Suppose It's Not True: Challenging Mediation Ideology, Deborah R. Hensler Jan 2002

Suppose It's Not True: Challenging Mediation Ideology, Deborah R. Hensler

Journal of Dispute Resolution

Across the country, people who file lawsuits are being diverted from adjudication to mediation. Whereas once mediation was seen as the preferred means of resolving family disputes (especially those involving child custody), now it is mandated for a broad range of civil disputes. Whereas once citizens were called upon to volunteer as mediators in community justice centers outside the courts, now mediation is a line of business for lawyers whose customers are sent to them by the courts. Whereas once dispute resolution theorists called on courts to provide a variety of procedural choices for civil disputants, now courts order litigants …

Internet Delivery Mechanisms For The Continuing Professional Development Of The Marine Engineer, Anne Patricia Mcdermott Jan 2002

Internet Delivery Mechanisms For The Continuing Professional Development Of The Marine Engineer, Anne Patricia Mcdermott

Other Faculty of Science and Engineering Theses

Recent advances in communications technologies enable access to the Internet from anywhere in the world. This has generated interest, demand and research into methods of using and enhancing this technology to deliver Continuing Professional Development (CPD). This research examines issues relevant to the electronic delivery of professional updating to marine engineers in a pro-active manner locating the learner at the centre of the CPD process. Educational theories including experiential learning, andragogy, constructivism and Laurillard's conversational framework are investigated and the importance of learning styles in the design of material based on user needs is examined. A needs analysis of 1117 …

The Rules Of Inference, Lee Epstein, Gary King Jan 2002

The Rules Of Inference, Lee Epstein, Gary King

University of Chicago Law Review

Although the term "empirical research" has become commonplace in legal scholarship over the past two decades, law professors have in fact been conducting research that is empirical--that is, learning about the world using quantitative data or qualitative information--for almost as long as they have been conducting research. For just as long, however, they appear to have been proceeding with little awareness of, much less compliance with, many of the rules of inference, and without paying heed to the key lessons of the revolution in empirical analysis that has been taking place over the last century in other disciplines. The tradition …

The Creative Destruction Of Copyright: Napster And The New Economics Of Digital Technology, Raymond Shih Ray Ku Jan 2002

The Creative Destruction Of Copyright: Napster And The New Economics Of Digital Technology, Raymond Shih Ray Ku

University of Chicago Law Review

To determine whether sharing music over peer-to-peer networks such as Napster should be considered copyright infringement, we must first conclude that digital works are entitled to copyright protection. This Article argues against copyright protection for digital works because the economics of digital technology undercuts prior assumptions about the efficacy of a private property regime for information, a public good. Questioning the conventional wisdom that the two interests served by copyright, creation and public dissemination, are aligned, the Article reveals that the argument for copyright is primarily an argument for protecting content distributors in a world in which middlemen are obsolete. …

Journal Selections: Let’S Support Our Students’ Futures, Eva Stowers, Lesley J. Johnson, Susan L. Meacham

Library Faculty Research

Dietetic educators concur that use of professional journals in the undergraduate curriculum promotes student reading skills, exposes students to current research, enhances computer skills and prepares dietetic students for the real world environment. Those of us in educational institutions are continually asked to review our university library holdings; prioritizing on the basis of department selections, cost, rate of inflation, use by faculty and students and availability through interlibrary loans and other document retrieval procedures. No doubt, those in industry and clinical and private practice are also watching their budgets and are asked to review expenses for professional publications.

Momentum Spread Of Spontaneously Decaying Cold Gas In Thermal Radiation, K.P. Marzlin, J.R. Audretsch, Chong Heng Raymond Ooi Jan 2002

Momentum Spread Of Spontaneously Decaying Cold Gas In Thermal Radiation, K.P. Marzlin, J.R. Audretsch, Chong Heng Raymond Ooi

Research Publications (2000 to 2005)

We study the quantum dynamics of the center-of-mass momentum distribution for the populations of a cold gas with two-level system undergoing spontaneous decay and coupled to a Markovian thermal reservoir at arbitrary temperature. We derive the momentum-convolutionless coupled equations for momentum Fourier transform of the populations which can be easily solved numerically and analytically for a specific internal scheme and for zero-temperature cases. The time and momentum evolutions of the populations are obtained by inverse Fourier transform. The momentum spread and the center-of-mass entropy across one momentum dimension are computed and compared for different internal schemes, between zero-temperature and finite-temperature …

Technology Knowledge And Use: A Survey Of Science Educators, A. Louis Odom, John Settlage, Jon E. Pedersen Jan 2002

Technology Knowledge And Use: A Survey Of Science Educators, A. Louis Odom, John Settlage, Jon E. Pedersen

Department of Teaching, Learning, and Teacher Education: Faculty Publications

The purpose of this study was to determine the current state of technology use and know-how among members of the Association for the Education of Teachers in Science. A web-based survey site and an e-mail merge invited members to participate in the study. The survey examined the differences between current and desired levels of knowledge about using technology as an instructional tool, to support research, to enhance productivity in classroom applications, and to enhance data collection and analysis. Large mean differences about using technology as an instructional tool were found, including: (1) teaching students at a distance, (2) database applications, …
