Among A Homogeneous Population, Laura C. Koch

Theses and Dissertations

The concept of work-family fit has recently emerged in the work and family literature, comparable to work-family balance in that it represents interactions between work and family, and yet distinct from balance in its sense of universal ownership and responsibility. Using Barnett's (1998) model of the work-social system interface as a framework, this study explores the relationship between and predictive factors of work-family fit and work-family balance. Data are from a survey of Brigham Young University's Marriott School of Management (MSM) graduate school alumni (n = 273). Findings indicate that fit and balance are indeed two separate constructs, with fit …

Navigating The Starless Night: Strategies For Understanding Autobiogeography, Matthew Wolf-Meyer, Davin Heckman Jan 2002

Navigating The Starless Night: Strategies For Understanding Autobiogeography, Matthew Wolf-Meyer, Davin Heckman

Reconstruction: Studies in Contemporary Culture

[First paragraph]

Ancient mapmakers relied upon the presence of celestial bodies for their conceptualization of the world, for their external knowledge-making tools, as if a far-off body could help to make sense of our terrestrial life/as if it couldn't. Cosmology, as a practice, relied on the construction of an external body of knowledge that the local meaning-maker could situate him- or herself into, and more broadly, their entire society and culture -- the interior is determined by its relationship to the exterior (or the exteriorized). For the ancient Greeks then, the font of Western culture, this cosmology works at once …

The Uniform Domain Name Dispute Resolution Policy: A Practical Guide, Bradley J. Freedman, Robert J.C. Deane Jan 2002

The Uniform Domain Name Dispute Resolution Policy: A Practical Guide, Bradley J. Freedman, Robert J.C. Deane

Canadian Journal of Law and Technology

Disputes involving alleged bad faith registration and use of certain Internet domain names may be arbitrated pursuant to the Uniform Domain Name Dispute Resolution Policy (the Policy) mandated by the Internet Corporation for Assigned Names and Numbers ("ICANN").

The Policy is the first attempt to establish a global set of substantive rules regarding certain kinds of Internet-related trademark disputes, and a single, international system for the arbitration of those disputes. In many respects, the Policy has fulfilled its objective of providing an efficient and cost effective means of resolving certain domain name disputes. In other respects, however, the experience with …

Who Was That Masked Man? Online Defamation, Freedom Of Expression, And The Right To Speak Anonymously, Jonathon T. Feasby Jan 2002

Who Was That Masked Man? Online Defamation, Freedom Of Expression, And The Right To Speak Anonymously, Jonathon T. Feasby

Canadian Journal of Law and Technology

As the internet continues to reach into the lives of people around the world, it facilitates interaction and the exchange of ideas between far-flung individuals and groups to an extent unprecedented in communications history. However, with this positive effect, the potential of the internet as a forum for defamation and other malfeasance has increased as well. Words online can be heard or read in places conventional forms of speech might never reach. As the United States Supreme Court put it, with the aid of the internet ". . . any person with a phone line can become a town crier …

Is Internet Gaming Legal In Canada: A Look At Starnet, C. Ian Kyer, Danielle Hough

Canadian Journal of Law and Technology

The development of the Internet has kindled many new business opportunities in the online environment. Despite the recent slump in online business growth and popularity, one line of online business is generating profit and growing at a rapid rate: the business of online gaming.

The legality of such businesses is questionable in Canada and there are few gaming cases to assist Canadian lawyers. The following analysis must be considered in light of the dearth of jurisprudence in this area and should not be considered legal advice. This area of the law is in flux and developments may be unpredictable.

When …

The New Environmental Law: Forest Certification, Errol E. Meidinger Jan 2002

The New Environmental Law: Forest Certification, Errol E. Meidinger

Journal Articles

This paper argues that the rapidly expanding practice of forest certification, together with similar developments in other sectors, is creating a new template for environmental law. Nongovernmental organizations and some industry actors are establishing binding regulatory standards, systems for monitoring compliance, sanctions for non-compliance, and, when things work well, methods for assessment and revision. It locates these developments as a part of “phase 3” of environmental law, which also involves a proliferation of other initiatives beyond traditional regulation. Finally, it offers a preliminary discussion of the efficacy, adaptability, coherence, and legitimacy of the emergent system.

Anti-Minority Riots In Unified Germany: Cultural Conflicts And Mischanneled Political Participation, Roger Karapin Jan 2002

Anti-Minority Riots In Unified Germany: Cultural Conflicts And Mischanneled Political Participation, Roger Karapin

Publications and Research

Anti-foreigner riots in eastern Germany in the early 1990s have usually been explained by ethnonationalism or racism, ethnic competition for scarce resources, and opportunistic political elites. If anti-minority riots are analyzed as a distinct phenomenon with a cross-sectional approach, local political processes emerge as more important causes. Cultural conflicts, the channeling of mobilization from nonviolent into violent forms, local political opportunities for success, and mobilization by social movement organizations convert ethnic conflict and violence into riots. A comparison of riot and non-riot localities in eastern Germany supports this argument.
