The author argues in this Comment that disingenuity as first resort is an unwise approach to the conflict between our ex ante and our later, illness-endangered selves. Not only does rationing by tacit deceit raise a host of moral problems, it will not work, over the long haul, because markets reward deceit's unmasking. The honesty about clinical limit-setting that some bioethicists urge may not be fully within our reach. This article will ask a series of questions. What is third party sexual harassment? Under what conditions does it occur? Does it differ in any significant respects from traditional notions of sexual harassment? Should those differences, if any, make a difference in the way that the legal system addresses third party harassment? And indeed, should the problem be addressed solely through the legal system? What might an employer do to alleviate sexual harassment of this type?

The Supreme Court recently held in United States v. Mead Corp. that agency interpretations should receive Chevron deference only when Congress has delegated power to the agency to make rules with the force of law and the agency has rendered its interpretation in the exercise of that power.

The first step of this inquiry is difficult to apply to interpretations adopted through rulemaking, because often rulemaking grants authorize the agency to make "such rules and regulations as are necessary to carry out the provisions of this chapter" or words to that effect, without specifying whether "rules and regulations" encompasses …

The proposed Hague Convention on Jurisdiction and Foreign Judgments in Civil and Commercial Matters is currently drafted to cover most fields of private litigation, including intellectual property. However, as those following the Hague process are aware, the Convention has run into considerable difficulties. There is currently reason to be concerned that it may not be promulgated at all, or that if it is promulgated, that it will be reduced in scope and cover only select areas of litigation, likely not to include intellectual property. One of the primary attributes of a free market economy is the uninhibited flow of truthful information regarding the goods and services available in the marketplace (Azcuenaga 1995). Chilo partellus (Swinhoe) is a major pest of maize in East Africa. Its indigenous natural enemies are unable to regulate its densities to a level acceptable to farmers. Cotesia flavipes Cameron (Hymenoptera: Braconidae), a larval parasitoid of C. partellus now established in Kenya, was released in 1993 from Pakistan for the control of this pest. A major constraint in evaluating the establishment of C. flavipes, is the great amount of time spent for its field collection and identification. This study focuses on the level, stressors and symptoms of stress on bus drivers of ICB. This study was carried out at Intrakota Consolidated Berhad (!CB), Taman Tun Dr Ismail, Kuala Lumpur. A total of 138 respondents answered the questionnaires that have been distributed and 50 observations have been made thoroughly upon the ICB bus drivers within the area of Lembah Kelang. The findings of the study indicates that stress exist among the bus drivers. Most of them experienced low level of stress. Kajian ini dijalankan untuk melihat tanggapan responden terhadap keberkesanan pengurusan kaunseling Program Bantuan Pekerja (EAP) di Telekom Malaysia. Subjek kajian terdiri daripada 30 orang klien yang mewakili 75% responden yang pernah mengikuti kaunseling Program Bantuan Pekerja (EAP) di Telekom Malaysia. Satu set borang soal selidik yang dibentuk sendiri oleh penulis telah digunakan sebagai alat untuk mendapatkan maklumat kajian. Manakala kiraan kekerapan, peratus dan min digunakan untuk melihat tanggapan responden terhadap penekanan dalam kaunseling EAP, kesesuaian modul, kepakaran kaunselor EAP dan prestasi mereka selepas mengikuti kaunseling. Preparation Of Pvc- Clay Nanocomposites By Solution Blending, Dongyan Wang, Charles A. Wilkie

PVC-clay nanocomposites have been prepared by solution blending of the polymer with both sodium montmorillonite and an organically modified clay. The nanocomposites have been characterized by X-ray diffraction and transmission electron microscopy; in all cases the materials are best described as mixed immiscible—intercalated nanocomposites, Thermogravimetric analysis shows that, in some cases, the onset temperature of the degradation is enhanced, and the fraction of nonvolatile residue is always decreased. This decrease in the amount of char indicates a significant change in the degradation pathway of the polymer, caused by the presence of the clay. For some preparations, the tensile strength and …

In this essay, Katherine Franke explores how dissent becomes a different, and in some ways more interesting, phenomenon when the dissenter emerges not from outside the political horizon drawn by the state, but rather from within it, and as an integral part of the state's project of governance. In these cases, the state calls up a set of subjects who are in some fundamental sense positioned to gain state, if not public, disfavor. The current study examines a 4th grade, African-American male referred for special education eligibility evaluation. Specific academic difficulties cited on the referred included reading, writing, spelling, and math. A behavioral concern included the student's off task behavior and how it might contribute to his academic difficulties. A special education evaluation was conducted that included the procedures of reviewing the student's records, interviewing those of consequence to the evaluation, classroom observations of the student's behavior, and testing of skills. The testing procedures included nationally normed standardized tests, curriculum based assessment, permanent product review, informal reading inventory scores, and an intelligence test. …

The present study investigated what content in the area of human sexuality was being delivered to secondary students in the state of Iowa. The study was a descriptive study, which investigated the lesson plans used by the teacher(s) who delivered the participating school's sexuality education component. Specifically, the study compared what information schools cited that they were delivering to secondary students with a preset coding system developed by Ogletree, Rienzo, Drolet & Fetro (1995) to evaluate sexuality education curricula.
