Judicial Campaign Conduct Committees, Roy A. Schotland, Barbara Reed Jan 2002

Judicial Campaign Conduct Committees, Roy A. Schotland, Barbara Reed

Georgetown Law Faculty Publications and Other Works

As the other papers presented at this Symposium make abundantly clear, the problems associated with inappropriate statements and conduct during judicial elections are unlikely to abate anytime soon. Bench and bar leaders across the country are being joined by a growing chorus of members of the media and the public in demands that something be done. As an initial step that requires relatively little yet holds great promise, the authors endorse the use of judicial campaign conduct committees as a means of long-term improvement.

Free Speech Rationales After September 11th: The First Amendment In Post-World Trade Center America, Marin Roger Scordato Jan 2002

Free Speech Rationales After September 11th: The First Amendment In Post-World Trade Center America, Marin Roger Scordato

Scholarly Articles

The tragic events of September 11th generated numerous proposals for greater security measures and increased police powers that might, if implemented, constrict the customary scope of free speech in the United States. Legitimate concerns for internal security have placed increased pressures on traditional constitutional protections for expressive activity. It is against this backdrop that this article presents a careful examination of the basic rationales for adopting constitutional level protections for free speech. The article analyzes the nature of, and many of the conflicts among, the traditional rationales for a constitutional right of free expression. It also suggests that much of …

Whacking Unarmed Women: Gaps In The Law Of Armed Conflict, Michael F. Noone Jr. Jan 2002

Whacking Unarmed Women: Gaps In The Law Of Armed Conflict, Michael F. Noone Jr.

Scholarly Articles

In recent years, legal commentators have begun to write on women in war: usually as the civilian victims of belligerent forces, sometimes as military victims of discrimination within their own armed forces. Very little has been written about women as belligerents. What has been written does not focus on the legal problems conventional forces face when women are "unprivileged belligerents"' who fail to comply with law of war requirements for combatant status. These problems can become acute when conventional forces are engaged in "Small Wars" where unarmed women often serve as auxiliaries to their unconventional opponents. Although legal sources have …

The Extent Of Protection Of The Individual’S Personality Against Commercial Use: Toward A New Property Right, George P. Smith Ii Jan 2002

The Extent Of Protection Of The Individual’S Personality Against Commercial Use: Toward A New Property Right, George P. Smith Ii

Scholarly Articles

The purpose of this Article is to explore the extent of an individual's right of privacy, vis-à-vis the concepts of commercial use and appropriations, which compromise rights of publicity. The deceptively simple, yet complex, conclusion to be drawn from this analysis is that a delicate balance of interests must be struck, either legislatively or judicially, between recognizing a full right of privacy, and its permutations in the right of publicity, with the press and news media. A definitive balancing test may be elusive, but at a minimum, a framework for principled decision making must be attempted. It is imperative that …

Allocating Health Care Resources To The Elderly, George P. Smith Ii Jan 2002

Allocating Health Care Resources To The Elderly, George P. Smith Ii

Scholarly Articles

Health is not an absolute condition, but is assessed by reference to age and other factors. Therefore, a relative scale is necessary to determine whether an elderly person’s right to health care is being satisfied. Today, older Americans are increasingly affected by the growing need to regulate health care delivery. Since 1900, those over the age of 85 years have become twenty-one times as numerous in society, with an eightfold increase in the number of people over the age of 65. Given the need to curb rising health care costs — particularly the expenses related to caring for older individuals …

Politicization And Judicialization Of The U.S. Chief Executive’S Political And Criminal Responsibility: A Threat To Constitutional Integrity Or A Natural Result Of The Constitution’S Flexibility?, Rett R. Ludwikowski Jan 2002

Politicization And Judicialization Of The U.S. Chief Executive’S Political And Criminal Responsibility: A Threat To Constitutional Integrity Or A Natural Result Of The Constitution’S Flexibility?, Rett R. Ludwikowski

Scholarly Articles

This article attempts to analyze to what extent the scope of executive privilege, constitutionally committed to the executive branch, is determined by judicial process or by purely political factors. It opens with a brief report on the process of formation of the Presidential model of government and the system of checks and balances in the United States. Focusing on the checks imposed on the Executive, this article distinguishes those restraints that are clearly constitutionalized, or stemming from judicial determination of their constitutionality, and those which are the result of judicial interpretation of the beneficial aspects of public policy or political …

