Testing For A New Economy In The 1990s, Ray C. Fair Dec 2002

Testing For A New Economy In The 1990s, Ray C. Fair

Cowles Foundation Discussion Papers

This paper examines how much structural change there was in the U.S. economy in the last half of the 1990s. The results are consistent with the hypothesis that there was only one major structural change, namely the huge increase in stock prices relative to earnings. All other large changes can be explained by this change. There is no obvious reason for the large increase in stock prices relative to earnings. Increased productivity growth does not appear to be an answer since the data show that there was only a modest increase in long run productivity growth in the last half …

The Anti-Monopoly Origins Of The Patent And Copyright Clause, Tyler T. Ochoa, Mark Rose Dec 2002

The Anti-Monopoly Origins Of The Patent And Copyright Clause, Tyler T. Ochoa, Mark Rose

Faculty Publications

The British experience with patents and copyrights prior to 1787 is instructive as to the context within which the Framers drafted the Patent and Copyright Clause. The 1624 Statute of Monopolies, intended to curb royal abuse of monopoly privileges, restricted patents for new inventions to a specified term of years. The Stationers' Company, a Crown-chartered guild of London booksellers, continued to hold a monopoly on publishing, and to enforce censorship laws, until 1695. During this time, individual titles were treated as perpetual properties held by booksellers. In 1710, however, the Statute of Anne broke up these monopolies by imposing strict …

Poly(Meta-Phenylene Isophthalamide) Nanofibers: Coating And Post Processing, Wenxia Liu, Mathew Graham, Edward A. Evans, Darrell Hyson Reneker

College of Polymer Science and Polymer Engineering

Electrospun nanofibers have applications in the areas of filtration, composites; biomaterials, and electronics. Controlling the surface properties of these nanofibers is important for many applications. Nanofibers can also be used as unique substrates for observing the growth of deposited films and creating nanoscale structures. In this work, electrospun poly(meta-phenylene isophthalamide) (MPD-I) nanofibers were used as substrates for creating nanoscale structures out of carbon-based materials and metals. MPD-I was used because it can be electrospun into nanofibers with diameters smaller than 10 nm and it has good thermal stability. MPD-I nanofibers were coated with carbon, copper, and aluminum using plasma enhanced …

Wave Packet Spreading: Temperature And Squeezing Effects With Applications To Quantum Measurement And Decoherence, G. W. Ford, R. F. O'Connell Dec 2002

Wave Packet Spreading: Temperature And Squeezing Effects With Applications To Quantum Measurement And Decoherence, G. W. Ford, R. F. O'Connell

Faculty Publications

A localized free particle is represented by a wave packet and its motion is discussed in most quantum mechanics textbooks. Implicit in these discussions is the assumption of zero temperature. We discuss how the effects of finite temperature and squeezing can be incorporated in an elementary manner. The results show how the introduction of simple tools and ideas can bring the reader into contact with topics at the frontiers of research in quantum mechanics. We discuss the standard quantum limit, which is of interest in the measurement of small forces, and decoherence of a mixed ("Schrödinger cat") state, which has …

A Rationale For Meeting Quotas Asymmetrically, J. Patrick Meister, Robert S. Main Dec 2002

A Rationale For Meeting Quotas Asymmetrically, J. Patrick Meister, Robert S. Main

Scholarship and Professional Work - Business

Under certain conditions, otherwise identical, competing firms may find it jointly preferable to face differing degrees of trade barriers on individual products rather than symmetric trade barriers. The key is the ability to reduce marginal production cost via research and development. The economic significance of this insight is that there could be a role for a market for quota allotments. This insight also has applications to Voluntary Export Restraints in which a priori symmetric, restricted firms may prefer to have individual production levels allocated asymmetrically. This indicates the need for detailed studies of how quotas are met by individual firms. …

Law, Media And Political Dissent: The Case Of The Faln, Yanira Reyes Dec 2002

Law, Media And Political Dissent: The Case Of The Faln, Yanira Reyes

Open Access Dissertations

Inspired on the works of scholars and activists that had denounced state repression of political activists in the United States, this research explores the theoretical proposal about the criminalization of political dissidence. The proposal of the criminalization of political dissidence is analyzed through the study of the case of Puerto Rican pro-independence organization Fuerzas Armadas de Liberaci6n Nacional, F.A.L.N. The subjects of this research were charged with seditious conspiracy and other charges. They claimed the status of prisoners of war and deny the jurisdiction of US courts over them. Affirming their right to fight for the independence of Puerto Rico, …

The Regulation Of Interactive Television In The United States And The European Union, Hernan Galperin, Francois Bar Dec 2002

