A Study Of The Relationship Between Coal Mine Fatalities And The Length Of Time A Mine Has Been Opened., Nancy L. Dorset
Graduate Theses, Dissertations, and Problem Reports (ETD)
The cause and number of coal mining fatal accidents has been recorded since state mine inspection offices began in the mid 1870’s. With the advent of the United States Bureau of Mines, coal mine fatalities were analyzed in various ways. This study looks at the data from a novel direction: the relationship between fatality incidence rates and how long a mine has been active. Data from 1991 to 2000 was extracted from both the MSHA fatality reports and the MSHA Address/Employment database. The binomial proportion statistical test was used to determine when deaths exceeded or fell below the expected number …

An Oral Hygiene Education Program Based On An Assessment Of The Oral Health Needs Of Children Ages Four To Seven In Guastatoya, Guatemala., Heather Denise Gibson
Graduate Theses, Dissertations, and Problem Reports (ETD)
The people of Guastatoya, Guatemala have received minimal dental intervention and their dental needs have never been assessed. The purpose of this study was to assess the dental health needs of the children (ages four to seven) residing in this town. Based on these needs an oral hygiene education program was developed, implemented, and evaluated. A systematic sample resulted in 32 participants. The effectiveness of this three-phase study (assessment, disease control intervention, and post-assessment) was determined by utilizing four indices (DMFS, defs, OHI-S, and P-M-A). All subjects received oral bacterial plaque removal. Oral health education was provided to the experimental …
Developmental Versus Prescriptive Advising: An Investigation Of Advising Delivery At A Major University., Kristi Doniel Wood
Developmental Versus Prescriptive Advising: An Investigation Of Advising Delivery At A Major University., Kristi Doniel Wood
Graduate Theses, Dissertations, and Problem Reports (ETD)
Academic advising is an essential connection between student and university. Two types of advising, prescriptive and developmental, are examined in relation to the level of advising (pre-major versus major) and type of advisor (full time advisors or parttime graduate student advisors for pre-majors, and faculty or full-time department advisors for majors) in four academic areas selected for contrast in advising approaches at a large land grant institution. Questionnaires were developed, piloted, finalized, and administered to select upper division students and their pre-major and major advisors concerning the types of advising practiced and student perceptions of each. Results showed that full-time …

Children who experience difficulties with peers also tend to experience both concurrent social–psychological difficulties and long-term negative developmental outcomes. Specifically, a significant amount of research has identified peer rejection and isolation as significant precursors to academic troubles and socially deviant behavior (DeRosier, Kupersmidt, & Patterson, 1994; Kupersmidt, Coie, & Dodge, 1990; Parker & Asher, 1987; Parker, Rubin, Price, & DeRosier, 1995). Substantial research and intervention efforts have consequently been dedicated to an understanding of the problem behaviors commonly identified as correlates or antecedents of peer rejection. Childhood aggression is one of the most significant predictors of peer rejection, and has …

Factors For Effective Learning Groups In Face-To-Face And Virtual Environments, Charles R. Graham
Factors For Effective Learning Groups In Face-To-Face And Virtual Environments, Charles R. Graham
Faculty Publications
Group work has been a powerful instructional method used in face-to-face learning environments. To date, group work has not reached the same prominence in distance learning environments where there is a strong emphasis on independent or individualistic learning. This may be due in part to the perceived difficulty of engaging students in working together at a distance, as well as a general lack of knowledge about the factors that contribute to effective virtual group work. This paper reviews the literature related to creating effective learning groups in face-to-face and virtual environments. Research from the following four areas was used: cooperative …

Early space radiation shield code development relied on Monte Carlo methods and made important contributions to the space program. Monte Carlo methods have resorted to restricted one-dimensional problems leading to imperfect representation of appropriate boundary conditions. Even so, intensive computational requirements resulted and shield evaluation was made near the end of the design process. Resolving shielding issues usually had a negative impact on the design. Improved spacecraft shield design requires early entry of radiation constraints into the design process to maximize performance and minimize costs. As a result, we have been investigating high-speed computational procedures to allow shield analysis from …
The Influence Of Pitch And Loudness Changes On The Acoustics Of Vocal Tremor, Christopher Dromey, Paul Warrick, Jonathan Irish
The Influence Of Pitch And Loudness Changes On The Acoustics Of Vocal Tremor, Christopher Dromey, Paul Warrick, Jonathan Irish
Faculty Publications
The effect of tremor on phonation is to modulate an otherwise steady sound source in its amplitude, fundamental frequency, or both. The severity of untreated vocal tremor has been reported to change under certain conditions that may be related to muscle tension. In order to better understand the phenomenon of vocal tremor, its acoustic properties were examined as individuals volitionally altered their pitch and loudness. These voice conditions were anticipated to alter the tension of the intrinsic laryngeal muscles. The voices of 10 individuals with a diagnosis of vocal tremor were recorded before participating in a longitudinal treatment study. They …

Vibrato Rate Adjustment, Christopher Dromey, Neisha Carter, Arden Hopkin
Faculty Publications
Summary: The goal of the present study was to document the acoustic changes that occur as singers attempt to increase or decrease their vibrato rate to match target stimuli. Eight advanced singing students produced vowels with vibrato in three registers, both naturally and while attempting to match faster or slower rate stimuli. Slower rates were associated with lower intensity and less steady vibrato. Faster rates involved increased vibrato extent in the chest register and increased intensity in the head register. Singers whose spontaneous vibrato rates were naturally either slower or faster tended to also be relatively slower or faster when …

