Minnesota law has long recognized the agency law principle of apparent authority. Minnesota law also provides that an agent is liable for the contractual obligations of an undisclosed or partially disclosed principal. Both of these well-recognized principles provided a basis for the plaintiff’s suit in Bagot, and both ought to provide a basis for similar suits in the future.

The Digital Divide And Equal Access To Justice, Mark Lloyd

This article begins by considering the problem of equal access to justice between those with access to communication technology and those without. It then goes on to challenge the current market-centered technology by exploring some of the dangers and limits of new communications technology as a corrective to a problem that has long divided rich and poor, a problem that defines the degree to which we can truly call ourselves a civilization, and the real and important opportunities made possible by new technologies.

This Article attempts a first step in filling the gap in the legal literature about lawyers and strategic business alliances. Part I describes the distinctive nature of strategic alliances. Part II discusses why strategic alliances pose unique problems for lawyers. Part III considers how lawyers' negotiation tactics can enhance rather than erode trust between the parties in alliances. Part IV suggests how lawyers can draft substantive contract terms that foster trust and cooperation in alliances. Boys' Aggression And Violence : A Lack Of Emotional Awareness, Samantha Lynn Flippin

As boys enter into the beginning years of adolescence, they begin a journey into a completely different world. The onset of puberty results in physical and cognitive changes that are often unexpected and challenging. As the biological changes begin, adolescents transition into middle school, with more expectations and responsibilities from the adults in their lives. Unfortunately for boys, there are no outlets for all the frustration, fear, embarrassment, anger, or other intense emotions caused by these transitions. The purpose of this essay is to suggest a new way to examine the aggression and violence of boys. I propose that boys …

This article addresses the prevailing problem of malpractice claims based on conflicts of interest. Part I of this article introduces the topic by underscoring the seriousness of all conflicts of interest and recommending preventative action. Part II describes measures that law firms can take to detect and manage conflicts and analyzes the effect of the firm’s ability to avoid conflicts claims on a firm’s ethical infrastructure. Part III focuses on some of the most common conflicts situations that result in malpractice claims and sanctions. Increased Demand Resulting In The Flourishing Recruitment And Trafficking Of Women And Girls: Related Child Sexual Abuse And Violence Against Women, Norma Hotaling, Leslie Levitas-Martin
UC Law SF Journal on Gender and Justice
The Standing Against Global Exploitation Project, Inc. ("SAGE") is organized by and for survivors of abuse, prostitution and trauma. Most of the staff have prior criminal histories, are recovering from severe drug addictions, and were formerly homeless. The staff at SAGE includes peer counselors, drug treatment counselors, therapists, acupuncturists, social workers, therapist interns, and volunteers. Within SAGE's programs, over 350 women and girls receive counseling and other services each week. Through advocacy, education programs, and direct services, SAGE raises public awareness concerning the sexual exploitation and trafficking of women and girls, as well as many other related issues for this …

Lawyers advertise to attract clients. Politicians advertise to attract voters. Businesses advertise to attract customers. All of these advertisers advertise with a common subtext: choose me, because I'm better than the rest. Hire me, vote for me, buy my product, and good things will happen. The message may be blunt, explicit, direct, linear. But often it is not. The bludgeon is not the tool of choice in modem mass advertising. The message, more commonly, is presented with subtlety, often merely suggested, often presented with indirection, irony, camp, or comedy. Information as such is not the point. The stuff of modern …

Structural Change Of The Chicago Economy: A Temporal Inverse Analysis, Yasuhide Okuyama, Michael Sonis, Geoffrey Hewings
Regional Research Institute Working Papers
Earlier study (Sonis and Hewings, 1998) proposed an alternative tool that can assist in exploiting trends and uncovering tendencies in individual sectors or groups of sectors within the context of an economy-wide system of accounts. In this paper, the methodology, Temporal Leontief Inverse Analysis, is applied to a set of annual input-output tables for the Chicago metropolitan economy during the period of 1980-97. The results are compared to the earlier analysis (Hewings et al., 1998, Okuyama et al., 2002a, and Okuyama et al. 2002b) to examine the method and to investigate further the structural changes of the Chicago economy.

Fit And Functional In Legal Ethics: Developing A Code Of Conduct For International Arbitration, Catherine A. Rogers
Michigan Journal of International Law
In this Article, the author develops a methodology for prescribing the normative content of a code of ethics for international arbitration, and in a forthcoming companion article, integrated mechanisms for making those norms both binding and enforceable are proposed. In making these proposals, the author rejects the classical conception of legal ethics as a purely deontological product derived from first principles. This Article argues, instead, that ethics derive from the inter-relational functional role of advocates in an adjudicatory system, and that ethical regulation must correlate with the structural operations of the system.