The Regulation Of Interactive Television In The United States And The European Union, Hernan Galperin, Francois Bar

Federal Communications Law Journal

The broadcasting industry is rapidly entering the era of digitization, distributed intelligence, and interactivity. The case of interactive television offers an opportunity to investigate how desirable policy goals should be implemented in the post-convergence environment. This Article first reviews the evolution of the broadcasting industry through three successive models: the traditional "Fordist" television model, the current multichannel television model, and the emerging ITV model. Second, it characterizes the basic components of ITV and explores the concerns raised by the evolution of multichannel video programming distributors into ITV platform operators. Next, the Article reviews how regulators in the United States and …

Book Review: Ruling the Root, Milton L. Mueller, Cambridge, Mass.: MIT Press, 2002, 301 pages.

A review of Milton L. Mueller's Ruling the Root, The MIT Press, 2002. In the spring of 1998, the U.S. government told the Internet: Govern yourself. This unfocused order-a blandishment, really, expressed as an awkward "statement of policy" by the Department of Commerce, carrying no direct force of law-came about because the management of obscure but critical centralized Internet functions was at a political crossroads. In Ruling the Root, Mueller thoroughly documents the colorful history both before and after this moment of inflection, and gives …

Making And Keeping Regulatory Promises, Warren G. Lavey Dec 2002

Making And Keeping Regulatory Promises, Warren G. Lavey

Federal Communications Law Journal

Multiyear regulatory commitments, or their absence, are an important part of the functioning of the telecommunications services and products industries. In this Article, Warren G. Lavey argues that, under some conditions, it is both possible and beneficial for regulators to commit to a well-defined, multiyear sequence of regulatory changes. First, this Article examines several examples of how efforts for comprehensive reform fared in real multiyear implementations. It also explores how some piecemeal regulatory changes evolved into efforts for comprehensive reform based on a well-defined sequence. This Article considers the effects of multiyear regulatory promises through analysis of several regulatory actions …

The U.S. Supreme Court Addresses The Child Pornography Prevention Act And Child Online Protection Act In Ashcroft V. Free Speech Coalition And Ashcroft V. American Civil Liberties Union, Sue Ann Mota

Federal Communications Law Journal

Both the Child Pornography Prevention Act ("CPPA") and the Child Online Protection Act ("COPA") were intended by Congress to protect minors. The CPPA was intended to protect minors from the harmful effects of virtual child pornography. The COPA was intended to protect minors from pornography currently available commercially on the World Wide Web. However, in 2002, the U.S. Supreme Court addressed the constitutionality of both statutes: The Court struck down sections of the CPPA as overbroad and unconstitutional in Ashcroft v. Free Speech Coalition. In Ashcroft v. ACLU, the Court upheld some sections of COPA as not unconstitutionally overbroad, but …

OBJECTIVE: One of the most important prognostic features of malignant melanoma is the involvement of regional lymph nodes. The aim of this study is to identify the sentinel lymph node which is the first node to be involved by metastases from malignant melanoma and then decide which patients can benefit from lymph node dissection and which will only need clinical follow-up. METHODS: Forty-four patients were included in this study from October 2000 to November 2001. The study was carried out at the St. Bartholomew9s and Royal Hospital, London, United Kingdom. We undertook a pilot study of patients with malignant melanoma …

Veil Of Secrecy: Public Executions, Limitations On Reporting Capital Punishment, And The Content-Based Nature Of Private Execution Laws, Nicholas Levi Dec 2002

Veil Of Secrecy: Public Executions, Limitations On Reporting Capital Punishment, And The Content-Based Nature Of Private Execution Laws, Nicholas Levi

Federal Communications Law Journal

One issue that is often overlooked in the capital punishment debate is the policy to shield the public from the specifics of the application, administration, and resolution of the death sentence. First, this Note provides a brief historical and analytical account of capital punishment in this country, and ultimately argues that this historical backdrop forces courts to characterize regulations as content-based distinctions on free speech. Second, this Note provides a background of the methods of capital punishment from the time of the country's founding through the early parts of the twentieth century. Furthermore, this Note will address the emergence of …

Enhancing Competition:Are Proposed Federal Communications Commission Rules That Treat Local Exchange Carrier Access To Multiple Tenant Environments A Taking?, Kathryn Gordon

Federal Communications Law Journal

The Telecommunications Act of 1996 marked a fundamental change in the attitudes of Congress and the Federal Communications Commission toward local telephone exchange carrier policy. This change affected local exchange carriers in many ways, including their relationships with the owners of multiple tenant environments, such as office buildings and apartment complexes. Under the Act, FCC rulemaking increased competitive local exchange carriers' access to the facilities of incumbent local exchange carriers by removing competition barriers. However, owners of of multiple tenant environments can also act as barriers to local exchange carrier competition. This Note will first review the general purpose behind …

Geoelectrical Response Of An Aged Lnapl Plume: Implications For Monitoring Natural Attenuation, Douglas D. Werkema Jr. Dec 2002

Geoelectrical Response Of An Aged Lnapl Plume: Implications For Monitoring Natural Attenuation, Douglas D. Werkema Jr.

