Toward A "New Deal" For Copyright In The Information Age, Pamela Samuelson Jan 2002

Toward A "New Deal" For Copyright In The Information Age, Pamela Samuelson

Michigan Law Review

Jessica Litman believes the public needs a very good copyright lawyer, and if I have not mistaken her intentions, she is volunteering for the job (pp. 70-73). A century of Congressional deference to industry-negotiated compromises has produced, she argues, a copyright law that is both incomprehensible and unfair. This incomprehensibility might be tolerable if copyright law governed only commercial relations among industry participants, all of whom have copyright counsel. To the extent that copyright law applies to the conduct of ordinary persons, its incomprehensibility presents serious difficulties. Moreover, to the extent that copyright law makes illegal many ordinary activities of …

What's Wrong With Our Talk About Race? On History, Particularity, And Affirmative Action, James Boyd White Jan 2002

What's Wrong With Our Talk About Race? On History, Particularity, And Affirmative Action, James Boyd White

Michigan Law Review

One of the striking and original achievements of the Michigan Law Review in its first century was the publication in 1989 of a Symposium entitled Legal Storytelling. Organized by the remarkable editor-in-chief, Kevin Kennedy - who tragically died not long after his graduation - the Symposium not only brought an important topic to the forefront of legal thinking, it did so in an extraordinarily interesting way. For this was not a mere collection of papers; the authors met in small editorial groups to discuss their work in detail, and as a result the whole project has a remarkable coherence and …

Behavioral Finance And Investor Governance, Charles B. Craver Jan 2002

Behavioral Finance And Investor Governance, Charles B. Craver

GW Law Faculty Publications & Other Works

The efficient market hypothesis is a special case in finance. It explains only tiny fractions of observed phenomena. Perhaps its major contribution is a formal definition of an ideal market world, to which policy formulations may be directed and against which they can be measured. Indeed, it seems unlikely that the infirmities of market action ever will be so minuscule as to render the EMH more than a special case, though it may explain more in the future than it does now. However things evolve, during the evolutionary course the shackles of the EMH should be unloosed from corporate and …

Comparing Communication Technology On Chinese, English, And Spanish Diabetes Web Sites, Yanko F Michea, Karen Pancheri, Yang Gong, Elmer Bernstam

Faculty, Staff and Student Publications

Technological and cultural factors influence access to health information on the web in multifarious ways. We evaluated structural differences and availability of communication services on the web in three diverse language and cultural groups: Chinese, English, and Spanish. A total of 382 web sites were analyzed: 144 were English language sites (38%), 129 were Chinese language sites (34%), and 108 were Spanish language sites (28%). We did not find technical differences in the number of outgoing links per domain or the total availability of communication services between the three groups. There were differences in the distribution of available services between …

Whatever Happens To Works Deferred?: Reflections On The Ill-Given Deferments Of The Copyright Term Extension Act, J. Michael Keyes Jan 2002

Whatever Happens To Works Deferred?: Reflections On The Ill-Given Deferments Of The Copyright Term Extension Act, J. Michael Keyes

Seattle University Law Review

In contrast to the limited judicial writings on the CTEA, there is a healthy stock of insightful scholarly works on the CTEA festooning the legal journals throughout the country. This article leaps into the scholarly fray and focuses on the domestic policy justifications and assumptions relied upon by Congress in enacting the CTEA. In so doing, this article argues that the CTEA is premised upon a wayward copyright philosophy and unsupported congressional assumptions. The article also posits a modest alternative to the CTEA that would be more consonant with the philosophical tenets of copyright and more apt to achieve the …

Discoverability Of "Deleted" E-Mail: Time For A Closer Examination , Michael Marron Jan 2002

Discoverability Of "Deleted" E-Mail: Time For A Closer Examination , Michael Marron

Seattle University Law Review

This Comment will argue that the discovery rules presently require disclosure of an unacceptable amount of information. Part II of this Comment will outline some of e-mail's advantages over other communications media to help explain the rapid rise in e-mail use. Part III will then explain, in layman's terms, how e-mail actually works and discuss some of the reasons why e-mail archives are often considered as likely to contain “smoking gun” messages—the kind of evidence that can drastically affect the outcome of a case. But what is it about e-mail that can make it such a potent evidentiary weapon? The …

Classroom Analysis Of Ross Perot And Diversity Using C-Span As A Data Base, Jim Schnell

Iowa Journal of Communication

Goal: To enhance student understanding of variables that comprise and impact the process of defining what connotes sensitivity and insensitivity with diversity issues and how journalistic interpretation can affect our perception via mass media.

