The Tragicomedy Of The Public Domain In Intellectual Property Law, Samuel Oddi Jan 2002

The Tragicomedy Of The Public Domain In Intellectual Property Law, Samuel Oddi

UC Law SF Communications and Entertainment Journal

As the overall amount of protected and protectable subject matter expands, duration of protection grows longer, and overlap between types of protection increases, constituencies who rely upon intellectual subject matter as stimuli for the creative process grow concerned about incursions of the private domain into the public. This Article explores the relationship between the public domain as a source of sensory stimuli, the creative process as a generator of ideas, and the interaction among the public and private domains and the intellectual process - both in a "state of nature" and under the protections of an intellectual property system - …

The Impact Of Burnout On Human Physiology And On Operational Performance: A Prospective Study Of Soldiers Enrolled In The Combat Diver Qualification Course, Charles A. Morgan Iii, Tracey Cho, Gary Hazlett, Vladimir Coric, Jeff Morgan Jan 2002

The Impact Of Burnout On Human Physiology And On Operational Performance: A Prospective Study Of Soldiers Enrolled In The Combat Diver Qualification Course, Charles A. Morgan Iii, Tracey Cho, Gary Hazlett, Vladimir Coric, Jeff Morgan

National Security Faculty Publications

(from p. 201) "If little is known about the pathophysiology of burnout, even less is known about the actual impact of burnout on military operational performance. This is due to a lack of studies focused on military performance. Whether or not soldiers may feel symptoms of burnout is one thing - whether this state actually affects how they do their job is another. Within the current environment (reduced forces, increased training rates, increased deployment rates, extended tours) we believe that military personnel may be at significant risk for the development of burnout. Further, we wondered if there was a demonstrable …

The Right Of Refuse: A Call For Adequate Protection Of A Pharmacist's Right To Refuse Facilitation Of Abortion And Emergency Contraception, Donald W. Herbe Jan 2002

The Right Of Refuse: A Call For Adequate Protection Of A Pharmacist's Right To Refuse Facilitation Of Abortion And Emergency Contraception, Donald W. Herbe

Journal of Law and Health

The purpose of this Note is not to argue for or against either the pro-life or pro-choice positions. The purpose of this Note is to shed light on a serious moral dilemma that faces many pharmacists today, to call for universal acceptance in the pharmacy profession of a right of conscience, and to suggest adequate state and national legislative measures that would protect and prevent pharmacists from having to act contrary to their basic moral convictions. Section I provides background regarding present day abortive and contraceptive drug therapies and the role of the pharmacist in providing such medications. Section II …

Biogenesis And Traffic Of The Potassium Channel, Natalie De Souza Jan 2002

Biogenesis And Traffic Of The Potassium Channel, Natalie De Souza

Student Theses and Dissertations

Excitability of nerve and muscle cells depends on the number and the types of ion channels expressed at the plasma membrane. This work examines aspects of biogenesis and traffic of the Shaker voltage-gated potassium channel. Shaker is an oligomeric, polytopic membrane protein and, as such, its biogenesis begins at the endoplasmic reticulum (ER). I have studied (i) targeting of Shaker to the ER and stable integration into the lipid bilayer, (ii) N-linked glycosylation, assembly and folding Shaker in the ER, and (iii) export of Shaker from the ER and subsequent traffic to the surface. Targeting to the endoplasmic reticulum, integration …

The Mythological Role Of Gender Ideologies: A Cross-Cultural Sample Of Traditional Cultures, Richard Owens Jan 2002

The Mythological Role Of Gender Ideologies: A Cross-Cultural Sample Of Traditional Cultures, Richard Owens

Nebraska Anthropologist

Hunting and gathering along with horticultural societies provide a basis for understanding contemporary ideologies. Such groups are generally labeled as egalitarian societies from their status and treatment of females. A survey of traditional hunters-gatherers and horticultural societies compared their mythological charters on gender ideologies to the dally interactions of gender roles in order to determine their level of influence on the culture. Traditional societies are thought to be a basis to observe gender stratification among all known societies. The division of labor is in all cultures, as a means to limit control economic resources, often favoring men. In this paper …

The Need For The Expansion Of Military Reservists' Rights In Furtherance Of The Total Force Policy: A Comparison Of The Userra And Ada, Andy P. Fernandez Jan 2002