Dissertations

The geoelectric stratigraphy at a site impacted with light non-aqueous phase liquids (LNAPLs) is investigated for its link to natural biodegradation, its contribution to the conductive model for aged (i.e. mature) LNAPL contaminated sites, and the relationship to the natural hydrologic regime. The highest conductivities (lowest resistivities) were observed in portions o f soils where LNAPL was in residual and free phase. Corroborating evidence from bacteria enumeration from soil close to the vertical resistivity probe (VRP) installations show orders-of-magnitude increase in both heterotrophic and oil degrading microbes at the depths where the conductivity was at a maximum. The coincidence o …

Nonadditive Genetic Effects In Animal Behavior, Lisa M. Meffert, Sara K. Hicks, Jennifer L. Regan Dec 2002

Nonadditive Genetic Effects In Animal Behavior, Lisa M. Meffert, Sara K. Hicks, Jennifer L. Regan

Faculty Publications

Heritabilities, commonly used to predict evolutionary potential, are notoriously low for behaviors. Apart from strong contributions of environmental variance in reducing heritabilities, the additive genetic components can be very low, especially when they are camouflaged by nonadditive genetic effects. We first report the heritabilities of courtship traits in founder‐flush and control populations of the housefly (Musca domestica L.). We estimated the heritability of each male and female display through the regression of the courtships involving daughters and sons (with randomly selected mates) onto the “midparental” courtship values of their parents. Overall, the average heritability was significantly higher for the …

The Lateblight computer simulation (Arneson and Ticknor, 1990) has been implemented in the general biology laboratory and the science methods course for elementary teachers to reinforce the processes of science and to allow the students to engage, explore, explain, elaborate and evaluate the methods of building concepts in science. The students develop testable hypotheses and then use the program to run experiments and collect data. In addition, they research relevant background information and subsequently present their results in a poster during class.

Situational Tests In Student Selection: An Examination Of Predictive Validity, Adverse Impact, And Construct Validity, Filip Lievens, Pol Coetsier Dec 2002

Situational Tests In Student Selection: An Examination Of Predictive Validity, Adverse Impact, And Construct Validity, Filip Lievens, Pol Coetsier

Research Collection Lee Kong Chian School Of Business

The Flemish Admission Exam 'Medical and Dental Studies' is comprised of four cognitive ability tests and four situational tests, namely two work samples (i.e., a lecture and a medical text) and two video-based situational judgement tests (i.e., a physician-patient interaction and a medical expert discussion). On the basis of the Admission Exam scores of 941 candidates (359 men, 582 women) this study shows that situational tests significantly can predict better than cognitive ability tests, with lecture and text emerging as significant predictors. When situational tests are combined with cognitive ability tests, there are no mean gender differences. Situational tests also …

This issue of International Studies of Management and Organizationbrings together five articles that reflect the rich array of contemporaryresearch that is being conducted into the activities of the managementconsultancy industry. Management consultancy, in various forms, has existed foras long as complex organizations. However, its increasing economicsignificance, associated with the rapid expansion in the number ofconsultancies and the rise of large multinational consultancy firms, as well asthe influence and impact of the fashionable management knowledge and techniqueson which much of their work is based, are more recent phenomena. To date, detailed conceptual and empirical research into the work of consultants hasbeen slight …

Independent External Review Of Health Maintenance Organizations' Medical-Necessity Decisions, Wendy K. Mariner Dec 2002

Independent External Review Of Health Maintenance Organizations' Medical-Necessity Decisions, Wendy K. Mariner

Faculty Scholarship

States may have more freedom to regulate the practices of managed-care organizations than many observers previously believed. In the absence of congressional action on the federal Bipartisan Patient Protection Act, the primary source of patient-protection legislation remains at the state level. Nevertheless, the federal Employee Retirement Income Security Act (ERISA) of 19742restricts state regulation of health maintenance organizations (HMOs) that serve private employee group health plans. On June 20, 2002, the U.S. Supreme Court, in Rush Prudential HMO, Inc. v. Moran, upheld an Illinois state law that requires binding independent external review when an HMO disagrees with the …