Distributive Justice And Health Care, George P. Smith Ii Jan 2002

Distributive Justice And Health Care, George P. Smith Ii

Scholarly Articles

The challenge of contemporary health care distribution is to structure a framework for normative decision making whereby the goal of distributive justice is achieved equitably for as many citizens as possible. Establishing fair procedures for the distribution of health care resources is a crucial goal for contemporary society to set and, hopefully, to achieve. It is only by and through deliberate debate within a democracy that assumptions, for example, about aging, the value of life for the aged and intergenerational responsibilities of assisting them in their care can be set, tested or - as the case may be - rejected. …

Rethinking Sullivan: New Approaches In Australia, New Zealand And England, Susanna Frederick Fischer Jan 2002

Rethinking Sullivan: New Approaches In Australia, New Zealand And England, Susanna Frederick Fischer

Scholarly Articles

This Article employs a comparative analysis of some important recent Commonwealth libel cases to analyze what has gone wrong with U.S. defamation law since New York Times v. Sullivan and to suggest a new direction for its reform. In Lange v. Australian Broadcasting Corporation, Lange v. Atkinson, and Reynolds v. Times Newspapers, the highest courts of the Australian, New Zealand, and English legal systems were confronted with the same challenge faced by the U.S. Supreme Court in New York Times v. Sullivan. They had to decide the proper constitutional balance between protection of reputation and protection …

Feminist Issues And Concerns In The Fictions Of Two Egyptian Women Writers: Alifa Rifaat And Nawal El-Saadawi, Shafiqa Anwar Fakir Jan 2002

Feminist Issues And Concerns In The Fictions Of Two Egyptian Women Writers: Alifa Rifaat And Nawal El-Saadawi, Shafiqa Anwar Fakir

Dissertations and Theses @ UNI

This thesis involves an examination of feminist issues and concerns in the fictions of two contemporary Egyptian women writers: Alifa Rifaat and Nawal el-Saadawi. The main focus will be on illuminating the social, sexual, economical problems that the literary female characters encounter and how they deal with these various forms of oppressions. Examination of these author's lives and works illustrates the complexity of women within the boundaries of the same nation in matters of gender justice and equality. This further, implicitly, illustrates the complexity of Arab women who tend to be viewed as a cohesive whole.

Book Publishing In The Age Of The E-Book, Nancy B. Vermylen Jan 2002

Book Publishing In The Age Of The E-Book, Nancy B. Vermylen

Vanderbilt Journal of Entertainment & Technology Law

Whatever role e-publishing is ultimately to assume in the publishing world, its emergence calls for the (re)evaluation of significant legal issues affecting the contractual relationship of authors and publishers. This Note identifies some of those issues, and where appropriate, suggests some tentative solutions. Part II of this Note sets e-publishing and the concerns it raises in context by providing a brief discussion of the traditional book publishing industry and the roles that publishing contracts and personal relationships play in that industry. Part III provides an introduction to the emerging world of e-publishing and e-books. Part IV discusses the legal issues …

Nfl General Counsel Adolpho Birch Speaks On The Nfl's Drug Policy, Adolpho Birch, Journal Of Entertainment & Tech. Law Editor

Vanderbilt Journal of Entertainment & Technology Law

Our standards are set in stone and frankly I think that's the best way to do it. The Commissioner obviously has discretion to alter the discipline, but it is not the type of discretion that is used lightly. It is better in our view to have a defined system with delineated consequences that occur from the use of a prohibited substance. For example, a positive test for a performance-enhancing substance nets a four-game suspension without pay. That is the rule for a first violation and everybody knows it. And when it happens to you, you will be treated the same …

The Impact Of State Prohibitions Of Punitive Damages On Libel Litigation: An Empirical Analysis, Dennis Hale

Vanderbilt Journal of Entertainment & Technology Law

Specifically, the Article identifies appellate court decisions for media libel cases over a ten year period from 1986 to 1995, comparing five states with punitive damages (Alabama, New Mexico, South Carolina, South Dakota and Tennessee) to five states without punitive damages (Louisiana, Massachusetts, Nebraska, Oregon and Washington). Each appeal of a federal or state media libel case was coded for the following characteristics: year, whether the media won …