The Need For The Expansion Of Military Reservists' Rights In Furtherance Of The Total Force Policy: A Comparison Of The Userra And Ada, Andy P. Fernandez

St. Thomas Law Review

The call to arms has sounded! The militia awaits and the citizen-soldier must stop all his daily activities and chores. His industrial pursuits, projects, and presentations are only half done. There are bills that are unpaid; insurance, credit cards, car payments, house payments, and loan payments. What income will my family have to sustain them through the deployment? There are still so many chores left undone, the citizen-soldier thinks as he reaches for his equipment. Who will take care of my home? Will my family be fine? Can they manage? I hope so. There will be so much more to …

Effectively Including Human Factors In The Design Of New Facilities, Johan Hendrikse, Kevin Mcsweeney, Eileen B. Hoff, Paul Atkinson, Gerry Miller, George Connor, Ben Poblete, Rick Meyer, Pat O'Connor, Hilde Heber Jan 2002

Effectively Including Human Factors In The Design Of New Facilities, Johan Hendrikse, Kevin Mcsweeney, Eileen B. Hoff, Paul Atkinson, Gerry Miller, George Connor, Ben Poblete, Rick Meyer, Pat O'Connor, Hilde Heber

United States Department of Transportation: Publications

Human error is a major cause of incidents in the offshore industry. For example, in the Gulf of Mexico region in 1998, 38% of all incidents were attributed to human error with an additional 9% of incidents resulting from slips, trips, and falls (MMS 2000-021, OCS Report). Human Factors, when integrated during the design of a new offshore facility, can reduce the potential for human error and the occurrence of unfortunate incidents.

Quite often the implementation of Human Factors (HF) during design is disregarded because of the notion that it will add unacceptable costs. Review of the cost/benefit data contained …

The Effects Of Singing On Blood Pressure In Classically Trained Singers, Kimberly Jaye Broadwater Jan 2002

The Effects Of Singing On Blood Pressure In Classically Trained Singers, Kimberly Jaye Broadwater

LSU Major Papers

Blood pressure readings were taken in four normotensive, classically trained singers of varying age and experience. The results show changes during the systolic and diastolic phases of blood pressure measurements while singing. While systolic blood pressure changes were individualized and random, diastolic blood pressure changes generally showed a direct correlation to changes in intrathoracic pressure. Additional research using a larger subject base involving normotensive, hypertensive, and hypotensive populations is warranted.

Seasonality Of Cardiovascular Disease Risk Factors, Donna Garland Robbins Jan 2002

Seasonality Of Cardiovascular Disease Risk Factors, Donna Garland Robbins

All ETDs from UAB

Generalizability of possible seasonality of cardiovascular disease risk factors has not been demonstrated, and, if present, biologic mechanisms remain uncertain. This was addressed by examining cross-sectional seasonal variation in cardiovascular disease risk factors among Coronary Artery Risk Development in Young Adults (CARDIA) subjects, and cross-sectional and longitudinal seasonal variation in and interrelationships between lipids and thyroid hormone levels in a Lipid Variation Influence of Stress (LVIS) study subsample. Although crude analyses identified some significant seasonal variation in low density lipoprotein (LDL) cholesterol, physical activity, maximum heart rate, caloric intake, triglycerides, body weight and blood pressure overall and/or among race/gender strata …

The Effects Of Oryzanol On Bone Mineral Density In Ovariectomized, Retired Breeder Rats, Heather Compton Colona Jan 2002

The Effects Of Oryzanol On Bone Mineral Density In Ovariectomized, Retired Breeder Rats, Heather Compton Colona

LSU Master's Theses

The accelerated rate of bone loss that occurs after menopause may be reduced by consuming rice bran oil (RBO), which contains natural oryzanol. Three different forms of oryzanol (natural oryzanol, NO; crystalline oryzanol, CO; and solubilized oryzanol, SO) were evaluated in a rat model of postmenopausal women. Retired Sprague-Dawley breeder rats were stratified by weight and assigned randomly to one of five groups for a thirteen week study. Rats were either variectomized (O, n=37) or sham-operated (ShC, n=10) and assigned to control (C) diets (OC, n=10 or ShC, n=10) or one of three forms of oryzanol (NO, n=9; CO, n=9; …
