Fiduciary Duty: A New Ethical Paradigm For Lawyer/Fiducaries, Paula A. Monopoli Apr 2002

Fiduciary Duty: A New Ethical Paradigm For Lawyer/Fiducaries, Paula A. Monopoli

Missouri Law Review

The modern academic trend, as embodied in the Uniform Probate Code (“UPC”) and the new Uniform Trust Code (“UTC”), has been to move from a interventionist model of probate toward a minimalist approach to judicial intervention. That model may not be working when it comes to lawyers acting as fiduciaries. The ethical issues and monitoring problems inherent in the confidential relationship that characterizes the attorney/client/fiduciary relationship may warrant more, rather than less, intervention. Reconceptualizing Professional Responsibility: Incorporating Equality, Rosemary Cairns Way Apr 2002

Reconceptualizing Professional Responsibility: Incorporating Equality, Rosemary Cairns Way

Dalhousie Law Journal

Are legal professionals concerned with "doing good" or just with "doing well" financially? In an age of increasing and intensifying public scrutiny there is a need to examine and challenge the legal profession's conception of professional responsibility, and how it translates into practice. This paper expresses the concern that the profession has moved too far in the direction of a "billable hours" culture, a culture that is falling short of the legal profession's obligation as a self-regulated entity to consider and acknowledge the public interest at all points. The author calls for a broader conception of professionalism, one that encompasses …

He set himself up as the leader of a racist "church" called the World Church of the Creator and immediately went about attempting to put an articulate, polite face on the organization. Hale's application to become a licensed attorney in Illinois, his subsequent denial and the litigation that followed are discussed.

Professionalism Consequences Of Law Firm Investments In Clients: An Empirical Assessment, Royce De R. Barondes

Faculty Publications

This article examines two principal hypotheses: Hypothesis 1: Law firm investments in clients diminish the extent to which those law firms require issuers to disclose adverse information in IPO prospectuses. Hypothesis 2: Those law firms that are willing to invest in their clients are generally less aggressive in requiring their clients, in their IPOs, to disclose adverse information in their IPO prospectuses.

This is a submission to the FTC that discusses this agency's use of disgorgement as a remedy in Antitrust matters. The Mead Doctrine: Of Rules And Standards, Meta-Rules And Meta-Standards, Thomas W. Merrill

Public Law and Legal Theory Papers

In United States v. Mead Corp. the Supreme Court sought to prescribe a test for determining when the Chevron doctrine applies to agency interpretations of law. The Court got off to a good start, announcing that Chevron applies when Congress has delegated authority to an agency to make rules having the force of law, and the agency has adopted an interpretation pursuant to this authority. Unfortunately, the Court was less than clear about when Congress has delegated the required authority, applying a vague standard that incorporates such elements as whether Congress has directed the agency to use relatively formal procedures, …