This article presents a unique means for classroom analysis of the blend of politics and diversity issues. A primary objective in the development of my classroom assignments is to construct activities that convey theoretical understanding and illustrate correlation between theory and real world application. Theory and the application of theory should be woven into the fabric of knowledge. The use of C-SPAN videotapes, available from the …

Changing The Quality Of Conflict Interaction: The Principles And Practice Of Transformative Mediation, Robert A. Baruch Bush, Sally Ganong Pope Jan 2002

Changing The Quality Of Conflict Interaction: The Principles And Practice Of Transformative Mediation, Robert A. Baruch Bush, Sally Ganong Pope

Hofstra Law Faculty Scholarship

Many practitioners now identify themselves as transformative mediators, who practice from the transformative perspective in some or all of their work. This article explains the unique character of transformative mediation by offering answers to three basic questions: Why is transformative mediation being sought and used by parties in conflict? What is the basic nature of the mediation process, especially the mediator's role, according to this model? How does a mediator work with the parties in transformative mediation? Answering these three questions why, what and how-will provide the reader a good overview of the transformative model in theory and practice. We …

Clarifying The Theoretical Underpinnings Of Mediation: Implications For Practice And Policy, Dorothy J. Della Noce, Robert A. Baruch Bush, Joseph P. Folger Jan 2002

Clarifying The Theoretical Underpinnings Of Mediation: Implications For Practice And Policy, Dorothy J. Della Noce, Robert A. Baruch Bush, Joseph P. Folger

Hofstra Law Faculty Scholarship

In this article we examine developments in explaining and understanding "the when and why" of mediation practice - from the "lay theories" that have informed much of the field, to Bush and Folger's articulation of three distinct and coherent ideologically based theoretical frameworks: the problemsolving framework, the harmony framework, and the transformative framework. We then trace the development of the transformative framework since its articulation in 1994, and share the insights we have gained along the way regarding the impact of increasing theoretical clarity and differentiation in the mediation field. We conclude with a discussion of the implications of ideologically …

How Does The Community Feel About Problem-Solving Courts?, Michele Bertran, Mary Barr, Charles Grodin, Monroe H. Freedman, Jacqueline Nolan-Haley

Hofstra Law Faculty Scholarship

When I was a young man, I was doing a lot of civil rights, civil liberties, and indigent criminal defense work, and I believed in the constitutionalized adversarial system. I believed in the constitutional rights of the Fifth Amendment and the Sixth Amendment, due process of law, the right to the effective assistance of counsel, the right to trial including an advocate who was going to be your champion against a hostile world.

I believed in the standard of proof beyond a reasonable doubt. I believed in the right to confront witnesses against you, the privilege against self-incrimination, equal protection …

E-Buyer Beware: Why Online Auction Fraud Should Be Regulated, Miriam R. Albert Jan 2002

E-Buyer Beware: Why Online Auction Fraud Should Be Regulated, Miriam R. Albert

Hofstra Law Faculty Scholarship

Part of a special issue on cyber law. The increasing use of the Internet as a medium of commerce has led to an increase in Internet fraud, raising new and challenging legal issues in areas including online auctions. Under current law, a defrauded participant in an online auction transaction has no recourse against the online auction site. However, the FTC should apply its substantial regulatory authority to the creation of binding regulations for online auction sites. Such regulations should include ideas such as authenticating participants' identities, limiting the number of user names per participant, verifying the creditworthiness of participants, offering …

The Constitution As Family Arbiter: A Moral In The Mess?, Janet L. Dolgin Jan 2002

The Constitution As Family Arbiter: A Moral In The Mess?, Janet L. Dolgin

Hofstra Law Faculty Scholarship

Two interconnected social upheavals that occurred in the second half of the twentieth century underlie an intensifying legal debate about the conception of family. First, Western culture openly challenged a set of assumptions that supported a vision of family as hierarchical, holistic, and almost completely separate from the marketplace. Second, a group of social institutions (including schools, churches, and voluntary communal groups) that once anchored moral debate began to recede in significance. To these upheavals, American law has increasingly responded by eliding traditional legal responses to family issues and by seeking moral direction from constitutional principles. The second of these …
