A Jurisprudential Analysis Of Government Intervention And Prenatal Drug Abuse, Susan Saab Fortney

This article addresses the serious public health problem of substance abuse among pregnant women. Part I of this article introduces the national problem of prenatal drug abuse. Part II discuses the appropriateness of government intervention. The article explains the medical consequences of prenatal drug abuse, and then, describes the justification of government intervention. The article details both existing criminal law and new legislation regarding prenatal drug abuse. Part III addresses constitutional concerns and the conflict between a woman’s right on the one hand and the state interest and “fetal rights” on the other. Part IV considers the moral and legal …

Breach Of Contract?: The New Economy, Access To Justice And The Ethical Responsibilities Of The Legal Profession, Richard Devlin

In the last several years, there has been a growing awareness within the legal profession that access to justice, that is, to legal advice and representation, is becoming increasingly difficult. Nowhere is this more obvious than in the cuts to legal aid programmes. The author argues that the response of the legal profession is inadequate because it remains trapped in a welfarist paradigm of legal aid that is insensitive to the impact of the new economy and the newly emergent social investment state. Who's Talking? Disentangling Government And Private Speech, Leslie Gielow Jacobs
University of Michigan Journal of Law Reform
Several different constitutional rules apply to government actions that influence the content of speech. The government has far more discretion to determine speech content when the government itself is the speaker than when it regulates private speakers. Specifically, in the former circumstance, the government can discriminate according to viewpoint, whereas in the latter circumstance it cannot. While the application of the rules may be obvious when either the government or private entities speak alone, increasingly, through various different types of interactions, government and private groups or individuals are speaking together. Robert E. “Bob” Hirshon was born April 2, 1948 in Portland, Maine and raised there. His parents were Severin and Gladys (Wein) Hirshon. His father was a dentist. His mother worked in the home and was from the Waterville area. Bob was involved with the evaluation system for the Model Cities program in Portland during his high school years. He received his undergraduate and law degrees from the University of Michigan. He joined the law firm of Drummond, Woodsum and MacMahon in 1973. Hirshon was President of the ABA (American Bar Association) in 2001 and 2002. In 2003 he was …