Bringing Online Learning To Campus: The Hybridization Of Teaching And Learning At Brigham Young University, Gregory L. Waddoups, Scott L. Howell
Faculty Publications
The primary purpose of Brigham Young University (BYU) is to provide students with a combination of sacred and secular education often described as the BYU experience. Achieving this purpose is challenged by the rapid growth in Church membership and an enrollment cap of 30,000 students. To address these challenges, BYU sponsors the use of technology to bridge the gap between the increased Church membership and the number of students allowed under the enrollment caps. This institutional case study shows how these challenges have influenced the hybridization of teaching and learning for on campus (resident) and off campus (distance) students. It …
When Voluntary, Incentive-Based Controls Fail: Structuring A Regulatory Response To Agricultural Nonpoint Source Water Pollution, Douglas R. Williams
When Voluntary, Incentive-Based Controls Fail: Structuring A Regulatory Response To Agricultural Nonpoint Source Water Pollution, Douglas R. Williams
All Faculty Scholarship
This article is part of the Symposium, Sustainable Agriculture: Food for the Future. Recognizing that, to date, farms had largely escaped regulation under the Clean Water Act, and that agricultural nonpoint source pollution is a leading contributor to impaired water quality, this article advocates for a regulatory response to such pollution. It considers existing programs to control nonpoint source pollution and demonstrates that they are inadequate. The article makes three recommendations: (1) an increased federal regulatory presence is needed; (2) the costs of implementing nonpoint source controls should be distributed in a pragmatic way that recognizes the extraordinary organizational presence …
Whither Antitrust? The Uncertain Future Of Competition Law In Health Care, Thomas L. Greaney
Whither Antitrust? The Uncertain Future Of Competition Law In Health Care, Thomas L. Greaney
All Faculty Scholarship
Although instrumental in ushering in competition to the health care industry and later in safeguarding the competitive structure of markets, antitrust law has come under attack. A series of questionable judicial decisions has clouded the standards applicable to analyzing health care markets. Legislative efforts to immunize conduct from antitrust challenge also have gathered support in recent years. This study finds scant economic or policy basis for these developments and concludes that anti-managed sentiments have diluted enthusiasm for applying competitive principles in health care. This phenomenon has resulted in outcome-driven judicial decisions and legislative activity geared to serving political expediency rather …
The National Wildlife Refuge System And The Hallmarks Of Modern Organic Legislation, Robert L. Fischman
The National Wildlife Refuge System And The Hallmarks Of Modern Organic Legislation, Robert L. Fischman
Articles by Maurer Faculty
This article explores the origins and precise meaning of the term "organic act," which is widely used in public land law. The evolution in the meaning of the term reflects larger shifts in the role of legislation in public resource management. The article illustrates this with an analysis of the 1997 Refuge Improvement Act, a substantial revision of the charter for the Refuge System and the first major statute governing public land management enacted since the 1970s.
The Refuge System's "dominant use" regime is an important model for sustainable resource management. The article describes this regime in the context of …

Articles by Maurer Faculty
This article addresses health privacy in the broader context of other areas of recent privacy activity, in an effort to discover what people should have learned in trying to identify those principles that should undergrid regulatory efforts to protect privacy. Increasingly, the dominant trend in recent and pending privacy legislation is to invest consumers with near absolute control over information in the marketplace. - irrespective of whether the information is, or could be, used to cause harm. The Health Insurance Portability and Accountability Act privacy rules wholly ignore the concept of harm and the constitutional requirement of targeting restriction on …

A History Of Jewish Life In The Central Appalachian Coalfields, 1870s To 1970s., Deborah R. Weiner
Graduate Theses, Dissertations, and Problem Reports (ETD)
This study explores the intersection of two historical phenomena. From the 1880s to the 1920s, Central Appalachia experienced rapid industrial development as the entry of railroads into the mountains initiated large-scale coal extraction. At the same time, East European Jewish immigrants streamed into America's eastern seaboard. Some found their way to the coalfields, where they carved out a role as retailers in an expanding rural-industrial economy. This niche enabled them to build several small but vital Jewish communities which lasted late into the twentieth century. Their economic position facilitated the entry of Jews into the coalfield middle class and made …

Patent Abolitionism, Mark D. Janis
Patent Abolitionism, Mark D. Janis
Articles by Maurer Faculty
In this Article, Professor Janis argues that modem enthusiasm for large-scale legislative reforms in patent law should be received with caution in view of the history of patent law reform. That history suggests that patent law is more resilient--or perhaps more impervious to change-than modem reformers recognize. To explore these propositions, Professor Janis analyzes the history of the mid-Victorian era British patent abolitionism movement. He demonstrates that much of the reform dialogue of that era, from the elucidation of major problems in the patent system, to the formulation of legislative solutions, mirrors quite closely the modem U.S. patent reform debate. …

Organizations are facing many problems as they strive to maintain a well-trained workforce. A diverse workforce separated by location and work schedule as well as decreases in funding, personnel, training materials, and other resources, face-to-face training has become more difficult to accomplish. Paradoxically, because of the increase in job knowledge, fast-paced business practices, and the flood of technological innovations, now more than ever it is imperative that organizations have a workforce that is fully prepared to meet the challenges of the workplace. As a result, organizations must find effective, alternate ways to ensure that their employees have the information they …
